  • Tennessee Constitutional Carry Spells Big Troubles for Some! News: The new Tennessee permitless carry law announced by Governor Bill Lee went into effect on July 1, 2021. The new law may not be exactly what you expected it to be. The new Tennessee law is far from constitutional carry. Rather, it is permitless handgun carry that is full of traps and pitfalls for those who may rely on it. Even if it were constitutional carry, the Tennessee government has not done a good job of providing information pertaining to it to the citizens of Tennessee. We strongly recommend that you keep your permit, or get one if you don't already have one. Don't rely on this new law to keep you out of hot water. That said, each person who is going to carry a handgun needs to know the laws surrounding carrying a firearm, and the laws surrounding the use of deadly force.

    I am a retired police officer of 23 years. When I was out on patrol. I didn't care if someone was carrying an AR-15, shot gun, 30.06 or 308 rifle down the road or not. Reason why. It's not the gun that kills people. It's the person behind the gun that kills people. Remember. A crime isn't a crime until it's committed. When I was a kid, I carried all types of firearms up and down the road while hunting. Never once was I stopped by the police or sheriffs department and questions because I was exercising my 2nd Amendment right. Hell. When they drove by me caring a gun they either just waived and kept going or got out and asked if I killed anything and looked at what kind of gun I was carrying. This shit today that everyone is a criminal that's caring a firearm and violating peoples rights is the reason I got out of Law Enforcement. People better remember. The 2nd Amendment gives the people the right to do just that. Carry firearms in their vehicle or out in public. Incase people are to damn dumb to understand what the 2nd Amendment says, I will tell you. (A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear Arms SHALL NOT be infringed) I think it's spelled out pretty damn clear myself. The commas are put in the right place. Shall not is a direct command. It doesn't mean must or may. It means SHALL NOT!! which tells me It's NOT going to happen without a fight from the people. PERIOD! I choose to be on the right side of the Constitution. The 2nd Amendment side.

Are you being serious or just being a typical dumbass millennial who slept through history class and really don’t know?? Either way, by the way you asked the question you hate the 2nd Amendment and what it stands for. If not! then I would tell you to look up the definitions of the words Regulated, Militia, freedom, security, bear Arms, right, necessary and the key words SHALL and NOT to really understand the 2nd Amendment and what it stands for. The second part to your question is this. Look up the first eleven words to the preamble to the Constitution. That’s your clue to you dumbass question on who regulates the militia. Hope this helped. Now go study like you did back in school.

They are all terrorists who do not fulfill their oaths as I have seen literally zero law enforcement ever arrest a politician for violating 2a rights. 18.242 deprivation of rights, capital crime. They should all be prosecuted, convicted, and executed. All one million law enforcement in the USA are guilty, and every judge. It's time. It is time for every last one to be removed from the ecosystem. They are all terrorists.

      18.242 deprivation of rights. Capital crime. Prosecute, convict, execute all antigun politiicans, and all law enforcement and judges in USA. Zero arrests have ever been made for deprivation of rights or Infringments. Zero cops or poltiicans were arrested for depriving rights. Therefore all leo are guilty. Every last one. Every judge. Every cop. We can't function as a human termite colony with disrunctioal parasitic organisms in it. We have to cleanse the colony. Survival of the colony depends on it.       Yeah but if ya live in NJ or NY, you're looking at 5 years mandatory if you're caught with a loaded pistol. A lot of us embody the, "I'd rather be judged by 12 than carried by 6" attitude but it's still a little nerve-racking.

    Just updated my permit in 2022. When Will the TN Code about "Going Armed" be Repealed or changed to Keep from being charged of Being Guilty and Having To Prove I'm innocent for Carrying a firearm On My Own Property Or Anywhere Else in Tennessee?

      TFA said the 2010 Bruen case in the Supreme Court rendered the "intent to go armed" statute null and void but I'd sure like to see it deleted.

    As Clint Eastwood would say, this is a "Cluster Flop"! The words in the movie were more descriptive, but it was four letters and did start with "F". Most TN Lawmakers are just dumb when it comes to firearms. This is just an open invitation to get arrested. The lawmakers lost their nerve when it came to Constitutional carry. Our last Governor and our present Governor are just "Sitting on the fence" when it comes to 2nd Amendment issues. It is a stretch to say they are conservative. They are weak on other issues such as capitol punishment.

      I agree 💯 with this. The enhanced carry permit requires the class and range time. It is great because it gives you understanding of the law, and allows you to ask questions.

    I carry everytime I got hiking. In the mountains. And now permit
    Because it is very stupid to go hiking without a fire arm. Im not going to become bear food because of some dumb ass politics.

      Exactly. Plus you never know who else may be out there. If it is you and someone doped up, and they are intent on not just robbing, but doing worse, and you have no means to protect yourself, your only hope is the rattlesnakes or bears get them first. Remember, if there are no witnesses, it is your word against someone that can't testify due to lack of life.

      With the enhanced carry permit, it allows you to carry in other states that recognize Tennessee. It also allows you to carry on TWRA lands and state parks, unless rules prohibit. ALWAYS check those rules or laws before entering armed. Last I checked, you could not carry in a state park without a permit or the concealed permit. Of course this is last I checked. I have the enhanced permit, but please, don't take my word for it and make sure you do research and find out for yourself. I would hate for my words to get someone else in trouble.

      @@jdailey19811i was just reading the law. Both permit holders and enhanced can carry in parks as long as it's during an authorized hunting season of what you're hunting and that you're hunting on approved land/going to approved hunting grounds or a gun shows that harder authorization. Do I understand the law regarding parks correctly here?

      A free gun zone such as a mall can not have you arrested, they can only ask that you leave the property if they see you with a firearm. If you conceal it, and don't sho w it off, you are good.

    And remember National Parks, Federal building's and while you may be legal on the waterways firearms are prohibited on Corp of Engineers areas that's a tricky one , even with Enhanced permits. Be careful

    If it's concealed nobody knows you have it unless you need it and in that case I'm sure it would not matter if you snuck it in past their little paper sign..

      Those signs do not carry the weight of the law in Tennessee, unless they have the TCA code listed with it. If it just says "no firearms allowed", the most they can do is ask you to leave, and only if you don't and make a scene, now ot becomes a problem. I try to do my best to avoid businesses that want to keep us from protecting ourselves.

    Carrying in tennessee is full of gotchas. Its obvious the general idea is to have the illusion of constitutional carry, but in reality its designed to be difficult to actually carry within the law. Dont doubt for a second that if fpund in violation tennessee will strip you of your rights and charge you criminally.

    I moved here from Virginia and y’all’s gun laws are WACK… Virginia is a largely liberal state and we still don’t need a permit or “enhanced carry permit” to open carry. We also in Virginia can carry a firearm in a business even if it posted as a gun free zone and it’s NOT a criminal charge. But here in COMMIE Tennesee it’s a misdemeanor charge and they take your GUN! RIDICULOUS!

      If the law is contrary to the U.S. Constitution, the law is null and void. No State law can supersede a federal law and the U.S. Constitution is federal law. If there are any doubts, just refer to the Supremacy Clause, Article VI, Paragraph 2, of the Constitution for clarification.
      The problem is that citizens don’t understand their rights. They believe anything government tells them and bow down without question. We should ALWAYS be defensive against our government and question anything, and everything, they do all the time. The Bill of Rights were written to protect our rights, not grant us rights, and, is a restriction on government… not a restriction on you or I.

    There is only one constitutional carry state that require you to be a state resident to carry without a permit… Tennessee does allow non residents to constitutional carry.

      I was always under the assumption that the U.S. Constitution was valid in any State of the Union. I have 1st and 4th Amendment rights when I travel to other States, why do I not have the same 2A rights as well? The 1st, 2nd and 4th Amendments all have what in common? They have these words… “The right of the people” in their wording.
      The Bill of Rights of the U.S. Constitution is a federal law. If anyone has forgotten that just refer to the Supremacy Clause and it will clear things up.

    Please just do yourself a favor and get the enhanced permit. Sure, it costs more, but you get so much more than the concealed or permitless carry, and police will actually feel better in knowing you have taken the enhanced course.
    Taking the class, you get a lesson in Tennessee gun laws, carry laws and what is justifiable use of deadly force. You also go to the range and the instructor can see if you can safely handle a firearm.
    Once passing and meeting requirements, and your permit comes in the mail, you can now carry anywhere you can legally carry, open or concealed (unless otherwise specified) and in TWRA areas as well as state parks and greenways (unless rules prohibit). It is better to just save the time and possible hassle. Get your enhanced permit. They are $100 or you can pay $300 and get a lifetime. Once you get your enhanced permit and should you decide to upgrade, the cost is $200 if your permit is still valid before you need to renew.

      The Enhanced Permit is most certainly the best way to go. And, you can get a lifetime permit with the Enhanced Permit class.

    oh I can tell there will be more than a few misinformed individuals... The average JOE/JANE won't read anything. Favorite excuse: "I didn't know" reading signs and new laws has saved my hide on a number of occasions. It pays to keep in the know when it comes to this stuff. Getting an Enhanced Permit is the way to go. Also invest in carry insurance!!!!!! U.S. Law Shield is a must when going armed!

      This video has misinformation… I can’t find anywhere that you need to be a resident and only information stating the contrary. There is only 1 constitutional carry state that requires residency.

      @@waimeagavin808 - All States have Constitutional carry. It says so in the 2A. Whenever a State requested to be a member of the Union they were required to adopt, and adhere to, the U.S. Constitution and they could also make their own Constitution but it couldn’t be restrictive on rights already protected by the federal Constitution. The Supremacy Clause will clarify that a State law is null and void if it’s contrary to the U.S. Constitution.
      If States recognize that citizens from other States have 1st and 4th Amendment protected rights, why do they not recognize the 2nd Amendment protection as well? If no “Mother may I” slip is needed for freedom of speech, religion or the protection against unreasonable searches and seizures, why isn’t a citizen afforded the same for the 2A? All 50 States, and U.S. territories, recognize the drivers license from other States and allow the privilege to drive yet they want to restrict an inherent, unalienable, right like the 2A. If we’re required to have a permit to exercise a right, then it’s not a right but a privilege. Anything government grants to you via a permit they can also take away. The 2A is not a privilege.
