- Since October 24th 2004 you may have found yourself in legal jeopardy if you owned, built, bought, or sold an Eleanor Gone is 60 seconds Shelby. Owners have been contacted simply for the paint scheme regardless of the year of manufacture. Those shenanigans are now officially over. Countless people have been raked across the legal coals because of the claims of Denice Halicki. Because a the Shelby Trust's lawsuit a court has taken the time to meticulously look into her and her legal team’s claims and after review the original films have those found those claims to be baseless. I would like to see B is for Builds get their car back. That would be a nice ending to this story.

Hope "B Is For Build" get their car back...if not, they should sue for the time, parts, labor and legal fees spent on their vehicle

I hope Chris gets it back too!
Geez can we sue for mental anguish as views? I was so bummed out when “B” lost his car!
@BisforBuild
They have a right to sue them for it back.
Hopefully Ms. Halicki will now get sued into oblivion by everyone she has bullied and/or extorted.

She is literally evil.
She and her slimey lawyer should do jail time for lying to the courts.
@@mjflit yeah if you or I would lie to a judge/court that could be 6 months jail time. Depending on the circumstances.
the fact that the earlier lawsuit ever worked was proof that the justice system is more about money than about justice. Especially the fact that they had to give her the car, as if the "copyright" justified her being able to take someone else's property.

@@blackcountryme Perhaps... I was referring to the fact that despite the Justice System's "supposed impartiality" only those who can afford to use it have any chance of a fair and equitable outcome, the adversarial system is less about truth and more about Lawyer Vs. Lawyer.
Not all judges are smart, know the law and abide by it. Not all lawyers are smart, know the law and abide by it. Big fan of "B is for Build" and I hope Chris and the team get back their car so they can finally complete it
It would be great to see him get it back, and finish it. I was really enjoying that build!
He already stated thats impossible for him to get it back and compared it to people saying "you should get your ex gf back" after she died
Chris should sue for monetary loss from the views that build would have provided .
I'm not a fan of B is for build, but I also hope he gets his car back because it was a bullshit claim. You don't have to like someone to recognized they had been screwed.
Hope doesn't resurrect the dead.
Suing doesn't either. You guys are like the people suing Alex Jones for é trillion dollars
Could you imagine this happening to anyone who built a batmobile or a back to the future delorean or a Jurassic park jeep. Imagine steve McQueen's estate suing anyone in a dark green fastback 68 mustang.
Actually it has happen with the Batmobile....
Steve Leto had a series of videos about the batmobile earlier this year. so super rich guy in CA ordered one. when he missed payment on it they moved it to the end of the line to work on paying customers cars. The deadbeat found out, pressed charges in CA and the sheriff flew investigators to Indiana to raid the shop! they actually arrested him and took him to jail! in the end, the builder was exonerated and CA dropped all charges (theft by deception and a couple others).

Her poor husband…
Unfortunately, a lot of women are like that. They're not above lying and destroying other people to get what they want. Not saying a lot of men wouldn't do the say, but the legal system holds men accountable when they do.
This is how hollywood works. They will go after every means to get money until it blows up in their face and even then they won't have any repercussions. They don't lose even when a movie bombs.
The number of possible counter suits against her for possession of vehicles she got in her suits and or the return of monies she received or basically STOLE from people she sued should definately prohibit anyone else from attempting these kind of shenanigans again. And it would serve her right for 35 years of Overloarding the Eleanor scheme ILLEGALLY.

Did you even watch the video?
Thanks for making this video. I'm glad her ridiculous lawsuits have come to an end. People should be allowed to build any replica they want. It's their car, after all.
Agreed & Thank you for watching!
Quite right! If anyone chooses to build a replica in homage to anything it is their right to do so. Copyright only comes in if you intend to profit from said venture. Even if B is for Build we're making money as a channel they are still building a replica and not trying to pass it off as anything but... Bloody blood thirsty lawyers
Not sure about the legality of replicas if it's like a new car model, but the case was just about these being sold / built as Elenor, which all the replicas are meaning the Cage one. Great to see her lose.
Agree, although I would build an actual GT500 and not an Eleanor, that thing is ugly (in my opinion).
I would also make it blue with white stripes, as an homage to a much, much better propriety than Gone in 60 Seconds.
It would be truly awesome ( and the ultimate case of Karma) if someone with bottomless pockets took this extremely personally and sued Halicki and her entire legal team back into the stone age for what they've done to people over the years regarding this.

Alcohol wouldn't hurt if you had to take notes and give ruling.

I remember watching the B is for build series and being gutted when they had the project taken away. We were all robbed of that project getting finished thanks to these dumb lawsuits. It was ridiculous from the start. I hope now that her company get sued to hell and money or projects returned along with any loss.
You shouldn't be that emotionally attached to a youtube video.
A friend of mine who owns a 67 Mustang was worried,, her name is Eleanor.
As for Ms Hallicki, her and her husband used a yellow 73 Mustang and the only similarity is the model of car.
Why she went after B is for build is a joke. And it seems so was his legal representation and the court that found in her favour.
Rename it. Problem solved.
@@goncalo33 Not the point. Nobody has the right to monopolise a name. It's pure greed.
The video here doesn't explain the outcome in detail. The judge found that the original movie used a yellow Mustang. The remake years later used a Shelby GT as the basis of the "Eleanor", something the was not in the original movie. How Mrs Halicki and her scum lawyers ever prevailed in a single copyright claim or lawsuit is beyond belief. The color, image, style and appearance of the well known "Eleanor" has no connection to her, her late husband or the original movie...

Yeah that's fair, however you're talking corporate entity to corporate entity and in that regard they have company product to protect. So yeah, i get where you're coming from.

@@goncalo33 no not so. she served B is for build a second time for a black 2007 mustang gt with a silver stripes that had nothing to do with Elenore. but claimed it was too close to the likeness of the movie car. they were drunk with power after confiscating his first car. this time his legal team told her to kick stones.
Didn't even know this was a thing, people need to sue her to show her how it feels and so they can recover loss of money, time etc
The time has been lost already = you don't get time back. Loss of money -- most people have moved on already and most of the people they sued were businesses - very few individuals.
It’s completely insane to me that Bisforbuild lost that car. The fact that you can lose a car that you own and have modified because you spoke and called it a certain name is insane. If it was Ford I could almost understand it more, but it still would be crazy.
The CZcamsr who lost his car should have it delivered back to him by the morons who took it. And she should have to pay the man for lost revenue etc on his channel.

I said this when she started this bullshit. Her husband Toby would be kissed at her. He was a real car guy and would never have done what she tried! Glad the Cali court came through. One of the very few things they got right!
I agree that Toby would not have sued Mustang builders and the like, However I believe he would never have allowed the Nicholas Cage movie to be made either.
Too bad toby didn't have better taste and discretion in women. He found a litigious golddigger.

I'm actually excited to hear this because I was very visually invested in the beautiful build series and then it came to an end abruptly like how did somebody tell you what you can do with your own car

I remember hearing something about that they actually went after the people who made and sold the body pieces, even though they weren't specifically sold as Elenore or as whole kits.
Noonne Cares, you heard correctly, they went after us MTF and miss Hi Lick Me lost her ass. She couldn't prove Trade Dress.

Yep, and Carroll Shelby himself tried to sue the entire kit car industry out of existence, but that's down the memory hole now and people adore that son of bitch... that fucking old bastard nearly killed the whole custom build industry before it even started
I'm sharing this on Twitter. I'm too broke to afford a GT500 (plus I live halfway around the world) but this still makes me happy. I love B is for Build, I hope they get to finish their project
This woman needs to return that car immediately!
I hope anyone she has sued up and to this judgment are able to go after her, and recoup their loses, plus legal fees. I can't believe she was ever allowed to file these suits. Her legal team should be disbarred, especially if the court considers their facts and representations in previous cases to be false or misleading.
Wait so you can cosplay as the Main Characters from the film just not let you GT 500 cosplay as the 3 Main Character? Yeah that's just stupid... Thanks for sharing the good news and explaining the history of it I had no idea!
You could, but you might get sued from 2004 until last week. Thanks for watching!!!
I hope that woman is counter sued by everyone she went after and loses everything. What goes around comes around and she needs to eat it now.
ABSOLUTELY!!!! She (and her legal team) definitely need a serious taste of their own medicine after what they've done. For all the money, time, heartache, and stress they cost people, I wouldn't be too terribly upset if it 100% completely bankrupted all of them.
That's not how the justice system works.
once a supreme ruling ha been met or you've agreed to a settlement you cant come back with a counter claim upon the same arguments of the ruling
Thanks for taking the time to update this saga.
Thank you for watching!
The reason this lady is so unpopular is because she was CRUEL and this makes me so happy. I hope a handful of people she caused an unnecessary amount of damage and stress to go after her.
I hope they amend this hearing decision and she's forced to give everyone their projects back and $50k to help them finish what they started and another $100k for lost wages to people who used the builds for content.
Now sense the courts ruled that the reasons she sued for before were Fraudulent & Deceptive everyone she
"stole" from Previously should sue her for theft by deception
The doors are open now for counter claims, I hope everyone opens cases and she (and her legal team) are pursued into oblivion
In a perfect world there'd now be a short window when doing a burnout in an Eleanor replica outside Halicki's house would be entirely legal.

About 10 or so years back, I was working as a security guard that was posted at a car compound that had BMWs (approx 15,000 car sized compound). This compound was right in Immingham docks where the new cars came in from RoRo ships, then stored until wagons would collect them to take them to a BMW PDI centre near Doncaster... Anyway, one day during a shift, I noticed a mini bus coming to the main gate followed by... an 'Eleanor'. The young girl driving it (off the ship and into the compound), unfortunately parked it i a way that the wagons would have an issue getting into the compound... SO... Lucky me! Hahaha, had to move it. Man! Starting that hefty V8 (yup it was as we call it a 'Left Hooker' (LHD). Throaty! and, i noticed, had a 'Nitrous' button hidden under a 'Flip cap' on the manual gear shifter! NICE!, anyway, short drive as it was, I moved it and parked it up... Even for those coupla minutes... WHAT A CAR! I LOVE the Mustangs and the GTs! 👍👌 Ramble over. Hahaha 🤣 😎🇬🇧

Justice is served. I hope there is restitution for B Is For Build and this ruling sets court precedence in Copyright Law.
I actually completely forgot about this whole situation until this video. The way I see it just from other court cases that are very similar people like me is for build could very likely sue her to the extent of claiming financial and emotional damage considering that he had a CZcams series that was based on it which would have been an income for him and because of her now he lost it income. So damages are definitely possible to recover.
There are plenty of people she raked over the coals since 2004. I'm sure they are lining up in the court system to go after her now.
@@TonysFordsandMustangs I looked into it and yeah she took a lot from everyone. The best case scenario for her at this point is she's going to get sued there's no doubt about that to the point where she is going to file bankruptcy and that's about her only means of surviving this financially. Otherwise there will be dozens if not a few dozen people taking everything from her. As someone in the comments said not too long ago she's trying to make a profit off of her husbands 15 minutes of fame. In my eyes he comes off as the kind of wife where her husband will accomplish getting Commander out of post and she believes that she holds that rank over everyone she meets.
Chris/B is for Build is in a perfect position to make this stick too, as they have masses of video evidence of what they did, costs they incurred, revenue they lost etc... I hope she gets everything that coming her way......
He can sue for alot more than that he can sue for potential loses as well. The fact the build was abruptly stopped adds into him losing momentum in popularity & grow on his channel. He can sue for potentially lost earnings as well and really empty her fucking pockets.
Always great to see common sense prevail and put an end to these scam lawsuits.
I hope she gets sued by her victims! This is insane no called out she had no right to claim copyright infringement
This is a really good example of how insane copyright laws can be and I am really glad that it was finally overturned
The copyright laws aren't the problem. It was a false claim of rights that never should have been allowed...

Her and her lawyers should have been charged with theft.
*YES!* I hope this jackhole gets counter-sued by every single person she went after and has to pay damages to all of them for her nonsense.
The fact that she was able to legally steal B is for Build's car just because they called it a specific name was both ridiculous and infuriating.

I hope B for build goes after their car
I also thought it was odd when I first heard of the Eleanor law suits especially seeing that the two separate films used 2 different model cars (first film used a Mach 1 while the second film its a GT)
Thank you Shelby USA! I commented on B is for Builds channel last year that Shelby and Ford Motor Corporation needed to put this person in her place! They had no rite extorting money for design her estate had ABSOLUTELY NOTHING to do with, except exploiting Shelby and Ford!
"After reviewing both movies" - finally, a proper judge. Mrs. H. has been holding that business hostage for too long. SHE'S THE REASON I DROPPED MY DREAM OF OWNING AN ELEANOR ON DAY... Good for everyone.
I hope that woman suffers greatly for all the pain her greed has caused other people
She seems greedy and selfish with no love or appreciation for the car just the money and putting other people through these legal nightmares to take what belongs to them away is just pathetic
The late George Barris also sued successfully to unfairly get a batmobile replica that some one build turned over to him. Despite the fact that the original car was the Lincoln Futura designed and built by the GM styling studio.
That's interesting but he did all the work or someone at his shop did anyway.
All except the Lincoln Futura was designed by Bill Schmidt and John Najjar and built by Ghia.
Super vid mate. It's truly disgusting what happened to B is for Build. They were building something awesome. EviI, greedy woman! Now I wish the Shelby Trust would sue her and her lawyers for court costs!
Speaking for myself, I'm one of the few who preferred that Yellow/Black 1973 Mach One. That said, I've always preferred the larger 1970's body style over the much more iconic 1967 Mustang. If I had the money I'd buy a 1973 Mach One in a heartbeat. And then, of course, I'd ruin its resale value by painting it Highland Green (my favorite Mustang color). I'm sure the McQueen Estate would not be happy with me if I did that... LOL
I actually like the first film more as well but there aren't many of us out there who remember it. HB Halicki went around the country and sold the film to independent theaters. He used to tow the wrecked 73 Mach 1 around the country and sit it out in front of the theaters that bought the film for promotional purposes.
The first was the best. I'm positive H.B would never have let this crap happen, or the remake for that matter.
You're right. I know I've run into very few people who are familiar with yellow Eleanor. She may not be the best but she was the first.
Does anyone know if there was another body style car in Haliki's 2nd movie, (that was never finished, obviously), that was the next Eleanor of sorts. & yeah, I'd rather watch the original movie myself. I remember when it came out, & I was a Lil to young to go see it in theater, as I didn't live close to any cities that that movie theaters. He was clearly an enterprising movie & car guy. We need more of those.
@@Mountain_Valley_Sky He made other movies but died in a car accident filming the second gone in 60 seconds. He did everything himself including promotion and distribution. That's the reason so few people saw his movies in theaters.

Since when has it been illegal to build replicas of movie/TV vehicles? What about all those General Lee, KITT, Starsky and Hutch, the A-Team van, and many other replicas of well known TV vehicles? By the way, the REAL Gone in 60 Seconds from 1974 features one of the best, if not the best car chase scene in movie history. It pretty much takes up the entire movie, and uses absolutely NO CGI.

This is really interesting as I live in the UK and back in the early 2000s was an avid KitCar enthusiast. At one of the shows I saw a company offering an Eleanor body conversion for a Ford Mondeo/Sierra/Probe (I know but the UK wasn't lucky enough to have Mustangs just sitting around), anyway as I had a Ford Probe (my second mistake!) and some spare cash, I took their number and began following them in earnest. I was surprised to find that only 3 months later the whole company was rolled-up, website shut down, domain put up for sale, no explanation at all. The magazines at the time that had run articles on the "up and coming promising Company that had bags of Kitcar pedigree to ensure a long lived run" seemed to be just as puzzled too. I guess Ms Halicki's reach was long.
Sounds about right. Thanks for watching!
I hope everyone she extorted money from can sue to get it back now. If possible, I hope they also ask the court to press charges for perjury if their lies were sufficiently over the top.
The legal counsel of Mrs.Halicki needs to be disbarred as this is the textbook definition of such violation.
I can't believe she was able to do this in the first place! Hope b is for build can get their car back!
That's good news for people who actually care about cars and not just $$$. I think that the 67 Mustang is the quintessential car. I also think that some of the mods to "Elenore" didn't make it look better. Namely the flairs and side pipes. The 67 fastback is a dream car for me but I wouldn't want an "Elenore" clone. I want to build it the way I see fit.
As it should be. Thanks for watching!
Carol Shelby might be chilling behind the pearly gates but his foundation still doing gods work 👍😂😂
went to a small shop one time to look at a c6 corvette with my dad on the outskirts on new york near connecticut and they have an actual eleanor on the their show room rope off. starting price was 250k
A channel all about Fords and Mustangs! I’m all in! Just found you and subbed! ❤
Awesome! Thank you!
I'm 15 and considered an old soul, I did not know that there was a second one until a yr ago
That would meant that every case before hand was wrong, but I doubt anyone would get their cars and court fees back. Copyrights is always a guessing game=
This is true. The story may or may not be over.
Now sue her to pay back all the stolen cars from the owners and interest!
Not should she be sued to return any gains she made from her lawsuits, but her attorneys should be sanctioned for lying in court.
even if she owned the rights to the name and the likeness she didn't have any financial stake the the B for build car, how the hell did they get to take the car? Surely they could only stop them from using the name and likeness?
Signed that petition and added some funds. Absolutely screw that lady and her BS.
