      Many airline employees do not have the 9 to 5 job most of us do. They spend a considerable amount of time sleeping in hotels and motels near airports worldwide. It is up to the airlines to fly them to their next assignment on their work schedules. There wouldn't be any flights if there aren't any airline employees. Does MSNBC support unions? OBVIOUSLY NOT. While Louisville isn't far from Chicago, those employees could be having their next assignment from Los Angeles. Many are commenting on the airline business and operations with no clue...

      Their pilots and crews are victims of delays and cancellations too. Don't feel like the lone ranger. All it takes is one weather delay and the flight schedules cartwheels... Its like a dog chasing its own tail. No pilot, no crew, guess what, no flight... Do you screw 4 passengers or do you screw a whole plane of 200 passengers? Cancel that flight, guess what, another following flight or two are also cancelled. From 4 to 200 to 400 to 600 passengers... Passengers see the flights as one hop flights, but in reality several flights string together... Deadheading of airline crews has been around for decades and will continue to be around as long as there are airlines... Airline crews are NOT interested in paying for their flights to get to their assignments... And as far as planning is concerned, these schedules are more or less almost the same every day and every week, a tweak here and a tweak there. United probably deadheads crew to Louisville every day on another flight...

    This is a form of stealing. Imagine if you booked a reception hall for a wedding. The management took your money. Then on the day of the wedding they tell you that they need the hall for their own company party. They offer you $800 to have your wedding the next day but your guests are standing at the door and have to leave the next day. Listen up United Airlines. ...you are selling a time sensitive product. You are stealing from your patrons if you think for one second this is re-accommodation. I am ashamed your brand is called United Airlines. You will pay bigly. An apology is owed to that man and I don't care if he is the Son of Sam. Also, every passenger on that plane should be issued a free round trip destination anywhere for having to watch your criminal behavior.

      TheAndreacoble I do see your point with saying that overbooking flights is a HUGE issue! Unfortunetly every airline does this because there are a certain number of people not showing up as well as people want to have cheaper seats. I think this was even more of an issue because the gentle man got on the plane and into his seat which means that the contract which allows United to bump the customer is No longer valid. Definetly poor planning! They should have waited to board the customers until they had bumped the people (through volunteers, or involuntary) that they needed to in order to get the staff they needed on the plane

      Just to add to that if you are Bumped the airline is required to have you put on the next avalible flight PLUS give you the compensation. I also agree with your point that everyone on the flight should get some credit for having witnessed such a thing. Unfortunetly that wont happen because as people are looking for cheaper flight airlines are becoming more horrible at doing their job.

      Secondly why is overbooking legal?
      If a person pays for a seat, & fails to arrive for the flight, the airlines is still paid.
      The Airlines still makes the money once a ticket has been sold,
      then how does over booking make financial sense as you have to compensate customers with higher than the ticket price?

      be sure this is all figured out. The thing is that there is a known likelihood that people do not show up for their flight. So on a typical overbooked flight, instead of a problem they simply have a full flight, on a small minority of overbooked flights they pay volunteers to reroute, and on a really really tiny percentage of overbooked flights they actually have to bump people. There are computers crunching the probabilities all the time, and be sure that they are much smarter than you or me

      It could have been handled so many different ways. What is more interesting to me is that no one on the flight stood up for the guy getting beaten and dragged off the plane. Disgust sure in the faces in the crowd.....but did anyone tell the police goon squad to back off..........or hey, how about I get off the plane instead you beating the kwrap out the guy.............nope, didn't see that in the captured videos.......

      What makes anyone think that passengers would be willing to miss an important appointment or scheduled work shift - or an important family commitment such as a wedding or a funeral for any sum of money ? Isn't it possible that all of these passengers had to be at their destination on this flight because of work , an important appointment or a family commitment ? They should have made other arrangements for airline employees since they were at fault for poor planning .

    To the commenters who argue that "the officers are doing their job, and what do you think will happen if you don't comply?" I don't believe that officers have the rights to resort to violence when you are non-threatening. The man did not disrespect the security guards, nor did he place his hands on the security guards. The security guards were asked to escort him out, not to slam his head against the hand rest. The man also did not break any laws or rules, he has the RIGHT to stay on that flight. The man already checked in and got seated on the plane, and UA had no right to bump him out of his seat for their employee who made no prior reservation. People also shouldn't bring the victim's race into the argument. It shouldn't matter if the victim is asian, white or black, this human being was treated horribly, and honestly, he stood up for himself. People who comply even when they have the rights are only letting the UA continuing this horrible practice.

      Lili F. You are mistaken. When someone is given a lawful order to vacate an area they either comply of their own free will or they will be forcibly removed.
      Hence the warning the cop gives the guy. Several in fact. The guy refused to comply and said he'd rather go to jail.
      So where is the surprise? Do you know the legal obligation you have in complying with lawful orders? Do you know the extent you can argue? The local, state and federal laws that may come into play?
      If you think I'm wrong go onto property you don't own and refuse them peacefully. See what happens.

      They didn't resort to violence. The used force because he made them use force. He was in effect, trespassing when he refused to leave. In the process of using said force, said passenger hit his head on an armrest. That's often the case when a criminal is resisting the authorities. All he had to do was cooperate like the other three did and it wouldn't have come to that.

      You can be guilty of criminal trespassing after you've bought a ticket, AJH. Once a person has been declared persona non grata and told to leave your property, non-compliance would mean that they are trespassing. That's why Dr. Dao was told by the agents that he could go to jail if he doesn't cooperate. "Trespassing" has various legal definitions apart from simply entering private property without permission. For example, if you hire a contractor to work in your home but their poor quality of work makes you change your mind about using them so you tell them to leave. They might say "I'm not leaving without getting paid" to which you respond "I'm not paying you for this. It's going to cost me that much to fix what you screwed up. Get out of here!" If they refuse you call the police. Why? Because it's your property and they are 'persona non grata', meaning you don't want them there, even though initially they had your permission to be there. Once an airline employee tells you to leave and you refuse, whether it's because you're disruptive, drunk, or simply because of unforeseen circumstances, you have to comply. You can pursue civil action afterward if you choose, but you have to leave or you could be arrested.

    Please stop using the word "OVERBOOKED" to analyze United Airlines
    flight 3411. It confuses the issue of wrongful corporate mistreatment of
    undeserving paying customers by using unreasonable force and by
    incorrectly applying standard operating procedures.
    Once a paying customer with a confirmed seat has been allowed on the
    plane, federal rules and regulations regarding OVERBOOKING no longer
    apply. Seat confirmation now become passage protection. From this point
    onward, the only way the airline can remove any paying passenger is for
    posing a public security threat of some kind that would endanger the
    passengers and crew on board.
    Flight 3411 was fully booked, fully boarded, and ready to go, when 4
    United Airlines employees required to be added at the last minute, thus
    creating the overcrowding.
    PRIORITIZING unbooked non-paying employees over invaluable paying
    customers is 100% the fault of United Airlines.

      If you are asked to get off an airplane by the crew, you have to get off. The Doctor's mistake was mutiny. He is not entitled to anything for disregarding instructions from the crew.     United has a very flimsy legal basis for their actions (same goes for the PD). From what I can gather, this was not an overbooking or an oversales situation, therefore, the involuntary removal clause (getting bumped) does not apply. The United employees who needed to travel did not have confirmed seats. However, the hapless passenger who was forcibly and unceremoniously removed did in fact have a confirmed seat AND was already in his seat. He posed no risk by virtue of being inside the plane. The ensuing scuffle was caused by the PD who were acting on orders and testimony of airline staff. United breached the contract and will be liable for punitive and civil rights infringement damages.

    When you are already on a plane you cannot trespass. When you have done nothing wrong NOBODY has the right to ASSAULT you.
    United messed up, not the passengers. So United had to solve the problem, without attacking and injuring innocent people!
    Munoz put policies into place to save money in every way possible. He ordered the lid on compensation. What happened is a DIRECT consequence of Munoz' corporation policies.
    Both he and the airport security guys must be prosecuted! No out of court deals please.
    All we can and should do is to
    BOYCOTT UNITED!

      Nonsense. When I worked in the hotel business I was instructed that any guest who was excessively loud, drunk, belligerent ... etc. could be told to leave, even after paying for the room, because they had violated the terms of the stay. If they refused to leave they would be trespassing, and at that point I should call the police. This man signed a contract that stated that he could be bumped due to unforeseen circumstances, and when he refused to leave he was in violation of that contract. In effect, he was trespassing. That's when the United employees called airport security which they were legally within their rights to do. From a PR standpoint and policy standpoint they clearly screwed up, but Dr. Dao was committing a crime by not leaving that plane when ordered to. And he wasn't assaulted. He was forcibly removed because he wouldn't go on his own, and in the process he hit his stupid head on an armrest.

      just because u bought a ticket doesnt mean you have the "right" to stay in the seat. its a privately own plane. you pay for the service, if they dont provide the service, then your "right" is money back with compensation. the problem is people dont read the fine print.. and just willingly click "i agree". United and EVERY airline has the right to bump. just like any other establishment. Havent you ever seen signs at places "we reserve the right to refuse service"? in this situation, they had no choice. because there is a Federal Mandate that requires accomodation for crew members needing to get to another flight because it causes MORE problems. one cancelled flight has a domino effect with connecting flights including other airlines flights.
      How the cops handled the situation is a different story. but the passenger should have complied. United had no choice to bump people. they should have offered more money until someone volunteers.

    First the leggings, now this United CEO? Really? Customers first; employees second (after they're retrained). If they hadn't been so cheap...why not offer $1500 regardless of limit? It would've saved them millions, because the doctor should sue them for $15M. Emotion distress, assault, the works.
    Way to go United! After you "re-accommodate" your airline, its lousy business conduct (pick any day of the week), retrain your employees, fire a few, then hang up the fire sale, out of business shingle, because it is so over for United. I worked in pr for years; no agency in the universe can fix this mess; CEO certainly has no sense of sympathy, morals, manners, etiquette. How did he get that job?
    On the plus side, great commercial for Marlboro cigarettes; the cop dragging the man had a pack in his right pocket.

    This is also what happens when you have customer service agents who don't use good judgement. I am a former gate agent for a major airline (12 years) and worked overbooked flights almost daily. United Airlines/Continental hires people who do not use their customer service skills; when you combine bad customer service and bad judgement, this is what you get.

    The Airline Industry in this country is a joke. Their customers are treated like so much chattel. And this type of mentality isn't limited to United or the Airline Industry for that matter.

    that man should sue The Manufacturer of the Chair that Busted his lips, United Airlines, the Security Company, the Airport, the Federal/State Agencies regulating the airlines, the United States, The State in which this occured, and each of those individual security Guards and the parents who conceived them!

    I think 50 - 100 million damages at least will ensure passengers are respected.
