    Attorney Menchaca, the TN visa, what requirements would I need to meet in order to apply?
    The TN visa is a work visa to work in the United States legally.
    It allows people from Mexico and Canada to come to the United States, so you have to be a citizen of Mexico or Canada to qualify for the TN visa.
    Unfortunately if you don't have either one of those citizenships then you don't qualify.
    Ok, I see, so what else does the TN visa require?
    The TN visa requires that you have a job offer in the United States, that somebody in the United States be wanting to hire you.
    You can't work unless somebody offers you a job.
    Of course.
    Next you need to have a job offer that is of a professional level.
    So what exactly does a job offer at a professional level mean?
    It means that it needs to be a job that is normally performed by persons with a college degree, with the university 4-year degree or its equivalent.
    So for example, if I get a job offer as an engineer would I be able to qualify?
    Sure because engineering is a field that is normally performed by people with college education.
    I see, what would happen if I get a job offer as a medical assistant?
    Then unfortunately that one would not qualify, medical assistants normally requires something less than a four-year education at a university level, usually it's like two years and you get like something called an associate's degree or sometimes even less than two years so that one would not qualify for the TN visa because it would be considered a non professional level job.
    So what would be the fourth requirement?
    The fourth requirement is that you be a professional, and it makes sense, if you're being offered a job as an engineer, which requires a college education and you need to have a college education in engineering okay so you need to be a professional as well, which means that you need to have a completed college education.
    You could have studied in any country, in Mexico, Canada or abroad anywhere else as long as you have completed a four-year college education equivalent to that of a United States college education.
    I see, so what else would a TN visa require?
    It requires that the profession in which you are getting a job in the United States be listed, be included in the TN job list.
    So there's this list, which you can find on our law firms website, that includes all the professions that are eligible for the TN visa.
    So one of the things we need to do is figure out what profession you have, look at the list and see if your profession is included on that list.
    So for example I have a communications degree would I be able to apply for this visa?
    Unfortunately communications is not on the TN job list, so the initial answer would be no, however there is a way to still qualify you for the TN visa and that's through a position, which is on the list called the management consultant.
    So management consultant is somebody that comes to a company to teach and explain and improve systems and processes related to their field of education or expertise, so in your case, you have an education in communications, you're an expert in communications, you could be hired in the United States to provide consulting services on communication issues and that could qualify you for the TN visa.
    So there is an exception there are ways to qualify you for the TN visa even if your profession is not on the list, as long as the job that you're being offered is to provide consulting services.

    Hello, thank you for the video. I have a question, I’m logistics engineer with purchasing experience in Mexico and I got an job offer in purchasing, I would like to know if I’m available to apply to TN visa?

      Hi. Hard to say with the information you provided, but me try: (1) the job offered needs to be related to your field of study, (2) if the purchasing of the kind that requires an engineering knowledge, then yes, you should get the visa, (3) but if the purchasing you are going to do is general purchasing, the kind a non-engineer can do just as well as you, then you will not get the visa.     I have a bachelor's degree in Marketing, and marketing covers many professional job opportunities. I see Marketing is not included in the list.

      Lazcano, hi. You are correct. Unfortunately there is no TN Visa for people with marketing degrees who have job offers to work in marketing in the USA. Sorry for the bad news.

    I'm offered a position to UX Design at a company in SF. I have a masters degree in Business Mgmt MBA. However, I switched my career from business to UX Design 7yrs ago when UX was still very cutting edge and had no definitive standards. Until today, the vast majority of UX Designers are coming from business, engineering..etc or mainly anything that's not design or arts related.. I have a letter of experience from every employer I worked with before. Would that still qualify?

    Does the job offer or letter have to indicate “3 years”? I am being offered a full time long term job. I’m not sure if they will include the time frame of work to be within 3 years for the purpose of the letter.

      Hi. It wont help to do it for 3 years because right now the TN visa is only good for 1 year.

    If i have a bachelors degree in finance but i currently work in IT, would i qualify? And if not, is getting a diploma/masters in IT make up for it or it must be a bachelor's?

    Hi I got a job offer as an office assistant at a law firm and the job requires a bachelors degree for the position. I m not sure if I will be qualified for TN visa or no? Do I need to bring my original certificates to show at the port of entry? I’m a Canadian.

      Hi. Well bad news. Office Assistant is not a job eligible for the TN visa, regardless of the degree you have. Sorry for the bad news.

    Mexican citizen here! I will be working with a company under post-competition OPT as a business operations specialist until my permit is over. I have a BS from an American university in TV Production and Business. Would I be able to qualify for the TN visa as a business operations specialist?

      Hi. You will qualify for a TN if your profession is on the TN visa list of Professions. Unfortunately, your degree is not on the list.

    I have a bachelors degree in psychology and I work in the social services field. If I apply for a job as a social worker would I qualify under the job description “social work” since that’s the job I currently do but with a degree in psychology? Or would I require a specific degree in social worker ? Thank you!

      Hi. You are in a gray area, so you can try and may be approved since you can make a good argument. However, my reading of the law is that you need a degree in social work.

      Cesar, if you are on DACA you do not need the TN work visa because DACA gives you a work permit, which is basically the same thing that you get from a TN visa.

      @@InmigracionAbogado the difference with DACA is that I can't travel to my country... And can I travel to my country with tn visa and I don't think TN visa aplies to licence vocational nurses like my I think I need to be a Registered Nurse

      Yes, there is the traveling issue which is a big one. And yes, you need to be a Registered Nurse.

      There is also an H1B for nurses. But unfortunately, people on DACA can not get an H1B. In simple terms, to get DACA you have to have been out of status. To get the H1B you have to have been in status.
