      I've got somebody to completely moved to mobile home into my property and has no legal right to my property. What can I do? The sheriff's department here in Henderson county says they can't do anything about it.

      @@buddymacdaddy It’s a risk like anything, but wait until no one is home, break into your house, change all the locks, and when the squatters comes back call the police and say they are trespassers. Make sure you bring copies of ownership to the home or even type a fake lease to yourself. Police can’t do anything to you in the same situation and squatters won’t bring you to court cause they’ll lose.

      The problem is people pay illegals because it's cheaper and then they pull this crap. My dad paid some guys he picked up at home depot parking lot to do a job and when he came back to the job site the took off with his tools.

The tilesetter>squatter probably gave them a price that sounded good, with the arrangement of staying there. Some homeowners would think they were also getting "security", rather than leaving the house unoccupied.

      In this case they had a contract in writing that allowed the person to live on premise while completing tile work. In this case it is an eviction.

      They allowed him to live in the home while he did some work on the house. They even had a contract. So he's not really a squatter. More like a tenant and has to be evicted. They should have never allowed him to move into their home

      @@dogrum1 Them making a contract and allowing him to live there is what turned this into a tenant/landlord dispute and made it a civil case. Lesson here is don't be stupid and sign contracts or let people live in your home.
      Now if the property owners can show he entered into the contract in bad faith then the contract could be invalidated. Either way, its now a civil matter, not criminal.

    TEXAS, and EVERY other Governor must immediately do the same as Florida with their new signed Bill to abolish criminal trespassers/squatters. Legal Homeowners WHO pay the taxes to run your cities are dying defending their legal property and others are going to jail. Many have had to pay thousands of dollars in legal and repair bills. Every Mayor, Senator, Representative MUST take note and take immediate action to protect the mom and pop homeowner and apartment owner. Follow Florida's LEAD. Georgia has got their ball rolling and waiting on Governor signature. How egregious, this Spanish contractor is assuming he can bring his whole family into a home that he was doing some work. Mental note: NEVER ALLOW A CONTRACTOR to sleep on the premises. Many opportunists.

    Lawyers are reluctant to give certain legal advice, but I saw one in a video make it clear that, if it is your home, and someone is there without your permission, you have the right to enter YOUR home.
    Once inside, you have the right to defend yourself from intruders by any means necessary.

      I am happy for new laws taking away squatters supposed rights, but it's not good to imply someone would be legally safe doing something that isn't legally safe yet.

    You shouldn't have to evict someone who doesn't have a lease. You should be able to press charges and have them removed immediately.
    Texas needs to do away with adverse possession, admend renters' rights, and create a no squatting law.

      Okay but what about verbal contracts?
      If I tell my brother-in-law he can stay in my vacation home for a year over the phone and never write him a lease and then 2 months later I change my mind I still have to evict him and he still gets to have his say in court. Without a lease the state will assume he has a month-to-month lease at the bare minimum and require at least a 30 days notice to get him out.

    From what I understand of Texas law that man is a trespasser, not a squatter. And homeowners there have the right to use lethal force to protect their property, with full protection from both criminal and civil prosecution.
    In other words, that "squatter" is only alive because of the patience of the homeowner.

      Stopped paying? Are you talking about a squatter or a renter? Squatters generally don't pay anything, that's their purpose for doing it. If you're talking about selling a house that is occupied by renters that's you, their lease should have been transferred to the buyer or you should have given them ample notice of intent to sell.

    This is so stupid that the homeowner has to prove they did not rental out the house and have to hire an attorney to start the eviction process to regain possession of their own property. Squatters should have no rights. It's out of control because the system have given the squatters the power.

    This is a failure of the law to do what's right. They know what's right and they know what should be done.     This just happened to my Aunt at her small lake house. The young lady she let stay temporarily would not leave and invoked "squatters rights". Smoking weed, and having people hiding there. When the cops failed her, shee decided that she would have 10 of her "big smelly, wild biker friends" to be her new room mates! She said "they don't mess around and they party late into the night! Good Luck! They'll be moving in tomorrow." The girl left later that day!😂

    Property owners need to demand law changes. Owners shouldn’t have to evict….the police should remove them immediately….owners shouldn’t have to spend money and wait to go to court to get an eviction….the squatter should be arrested immediately.

    B&E stand your ground in Texas. my mother had this same trouble with her own granddaughter. her husband and 5 kids. the law kelp saying you have to do this do that do something else. i got a call drove 1900 miles and in 10 minutes they was out of my moms house.

    If a squatter can take control of your property why can't the property owner just squat on the squatter and get control back. They have to leave the house sometime. If the law can't stop them from squatting then it can't stop someone from squatting back.

    Missouri needs to change the law my neighbor is trying to steal part of my property .She lies telling the judge she been taking care of the land for 4 years and she just been there 3🙄we told her to stop mowing our property ,but she just keeps continuing cutting it we called the sheriff ,but he said can’t do anything it’s a civil matter ,we had our land surveyed and have a property map. If the judge grants her our property then I sure don’t believe in the law anymore.

      You should start aggressively lawn keeping the property line, and over it into hers. Build a garden and infrastructure right on the edge of the boundary, and fight fire with fire. Get the work approved and inspected officially for something like a small greenhouse right on the line, and then wield it like a weapon in the court case against her. Judge won't be able to make heads for tails, and probably will just drop it right where the line is at, or rule in your favor. Which would be even funnier when your land gets just a little bit bigger from one lady who wouldn't stop pushing.
      Believe me I've had to deal with neighbors like this before, especially ones trying to invade inches within, and over my line. Suffice to say I ended up inching them away even farther than they were before. I put a 6ft fence exactly where it should be on the line, and forced them to move a trailer they set down to live in literally 2 inches from the property line. Guess what? I couldn't paint both sides of my legal fence with their house sitting right in my way where it never should have been in the first place. Asshole just wanted a bigger porch, but too bad. You ain't gonna take my land away to do it buddy.
