Case title: Pramod Singh Kirar Vs State of Madhya Pradesh
Date of Order: 2nd December 2022
ISSUES RAISED- Is it valid to reject a candidate's candidacy on the grounds that he has been tried for an offense under Section 498A?
BRIEF FACTS- In 2013, Pramod Singh Kirar sought the constable position and was approved for the job. He stated that he had previously been tried for the offense under Section 498A IPC and had been found not guilty in the verification form itself. Later, his application was turned down because of his involvement in the criminal case. The Madhya Pradesh High Court (Division Bench) upheld this denial, noting that if the candidate is found to have been involved in a criminal case, the employer still has the right to consider antecedents and cannot be forced to appoint them-even in cases where the candidate has been cleared or the employee has made a declaration that accurately describes a finalized criminal case
FINAL JUDGMENT-
In an appeal, the Apex Court bench comprising of Justice MR Shah and Justice CT Ravikumar observed and noted that the offense for which he was tried ultimately resulted in acquittal and the same had arisen out of the matrimonial dispute which ultimately ended and resulted in a settlement out of the court. Further, it was noticed that there was no suppression of material fact in this case.
The bench observed and has stated that under the circumstances and in the peculiar facts of the case, the appellant could not have been denied the appointment solely on the aforesaid ground that he was tried for the offense under Section 498A of Indian Penal Code, 1860 and that too for the offenses alleged to have happened in the year 2001 for which in the year 2006 he was even acquitted and may be on settlement (between husband and wife).

Sir जिसके ऊपर तारी दारू पीने वाला और मार पीट वाला केस हुआ हो और उसका वेल कोट से हुआ हो तो उसका सरकारी नोकरी मिलेगा या नहीं
99.99% cases are not honourable acquittal because courts will never do fair trial.
Those who are witnesses in chargesheet will rarely appear in court after issuing summons & warrents.
Court'll never ever drop those witnesses in serious cases.it'll fully dependent on judge to drop the witness or not.
if investigating officer takes bribe to register FIR, he'll never ever come to court after a no. Of years of issuing summons & warrents.
If judge'll acquit you in criminal case either by chargsheet mistake of fact then it is somehow OK.if the judge give his judgement as a false case, then APP can appeal in high court/supreme court from case to case basis.
The system is corrupt.

if the criminal case is pending then there is almost a 100 % chance that his appointment may be rejected at the time of Joining, however, if he is already appointed then no action will be taken unless he is got convicted. There is one case Anil Srivastava vs Registrar of Chattisgarh, where the appointment of District Judge was rejected on the ground that at the time of his appointment, the criminal case was pending but he was acquitted subsequently, the SC has held that there is no bar for his future candidature, but the rejection will sustain
