Not sure where you got the idea that Trump's team didn't raise any defense but this. Read the court documents. There was nothing criminal about the POTUS having classified docs, he was the only individual with the right to de-classify anything, his people had been working with records people about how & when to send things for archiving, and, contrary to the photos the Smith team admitted to setting up, all the documents marked "classified" were in a room with double locks in a private club not open to the public, protected by secret service. Compare to Obama having boxes with classified records in several homes, Clinton having records in his sock drawer, Hillary having classified docs on a private server known to have been hacked and, of course, Biden, who never had authority to remove classified documents, storing them in a torn box in a garage. So, go ahead, make your case that Trump was the one who should be raided, his staff & attorneys locked out of the building.

One thing you conveniently leave out is that he was working with the library of Congress in June. And when they left he assumed that everything was being done correctly and that the only thing they asked him to do was put another lock on the door to the room that all the documents were secured. In truth, there were 104 pages that were questionable as to whether he could legally keep them. There have been witnesses that have claimed that some of those boxes were put in without Trump's knowledge as they were being removed from his premises at the White House. I wish they would spend as much time with Joe biden's documents found in the back of his garage and on the floor and in his house in Vermont and in another building which I do not remember the exact details. Remember all these documents that Joe was found with were removed illegally because he was never president at that time he took them. And yet they decided that he was too feeble to stand trial. Again remember that Trump was working with library of Congress. This judge made the decision based on the law states very clearly that prosecutor in that position must be nominated and go through the process in Congress before he can become a special prosecutor.

In fact, 28 CFR Section 600 stipulates that the Attorney General shall appoint Special Counsel (Prosecutors) and appointees shall be chosen from outside the U.S. government. In other words, "duly appointed and confirmed federal attorney(s)" are disqualified from serving as SCs. Therefore it seems obvious that Special Counsel absolutely have power to investigate and prosecute in any federal court. Period.

In the case of David Weis and for that matter Robert Hur were both selected by the president to become special counsels and were then approved by the senate as the constitution requires for officers of the United States. Jack Smith never went through that process, he was hired off the street by garland and given the assignment. The constitution is clear on two points, one the assignment process and two spending tax dollars without being assigned as an officer of the United States is unlawful. This issue is quite clear, merrick garland overstepped his authority and violated the constitution.

These reporters were surprised that the illegally appointed so called special prosecutor and Merrick Garland were called out AT the time it happened and now by the judge in the case? Congress was upset at being bypassed. Said so it is in several videos. So she hardly overstepped her authority in recognizing a simple fact. Maybe you should do a little bit of a homework on what actually happened with the documents. You are getting this from the media. Maybe if you knew that Trump was working with the library of Congress in June and had understood that they were satisfied with what he was doing with the documents and all they requested was that they would put a lock on the door to the area where the documents were being kept. There is speculation that some of the documents were put with Trump's paperwork without his knowledge because the members of the library of Congress are supposed to go through the documents before he takes them to his residence. But the media has conveniently left out that and much more information and left out the fact that Jack Smith was selected by the attorney general which was not legal. There was a special counsel rule made earlier which would have given him the power to select Smith legally but had expired and Merrick Garland knew that when he selected Smith. Smith's position and special counsel must go through Congress not only for approval but also for the funding which Garland did neither. But because we have a two-tier justice system the Democrats think that Trump got away with breaking the law. I'm guessing the paperwork to documents that they were looking for during the marlago way raid was a folder that people had known about but had disappeared when Trump was in there and my hope is it will put away a lot of people in prison.
