My auntie only named one of her daughters as beneficiary of her life insurance policy and thank goodness she did. The money was intended to cover final expenses and if my other cousin had received half I know damn well she wouldn’t have contributed anything. This dude asked for a loan to hire an attorney to help out his stepson and instead spent it on himself.
Right? I'll bet he also "borrowed" money from his mother and didn't pay it back because "she was old/dying/had plenty, so she didn't need it".
That's probably when she took his name off as beneficiary. What a jerk he is.
When a deceased parent with multiple children only leaves one behind as their sole beneficiary, there's usually a good reason behind that. Exhibit A.

Honestly one thing I'm seeing of the brother is that he has a serious case of "Golden Child Syndrome" and this case just proves it. It's likely he even inherited some things aside from the life insurance that he likely could've sold to pay for the legal fees.

@@erickanew My auntie’s policy was $10,000 and just barely paid for the funeral. My cousin had to used her income tax return to later buy a headstone. If half had gone to her sister, my cousin would have been up a creek and likely had to ask other relatives for money. That’s my dad’s side. I had a maternal relative pass two years ago and for her basic flat headstone was going to be $3,000. I was able to get it down to $2,100 partly because I didn’t order the vase part. A vase is an additional $700 upcharge. The cemeteries my mother’s side are buried in are private and perpetual care. A few years ago they changed their rules to you have to order headstones through them so it’s a monopoly. Also the cemetery was vandalized last year and someone stole vases off of some stones including that of my relatives. My whole family is pissed off because we feel like the cemetery should have paid to replace them.
Yup, my mom's funeral alone was $12,000. And that's in rural North Dakota so it's probably more expensive elsewhere.
All she got was 25000 dollars.. That's literally about enough to pay off debts and settle her mother's estate, plus funeral costs. It's not like she's set up for life.

A very common 'defence' (well not really defence, just how some people justify not paying people back the money they owe them) is the old "wellll they have plenty of money so I don't need to pay them back after all".

Very common! I had family say "your life is better than mine so I don't need to support you with your depression". And these family members work in mental health (which is why I reached out to them). It baffles me that people justify their actions this way.

25,000 really isn't a lot of money especially if she had to use some of those funds to pay for the funeral...

The plaintiff was probably left with very little, if any, money.
The mom also knew that he was waiting for her to die so he could get that money. It's why she removed him as beneficiary. I don't blame her.

My uncle knows these people, the story is a little more complex, the sister lent her brother money for a lawyer but he had a falling out with his wife, so when the sister found out that he didn't use the money to get his stepson a lawyer she immediately asked for it back, he told her that he already spent the money and that he will cover it when he gets part of the insurance claim from their mothers death, this was while the mother was still alive, the sister then told the mother about what he said and she took him off the life insurance.

@gogokris85 he admitted he spent the money on himself not his stepson. He used the stepson angle just to get the $4000 from her, there was no lawyer, he felt his sister should have given him that money when the mother passed, he never had any intention of paying it back 🤗
like andrea said the fucker didnt even use it on the stepson which is probably why hes still in jail now - lied to get it and about what it was for on top of thinking he doesnt need to pay it back - would be nice if he actually had to pay it instead of the show

Honestly, I feel like if he was a nicer person to his sister she would have let him keep it. But he's probably a bully to her, that's why she decided to take him to court.
I hate people who think they're entitled to someone else's money just because that person has money or came into money. It's not yours. I don't care if the plaintiff is a millionaire and that 4k is a drip in her pot. If it's a LOAN and you said you'd pay it back, it's a LOAN. You don't get to turn it into a gift because you don't think she needs it.
Now, I MIGHT have some sympathy for you if you said, "I'm really struggling, I don't have much. I was expecting to be able to pay her back with some of the inheritance, but then I didn't get any and was shocked. I simply don't have it. It's a loan, I acknowledge it's a loan, but I don't have the money." Because that at least shows that you care and you don't think you're just entitled to someone else's money.

The sister loaned her brother €4000 for a lawyer for his stepson .. the brother spent it on something else .. the sister found out asked for the money back ''now'' .. the brother said ''I can't now, so I'll pay you back when mom dies'' .. the sister told mom that .. mom changed her will.

That was the wrong way to handle things on the defendant's part. If your parent leaves you and your sibling with money, and you find out that after your mother/ father/ guardian passes away that you were not included as a beneficiary, then you and your sibling(s) need to go to court to settle things with the estate. You don't take matters into your own hands.
Many Wills have a provision that if someone contests the Will then they get nothing. If mom already disinherited him then it seems that she did not want any of her estate to go to him.
This was a life insurance policy not part of an estate. You don’t have to go through probate. As a matter of fact after someone dies, my family takes a policy to the funeral home and signs a waiver to allow the funeral home to collect payment directly from the insurance company. Then the funeral home refunds us the balance. I remember in some cases on JJ involving funeral homes, people in comments said funeral homes won’t do anything unless you pay up front. My family NEVER pays upfront. But then we only do business with one or two family owned funeral homes.

Context: Brother (defendant) owes money to sister (plaintiff) and is butthurt because the sister was the sole beneficiary of the mother’s money but he feels he doesn’t owe the money because he should have recieved some of the money from the will. The plaintiff & defendant’s mother is dead.

He's 100% in the wrong but I would have forgiven a $4000 loan to my family member if I'd just gotten 100% of the life insurance proceeds, even if the family member was a jerk.
It wasn't a lot of money. Just 25000. And he borrowed it from her way before the mom died, so it's unfair to say the insurance policy cancels out his debt.

This is my personal take on family stuff like this.. I loaned my brother 2k when he was building his house and needed some extra money.. I had to scrape to put it together for him, but I did regardless.. If he never paid me back.. He is blood, I would never sue family for anything.. It is what it is, and underneath everything it is your own blood.. If you don't have it to give, just say that.. Otherwise it is water under the bridge.. Next time they need something that isn't life threatening, you just say you don't have it to give.
