I'm been flying for 3 years now. I fly with Asian Black Kites which are birds of prey that are as big as Eagles. There are also Falcons, and owls. Smaller birds are swifts who will gather and swoop you if they believe you are a predator. However, it is important to know, that you can train them, even the raptors. You are correct about nesting and territories. But if you fly away then you are exhibiting the action of prey. The raptors will pursue you but if you stay your course, rise up and like you said, use sport mode then they usually learn quite fast that when you shoot straight up, it's something they cannot do. With Raptors, I usually fly opposite circular patterns to them. This is what they do with each other. It gives them a chance to check you out and because you didn't run away, they usually tighten the circle and check you out closer. Then if you shoot strait up, they realize that it is a skill they do not possess. I found that if you follow them for about 30 seconds to a minute they will fly away from you but be careful, they also fly in groups and can chose to double team you. For me, the key is not to show fear. I Fly with these Eagle sized Raptors all the time. I will often fly right into a large group of them just to fly those circular patterns. Here in Ha Long Bay Vietnam, the Raptors are now used to the drone and do not see it as prey or a threat. I am able to get some world class camera and video shots of them up close and personal. I have been attacked before but this was only when I am flying in a new area. They always stop the attack when I shoot straight up and then pursue them for a short time. Then I break it off as not to stress the bird too much. It seems to work. Just remember, if you act like prey they will attack, but if you establish a skill in flying, they tend to respect that. The only time I ever felt truly attacked is when I was attacked by a large falcon out over open sea. But I flipped into sport mode, rose quickly and got out of there. I was able to fly into the wind at a speed he could not match and I out ran him. Cheers.

I fly a drone for my company. We are a tourist destination, so a fairly large complex right on the water. My number one problem is grackles. These birds gather in large flocks and are highly territorial. When they are nesting they become highly aggressive. They routinely chase and attack ANYTHING that gets too close to their nest. I've seen them divebombing cars that drive by. People sometimes get injured when these birds start attacking. And they don't stop till you are WELL away from the nest.
Basically, I've got a policy not to fly our drone around the facility from April thru July while the grackles nest.

Here in California USA We have hawks, buzzards, crows, ravens, blue jays, falcons, seagulls and cliff sparrows, all well known to attack drones. Another one to consider while launching or hovering near trees and bushes are hornets nests and beehives. The sound of a drone will instantly set them off! It’s impossible to control your drone while dancing and running while flailing your arms, and you absolutely will not enjoy cleaning the blended bee carnage from every nook and cranny of your drone.

Waste of time. The entire video summarised... if you see birds don't fly a drone. The rest is just advertising for his drone academy as if the youtube adverts weren't enough. C'mon mate heaps of us live on the coast and fly 100% everyday around birds especially gulls. If you're on a contract for a specific shot or need a certain shot for other reasons you can't just go elsewhere or "ascend in sport mode." Many shots you have to hover to get the shot. We need specific tested methods such as colour patterns and googly eye paintjobs or something that actually deters the birds away from the drone... not simply pack up and leave which is pretty much all you said just to get views.
