J. Michael Luttig and Laurence Tribe make the case for Trump’s disqualification from public office

- In a new article for The Atlantic, retired former federal judge J. Michael Luttig and top legal scholar Laurence Tribe make the case that the Constitution includes a provision that disqualifies Donald Trump from holding public office again. Section Three of the Fourteenth Amendment is also known as the “disqualification clause.” It’s only two sentences long but it could doom Trump’s bid to return to the White House. The disqualification clause “forbids the former president from holding the office of the presidency again because of his conduct in and around January 6, 2021,” says Judge Luttig. And as Tribe points out, it’s not a sanction against an individual. “The framers of the 14th Amendment took great care not to treat this as a punishment … Nobody has a right to be president without meeting the qualifications.”

I’m so grateful to these two honorable men for bringing Americans the truth about amendment 14, section 3. We the people will not have an insurrectionist in the presidency, the Congress, or any government offices.

The most important charge was not yet made. Aiding the insurrection while the Capitol was breached by refusing to recall the mob.
Trump had the duty, the ability and the opportunity but he refused. That is known in the law as omission as actus reus. Inaction as criminal action.

Even without the disqualification clause, fret not. EVEN IF he is somehow allowed to run, Americans will NOT vote him in. 2016 was a horrible mistake mainly the result of too many of us not voting and likewise, not being involved enough I'm our own governments to make sure our country is run well enough that there aren't millions voting out of ignorance, lack of education, and SPITE and anger at being tired of other corrupt politicians.
We need to determine who in Congress and Senate supported the 1/6 insurrection, and remove them. They are a clear and present danger to our national security and our democracy!

The 14th wouldn't disqualify him because of his conviction, it would disqualify him as an insurrectionist. Any one who is over 35 and a natural citizen can run. The lack of qualifications was considered a protection against the office becoming the province of a ruling elite, I think. The founders were always thinking about Rome when as they designed the Republic. I think the lack of qualifications for the executive office were intended to prevent the patrician/pleb dynamic that created most of the internally generated drama of the Roman Republic.
I believe the founding fathers wanted to prevent political prosecutions to disqualify people. You see it in Russia. We cannot fall into that here. MAGA thinks we are descending into it, but that is the facade Trump weaves into their heads.
If you aren't eligible to vote then you shouldn't be able to run for office ,and if you are convicted of a crime you shouldn't be allowed to be elected.

How do we petition our secretary of state to have Trump taken off the ballot as Mr. Luttig and Mr. Tribe suggest? I will sign that petition in a heartbeat!
A petition wouldn't do it; perhaps if you managed to get 51% of the state's voters, it might carry some weight. But if a particular Secretary of State refuses to remove a name, the next step would be for a voter, a voter group, another candidate, to sue the SoS when that name appeared on a primary or general election ballot.
Create a petition and then publicize it. Lots of petition websites you can use.

The Executive Branch enforces the laws, but if the DoJ, being part of that branch, tried to enforce the 14th Amendment, you'd hear Republicans screaming "WEAPONIZATION!" all the way to China. Biden and Garland have been treating Trump with kid gloves because they don't want even the appearance that they're unfairly trying to disqualify the president's competition. Republicans, of course, accuse them of doing that anyway. If the shoe were on the other foot, a Trump/Barr DoJ would disqualify Biden in a heartbeat and let the chips fall where they may. Democrats are too afraid of doing anything that suggests they're taking anything less than the "high road." They're by far the more decent party, but not nearly tough enough.

After you showed your pocket size copy of the constitution you needed to become a US Citizen. I thought that every American should have a copy especially in these times. I googled online and the place to buy a pocket size constitution, the national archives popped up. Think of the irony in regards to the former guy. I ordered a pocket size copy of the constitution which arrived in the mail yesterday. I believe this is the most important document I’ve ever purchased and I believe every one in America should buy a copy.

I am looking back at this interview Monday April 15, 2024 and am ASTOUNDED the Supreme Court would not place hearing the Presidential immunity matter on a fast track. This is the most consequential act in recent US history. It is a direct hit and threat to our democracy and way of life. And yet, the Supreme Court, that has fast tracked other matters of less consequence refused to do so. The Court will hear the case at the end of April with an opinion by July. It makes calendars difficult for the judges in the 3 other Trump matters to schedule and it does not prevent Trump from running for President.
As a result, this Supreme Court has favored Donald Trump by dragging its feet, has placed politics over impartial judicial doctrine and is judicially tainted which is posionous to the highest court in this country.
How did he get around the law. He should not be on the ballot. This is dangerous for the USA.

Citizens for Responsibility and Ethics in Washington: (CREW) is an organization based in D.C. that filed a case last year in New Mexico to remove a local office holder on the same grounds, and they won! As a result of that victory and the recent supporting legal papers, they (CREW) will be filing suits in various state courts to keep Trump off the ballot. They expect this test case to be taken all the way to the Supreme Court, as these two guys predict. So, you might want to do two things, one, donate to C.R.E.W. to aid their efforts, and two . . . Stay tuned!

I served my time Honorably and moved on but the one thing I have NEVER (Nor Will I ever do so!) Relinquished is this part of that Oath that I took,
IMHO any Veteran or or any Politician who also took the same oath and has waffled/reneged/disregarded it have no respect

I'm adding a comment to this 9 months later. Alas, the Supreme Court completely turned this on its head. They decided it wasn't self-executing, and also said there had to be some kind of law made to establish how to implement it. What a mess!
Would the lawsuits from citizens against Secretaries of States have to be after he has the nomination or could they be before? No harm has occurred before he has the nomination so would the lawsuits just be dismissed?
First of all, you can't just go into a court house and file a lawsuit, because you don't want Trump to be elected. Judges and court houses are not the place for MSNBC media games. ie they'll punish you for not standing up when the judge walks in the court room. Never call a judge you or yo, do not ask a question before being given permission to do so, etc......You'll be better off staying home and watching CNN
