  • The Electoral Commission (IEC) says it's proceeding with its application for leave to appeal the ruling of the Electoral Court in favour of the uMkhonto we Sizwe party despite the court not furnishing the commission with its reasons. The commission has filed the urgent application in the Constitutional Court after the Electoral Court overturned the commission's decision to disqualify the party's leader Jacob Zuma from standing as a candidate in the upcoming elections. The commission had based its decision to disqualify Zuma on his 15-month sentence after his contempt of court conviction in 2021. IEC wants the decision of the court set aside. It simply means,back to square one. It wants to disqualify Zuma again.

    Ayanda it is wrong for the IEC to go to the ConCourt without the judgement.
    The IEC should be waiting for the Electoral Court to issue the judgement or rather be asking for the Electoral Court to issue the judgment with reasons.

    It's sad of these Zuma's loyalists' naked desperation, including their so called spokesperson. For a moment let's juxtapose this electoral court order blunt as it is in favour of the IEC. It cud hv been an outcry tht these judges are captured hence they give order without reasons it is based on, citing it as a clear sign to exclude Zuma by hook or crook. Now that it's in their favour, all's well. The poor guy doesn't even want to understand that it's in the interest of free & fair elections tht clarity be sought from the constitutional court to close this vacuum tht is left by the electoral court which was supposed to be a concern even for the MK if reasons 4 the order on such an urgent & crucial matter. Absolutely no politics here. It's like someone given directions to reach a particular destination & in the middle of the journey comes across a crossroad at which juncture gets persuaded to take a route different from the one ordered to follow at the point of departure. So, simple logic will be to call people at destination point for the right route to follow. That's exactly wht the IEC is doing in order tht even in future it never get lost for the journey tht it undertakes regularly as mandated by the very constitution.

    It is very surprising that the IEC is taking this matter for appeal as they are not even the complainants in this matter...moreover the reasons are not yet delivered by the Court...what is it that the concort is going to look at when dealing with matter if there is no written judgment in front of them if in any even it surprisingly allow the leave to appeal...the IEC in the first place does not have legal authority to apply section 47(1)(e)...I'm worried that the IEC is risking to lose its credibility...and that could be very dangerous for country...

    This is a matter that really requires a chief justice of the country to be on the bench. CJ Zondo cannot recuse himself in benefit of a criminal. He is our top Judge and best legal mind in the country. The fact that Zuma decided to symbolically spit on his face doesn't grant Zuma a right to be now protected from facing him. He made his bed, now he must lay.

    Why go to constit court for electoral court judgement/reasons when you can approach the same court to deliver the reasons of the court order urgently. The electoral court never refused to present reasons except that thry could not do so when they were pressed for time to deliver judgement.

    Zuma is a criminal and destroyed our country he must go to jail not parliament. He challenges all the courts, why can’t other people challenge the courts that favour him. This is not a Zuma country, it’s our country and IEC is right to challenge or Appeal this order on behalf of citizens not tiny MK party.     An appeal is brought on error in law or fact of the decision makers as articulated in their reasons for the judgement. In the absence of reasons the appeal is pre mature as your notice has no basis upon which the appeal is brought. This is unfortunate by IEC. Is their appeal now not going to affect their calendar.
