And unfortunately the Port Authority Trans-Hudson in NJ/NY actually has a photoban that can result in confiscation and arrest. Same idea as Simon. It’s beyond ridiculous and I have been harassed before. Almost cost me my camera. This awareness is important now than ever! It is very easy to fall for this trap in the United States. Knowing your rights on both private and public properties is must for filming. In this sense, it's your right to film. While he should have known about filming rights, he seemed to do the right thing by correcting what he did after talking to his colleague and then apologizing to you. In the end, he seemed to do the right thing. It's unfortunate how people get detained and have police called on them for literally doing nothing wrong. You could also say that railfanning is a God given right as long as you do it on taxpayer funded public property such as on the train or at the station.
Andrew, I have to thank you for always stressing our rights in our filming world for both public and private properties. Especially seeing how many people these days attempt to exceed their authority in both situations. A couple of weeks ago, I was filming an elevator at a multi-tenant office building (There was nothing saying I couldn't be there, but of course I comply if told to stop and leave if requested). The maintenance guy of the building freaks out on me when wrapping up my video. He wanted me to stop and I complied as we need to do so in this situation for private property. During the encounter, I figured out he was trying to illegally detain me during the interaction since he kept talking to me, but refused to answer my question of "Do I need to leave?". Once I caught on, I firmly said "Sir, I am sorry if I caused a problem. I am leaving now and you will never see me again." Even though he scolded me, I saved myself from encountering unnecessary trouble which if it wasn't for your awareness videos and posts, I would have never thought that what was happening was illegal and probably would have allowed him to have total control over me while giving up my rights.
Ever since watching this video many years ago and watching your link to Doctor Phil's video last year, I became confident about filming on public taxpayer funded properties and don't hesitate when I used too. Again, something I would have never known if it wasn't for watching your videos. In conclusion, it's easy to fall for these traps so knowing your rights is critical and cannot be stressed enough!

That's the problem, transit employees, even here in Canada are misinformed about the rules on photography. That's why as transit photographers, it's our duty to let them know, politely, that what we do is a hobby and it is legal. I also add the fact that we are documenting transit history in the city we're in. I started using that fact when I went to do pictures of Kingston (Ontario) Transit buses back in October and the drivers were cool with that.
Here in the Greater Montreal Area, I only had one major confrontation with a Réseau de transport de Longueuil driver in Saint-Bruno-de-Montarville in '09. He called the police on me and had his passengers waiting in the bus for 30 minutes. So I was told by the police officers, after I told them what I was doing was legal, that if I wanted to take pictures of buses, I should ocntact thr RTL and ask them to go to the garages (Vieux-Longueuil and Saint-Hubert) and ask to take pictures of the buses there.
I found that ridiculous and I still to this day take bus pictures wherever I wish, without impeding the flow of traffic armed with some calling cards I made explaining my hobby and with my point-and-shoot digital still camera. :)

Another thing that I recommend you not to do is "what's-so-called" joy-filming. It means you run around filming around while people are around you and it's sometimes suspicious and you can end up getting busted. If I went on the Light Rail in Houston, I'll just film and not disturb anyone.

I also tape phone conversations with the public transit agency, because Texas is a One Party Consent state (until Wendy Davis becomes Governor, which I hope she will not) we are allowed to tape phone calls that we make without the other person's consent.

Imagine me inside the dart light rail recording until the operator comes out to say “Hey I’m sorry sir but you can’t take either photos or videos on the train.” I think my only answer to them is to say “Uhh what do you mean I can’t take videos and photos of the train? I mean I’m just doing a CZcams video and a short tour of the Dart Light Rail itself that’s all.” And then the operator will be like “Ohh ok well I deeply apologize for that sir. Go ahead and continue on what you’re doing, but don’t try to record any of the passengers inside the train, cause they will have to call our police department for that.” And then I’ll be like “Yeah no problem, I’ll try to be extra careful on where I’m recording.” And then the operator goes back to the cab politely and gives me a thumbs up 👍. That’s how I want to say to them if I’m accidentally recording stuff for no reason.

Except that, with the exception of the Pentagon Station - which may be at DOD's insistence - WMATA has no problems with people filming on transit vehicles and at transit stations. I've also found WMATA trains stations and (usually) buses to be clean.

I do get the driver's point, however I would have simply asked if you could stop. If you said you wanted to keep filming, I would have respected that since there's nothing wrong. It's all personal preference.
