  • A Tennessee mom was arrested for DUI after failing a field sobriety test. The police report claimed Katie Slayton showed uncoordinated behavior and slurred speech. But Slayton says she was simply exhausted after working a 12-hour shift at her hospital in a COVID-19 ward. Turns out, she also took her regular prescription dose of adderall. Six months later, her blood test result came back negative for alcohol. The charges against Slayton were dropped.

    Why does it take 6 months for a simple blood test. That's unacceptable. She could have lost everything including her job and child. Once a kid is taken away and put in the system it's a nightmare to get them back even when you're proven to be innocent. The CPS simply say "But there must have been something"

      This happened to us also. In our case, the lab was backlogged. So many cases were behind. We waited 6 months until the test came back. Once it did, CPS dropped their case after wrecking havoc on our family.

      CPS is very corrupt. My one boy had to fight for custody of his daughter from some pedo that lived in the woods because his baby mother died from a drug overdose.

    She was supposed to be flying to Texas for my wedding the next day, instead this nightmare began. For the record, she offered to take a breathalyzer but was told no, she could be on drugs. She was without her son for 9 weeks. She is the sweetest, most generous person I know. I’m just happy she’s moving back to Texas. Tenn. lost a damn fine nurse.

      Anyway, I hope her son got lucky while he was in the foster system. That's a horrible place to be for any length of time. I'm glad she has him back and it's good to hear that she's leaving.

      I worry deeply about her and others who come into this type of situation. The extreme and immense trauma of this cannot be understated for her and her child. To take away a child you have better 99.999 percent sure of the situation first. What about a breathalyzer? They didn't do that? Wtf is wrong with these people?

      At least there were actually signs of impairment, unlike the officer in Fort Collins who made 10 DUI/DWI arrests in the last year where all the tests came back negative.
      Also, when you reach certain levels of fatigue, your coordination and reaction time will be the same as if you were drunk.

    If the cops made the correct call, then the field sobriety test has to be re-examined. This is a failing of the justice system. You can’t just ignore this.
    I’ve seen so many videos of inconsistency. Sober people doing badly, and people with high alcohol content in their system doing well.

      I don’t see where they said she was wrong. And the cops weren’t right, they just weren’t wrong because they acted under probable cause. A better solution would have been for these cops to follow her home and see if she drives erratically as if intoxicated, then they’d be better informed. The kid could’ve rode in the cop car. These cops didn’t care enough to do something like that.

    Never do their “tests”. Not required by law and can never help you-only incriminate you. You do have to take the breathalyzer though or risk losing your license.

      In many states, refusing any field sobriety tests = license suspension. At that point you'll be arrested for DUI and have to hire an attorney to prove you weren't inebriated.

    9 weeks of that child being taken away!? I could only imagine how the child was treated. What other "reasons" could determine her for failing a sobering test? Nothing because the lady was simply working and taking her prescribed medication like anyone else. The lady in the video did not look like she was drinking. I hope the mother does something like possibly sue those cops for unnecessary distress and damage without a legitimate reason to arrest her.

      The child was likely treated pretty well, as the general foster care is honestly a decent system. I’ve known plenty of foster families and children in my life, even those who have been taken from their families due to drug addiction, and things go very well for them.
      Suing the police wouldn’t go well as they had a cause for arrest, and after reviewing the video, it was said that the police “made the right call”. They were just doing their jobs and made a mistake. A bad one which definitely caused stress and pain, but a mistake that was understandable. This is why we have the blood tests to begin with. I’m glad she was proven innocent and given her son back.

      If officers arrested her for appearing “drunk” I’d be scared to know what’s she’s like at work. Dealing with patients and medications? I mean I’m a nurse so I know how 12 hr shifts can be. But to appear drunk? Even the chief agreed the cops made the right call. That just concerns

    As a nurse myself, after working a 12-13 hour shift, there’s times when I feel like I have to crawl in my front door and collapse on the couch…add nervousness, ADHD, a little natural clumsiness and there’s absolutely no way I’d have been able to stand on one foot until someone told me to stop.🤦🏻‍♀️ Another life ruined because someone “thinks” or “feels” a certain way…Despicable

    You should never leave your “sobriety test “ in the hands of a medically UNtrained person. Take a breathalyzer or a blood test as that is scientific, not staring at a pen or balancing which lots of people can’t, due to a past injury or inner ear issues!       I have several medical conditions that could impact my performance on a sobriety test, let alone a physical disability, I'm not ABLE to stand on one leg on a good day for more than a second or two. I had a stroke before I even started driving. I just got my learners permit earlier this year at 21. I will ALWAYS refuse to comply with a field sobriety test. I will demand a breathalyzer. Id rather not have my innocence even come into question with a failed "test". Drunk people can pass the test and so many sober people can and do fail. It's not something we should be using anymore, especially with field breathalyzers existing. It's harder to be arrested with cause (failing a field test such in this case) than to be taken into custody temporarily for a breathalyzer test. I also need to get a note from a doctor explaining my medical conditions and carry it around with me.

      No. The sentence is “you should never AGREE to a field sobriety test. EVER.”
      There is no legal obligation to in any circumstance. It will ALWAYS be used against you, and there is no pass or fail system.

He failed the field sobriety test and they were open beers in the car, but charges were dropped because the police force did not send the chest and dash cams as requested.

    Imagine ruining someone's life and taking their kid away from them, over something as simple and stupid as a broken sobriety test.       No if you refuse they have to arrest you to get a blood sample. Theytake you to some dui facility take your blood give you more testand release you. Not as bad of a process compared to being taking to a county jail

      You should watch the video where the guy blew a 0 in a breathalyzer and they still held him for DUI and only when the blood test came back he was then let off.

      But if you ask for a breathalyzer, they can't refuse you as its the most accurate test for alcohol besides blood(which gives too much info)
      I've done it after a cop tried 2 field tests i passed and went for a 3rd
      He quickly changed his attitude when I said "no, give me the breathalyzer"

    So the daycare was so concerned about the kid that they called the police who arrested his exhausted single mom and the boy spent nine weeks in foster care. They didn’t protect him and instead traumatized him. Horrible employees.

      @@Tuturu708 not in North Carolina. The sobriety test is optional. Breathalyzer on the scene is also optional. They will take you to the police station to do a breathalyzer and that one is mandatory. You may ask for a witness to be present (they will have 30 minutes to get to the station)

      I remember working a 12 hour shift once in heavy steel toed shoes and after driving home I could barely walk across the parking lot to my apartment. I'm in decent shape for my age but I pushed myself way beyond my limits at a very physical job. If a cop saw me he'd have assumed I was hammered and there would be no way I could do that test. I was shuffling my feet to get in the door so I could pass out on the bed but I'd have gladly taken the kitchen floor just after the entry door.

      Maybe somebody wanted her child and set her up. These police officers behavior was illegal. So was the State kidnappers. It's hard not to wonder if somebody wanted her child and used the system to kidnap the child. This was a kidnapping, plain and simple. The police had a thousand other ways they could have handled this situation. The fact that they arrested her for a DUI when she wasn't even drunk says volumes to me.

    This is absolutely insane and so scary. I had a terrible car accident where the car flipped and I was totally sober. It was break failure. And when the cop was asking questions I was nervous af cause I literally almost died. I even apologized to him for being erratic but my body literally went into shock. He was standoffish but he didn’t think I needed a sobriety test or anything like that. Which I would have understood if he did want to check for that. And done my best. This is why I am so distrustful of cops though is cause of stuff like this.

    100% believe that a 12 hour shift could cause you to behave erratically and fail a field sobriety test. As a student nurse myself I can tell you the job is not glamorous and you often see many nurses drinking energy drinks and coffee just to survive the long shifts.

    As a medical professional she risks losing her license/job as well as a driver's license and child and her car and being in prison.       I keep a very small footprint in my life cos I know I could be done for anything by the cops, I don't have any qualities of an 'innocent' person. I escaped a home invasion charge because I was at a night church service and my alibi was solid. And even my neighbours were convinced I was a suspect.

    There's no reason why a blood test for alcohol should take 6 months to come back from a lab. Personally, I think she should have grounds for a lawsuit. She was stigmatized, kept from her child for 9 weeks, and her life was in ruins. Not to mention the trauma this caused for her son. I would definitely be seeking to file a lawsuit.

      the drug test kits the police use to test for the presence of drugs doesnt work and OFTEN shows a positive for illegal drugs where none was ever present . many local and state news stories have been done that show on camera FALSE positive tests results of these test kits being used by the police AND the police know this but continue to USE these drug test kits to this day !!

    Reminds me of Utah State Trooper Lisa Steed. She would pull people over for no legitimate reason (she'd claimed that they were "swaying" or "driving erratically") and arrest them for DUI despite them being completely sober. She even made Trooper Of The Year until it was found out that most if not all of her 750 DUI "arrests" were of innocent people and she was fired. She basically did this because she felt like it.

      Yes, it would have. Those officers obviously didn't care about anything but making the arrest. Can't imagine how her child felt being away from his mother for over two months, even if he was treated well in foster care. Those police caused a family undue stress.

      Uh not to burst y’all’s bubbles but breathalyzers don’t work on anything but alcohol. She didn’t have alcohol on her breath so the test they did was the only way they could have a cause yo arrest. I say good job on the system for doing what they were supposed to do in a situation like this.

    Any hospital lab can have a full panel done in three days, any third party lab shouldn't take more than a week for results. It's absolutely unacceptable it took that long.

      Im guessing someone wanted that child. A little bribe money thrown around can get you a child via dirty cops and dirty State workers. Everybody broke the Law in this case. Everybody knew she wasn't drunk. They just wanted the child . Once a child is in State custody , it's very hard to get the child back. State workers will just lie and falsify paperwork until they illegally get final custody. Tbh, given how corrupt the system is, she's lucky she got that child back.

      I believe most officers do have the breathalizer tests on them. If she had done one, that would have proven she wasn't drunk and there would have been no probable cause.

      Unfortunately, they had probable cause per the law & followed it. They didn’t do anything wrong, despite the bad things that came from it. However, there should have been no reason it took so long to get the labs back, & no reason it took so long for her to get her son back! A BAL & a UDS come back in just a couple hours! She could have explained that she was a nurse coming off of a long, exhausting 12 hr. shift, & literally slept in a holding cell while they waited for the results, then they could have let them both go home when the tests came back negative.

      Not anymore, it's deleted once it's dropped or found not guilty. Not like it used to be. I have a few charges that were dropped or not guilty and I have a clean record now. In 2006 it was a different story even though I never had a conviction I had several charges on my record. At least in FL, MN and MA it's that way now.

    This is so heartbreaking!! I honestly don't understand why she wasn't given a breathalyzer or a blood test? Why do we still rely on police officers "observations"? That's not right. We have all this technology, and we can make tests on a massive scale for Covid, why is it so hard to give someone a quick blood or urine test to make SURE that the person is under the influence? Those field sobriety tests worked well when we had no other choice, but now we have lots of choices, but police departments don't have the funding so they could do things like that. My uncle was a cop with the LAPD, and was one of the very first drug recognition experts (DRE) and is the person that discovered that you could look at someone's eyes and figure out what they've taken, whether drugs or alcohol. And more recently he's invented a machine that you can hold up to someone's eyes and it tells you what drugs (or alcohol) they're on. They're expensive, but if every department had one machine, maybe horror stories like this one would happen less? Because waiting six weeks for a blood test is absolutely RIDICULOUS!!!

      Yea once I heard "nurse" I immediately thought "she must've been tired and really exhausted" haven worked 70-80+hour weeks myself with many nurses. Sad that it took so long to prove her innocence.

      I have even been so sleep deprived that my speech was slow and somewhat slurred. I've also heard of people hallucinating from sleep deprivation ( thank God I never experienced it)
