How Does VA Disability Evidence Work?
President Lincoln established the future of the Veterans Administration disability program when he envisioned a way “to care for him who shall have borne the battle.” For many years, the VA fulfilled Lincoln’s vision. Now, however, the VA is one of the most under-funded federal agencies, and it is difficult for veterans to receive the compensation they deserve.
In this environment, a VA disability attorney is more important than ever. An attorney knows what evidence you need to prove your disability, knows how to present this evidence effectively, and can advocate for you on appeal, if necessary.
When applying for VA benefits, evidence is everything. Medical records are the best starting point because a current diagnosis of a disabling condition is required for compensation. This evidence is not always easy to procure. VA physicians are overworked, so examination reports are often incomplete, lack proper analysis, or contain mistakes, which severely frustrates compensation claims.
Independent medical evidence from an outside practitioner can help. Either your attorney or the VA office handling your claim can request such evidence if a medical question has been left unanswered.
There are other ways to show disability, or severity of disability, besides a medical diagnosis. Disability can have educational, vocational, and other implications, so non-medical evidence is helpful. This includes not only the veteran’s own statements about how the disability affects his or her daily life, but also statements from friends, family members, and co-workers. Evidence from vocational experts showing a veteran has trouble working due to disability are also helpful in showing the level of disability.
The claimed disability must be related to service, which can be proven by obtaining records from the veteran’s active duty or training periods.
Claims examiners can often overlook evidence on initial review. Having an attorney look at your file can help you figure out what went wrong. If you appeal, an attorney can help you figure out what evidence you need for the best chance at success. Thanks for taking the time to comment. I can't say because I don't have that experience. I can repeat what the video and description state, 'There is no fee until you win.' I guess it just depends on who you go with, huh?

If you're white we have it, if you're black we can't find it!
