    The global Lego fan base provides free marketing for the Lego Group that creates adoption of new Lego fans leveraging the "network effect" over the last 30 years. The fan base needs to be encouraged. Then Lego goes and stops these fans via litigation. Without these fans Lego would have never been such a successful global toy company. This action for me by the Lego group has provided a sinister and negative view of Lego. I will definitely be having this thought when considering to buy Lego in the future.

      From looking at the case, HA Bricks was either selling printed/custom bricks on BrickLink, which is against the terms of service they agreed to, or they were printing trademarked images on Minifigures, which are themselves trademarked. My understanding is that this goes against trademark law. You cant print a trademark on another trademark and then resell it.

    This is Bizarre. So if I buy a canvas and paint and paint a picture and then sell it, I can’t legally do that because it was made with someone else’s products?

    • @VestedUTuber
      @VestedUTuber Před 10 hodinami

      It's a little more complex than this. The problem is predominantly one of trademark - you're not allowed to use the LEGO emblem on your products as a third party seller, and unfortunately that includes the molded-in LEGO emblem on the studs of each brick. HA unfortunately ran afoul of this.
      Even so, LEGO's response was way overblown and reeks of weaponized litigation in an attempt to secure a monopoly. They could have easily just settled by requiring HA to remove any LEGO branding from their completely original products and to sell their kits as instructions only instead, instead of shutting them down entirely. HA has grounds to retaliate with an antitrust complaint.

  • @VestedUTuber
    @VestedUTuber Před 11 hodinami

    If I was in HA Bricks shoes, I would have filed an antitrust complaint the moment I received the C&D, and then also altered my CAD drawings to remove any LEGO emblems just to be safe. Technically LEGO was in the right here but the lawsuit was blatantly in bad faith in an attempt to shut down competition.
    This is the same shit Traxxas pulls in the RC hobby.

    If Lego supplies all of us train enthusiasts with products like the very badly shaped ‘Orient Express’ (an insult for the original designer AND the legendary train itself) for ridiculous prices, they should not be surprised that we look elsewhere for better ways of design, building and spending our money on brick-build trains.

    So if HA bricks permanently changed the appearance then whats the problem. Are we not allowed to modify our own bricks. There's no end of chinese companies imitating lego but they go after the one that actually does a good job and pieces lego don't do. Why not work with HA bricks, buy them up and do another line of models etc with HA bricks running that line.
    How the f*ck can lego have rules after you purchase their product. Surely if you can't modify and resell lego then selling sets missing figures and bricks isn't allowed either.
    Urgh can just picture lego suing for the customer data and then suing the customers too. I wouldn't be surprised, if they can't get those in china then they'll get the customers. Morons. Perhaps if lego fulfilled what people want or need for models people wouldn't modify their own or purchase modified ones.

      The problem of the bricks with the bearings is that they had the "LEGO" logo on top of the studs and therefore someone could think that those are official LEGO parts.
      HA Bricks should have somehow cancelled "LEGO" from the studs or used alternative suppliers or 3D printed the bricks themselves.
      Furthermore, the list of bricks used did not properly differentiate what was actually LEGO and not.
      This means that HA Bricks was basically making LEGO liable to all the parts and modified parts without LEGO consent. I think this was reasonable.
      However, I don't like the severity LEGO went down.
      They could have settled it with forcing some new book instructions and emails to inform of the changes and that's it. Plus a small fine.

    • @dennistomsen5822
      @dennistomsen5822 Před 2 měsíci +4

      There was no mass producing stuff. HA Bricks used 99% original LEGO parts in the train sets. Also TLG didn't want any compromise and went straigth to court to make an example out of HA Bricks.
      Meanwhile the big offenders, the clone brands, walk free. Why? Because they can defend themselves in court economically. Which makes "our beloved" TLG:a bully imo.
