If she is that dumb not to get the entirety of the funds up front then that is her fault. In a rental, there is normally first, last, deposit. In airbnb, there is pay all the money and then move in so the fact that she claimed airbnb but for some reason rented the place outside airbnb just goes tro show that she was scamming airbnb and got scammed while trying to stick it to airbnb. I wish I could find it, but I remember reading a study once that claimed financially insolvent men had 1.5-2x more sexual partners than their financially solvent counterparts.
I think people should also seriously look into investing of some kind. Something that brings money back to your pocket, real estate, stocks, whatever can bring back value to their bank account rather than draining it. Obviously investing has its risks but so does just having money in depreciating assets or straight up liabilities.

There is a portal. It is called actually using Airbnb or vrbo for rental. This lady was trying to get away with not having to use any of those businesses and avoid the fees that come along with it; which would have helped her avoid this. She spent more in lawyer fees than she would have if she had used the proper rental companies!

@mrbear1302 People have stopped payment on cards before, they'll do it again. If the host "canceled" the reservation in order to avoid fees, that is a problem of their own making. However, relatively few guests will carry 10k on them, and few hosts will set up their own credit card acceptance account. If the guest canceled last minute to avoid paying (which is a possibility), that is fraud. I suspect this may be the more likely case: acquire the check-in info, then cancel and depend on the host not being able to react in time.
A hotel wouldn’t have this issue to evict once the person stops paying for the room. The cops would immediately be called and they would be told to vacate by force immediately. Why is an Airbnb any different?

Now, if they had a business license and this had happened, then, the business is protected under a different scope of law since a business is expected to trade service or product for goods. Now, I have seen business have to go through the court process to evict tenants but the law would be more in favor of a business.

It's mind boggling that this actually can happen in America. Once somebody is not paying that's criminal trespassing and they should literally be removed that same day, not a month later and after a landlord has to go through an eviction process. I simply don't understand how any law can permit this to happen.
Because when the police show up the squatter will claim (and often show) a fake lease. When they do so - and their stuff is in the location - the police can't really do anything because it's a civil matter. The police have no way of knowing whether the lease is fake or if it's just a vindictive landlord trying to use the police to illegally evict real tenants.
This lady did it to herself by not actually using Airbnb.

It’s so bad out there my mom has rentals and constantly deals with this stuff. Not to mention property damage. She’s been to court so many times to evict people for non payment.
Way overdue to have an expedited process to handle squatters such as these. Currently the process seems to favor deadbeats.
Don't forget getting Air BnB to follow same laws as other hotels and the like. No more special treatment for people buying homes and renting them as investments. Homes are for living in, not receiving a rent pay check from. Build an apartment complex if you want to be a land lord.
They banned airbnb in my neighborhood they can't even open one any longer because all the trouble that comes with them.
Wow $10k/mo? I would think background check, and upfront deposit would be required before renting out. Hell, we had to go through backround, credit check, deposit and 1st month, while signing our life away with the contract before we could rent a place temporarily while looking for our new home, and the rent was $2400! (Which is expensive to us!)
May I ask what state you did this in? In Oregon,Airbnb requires no credit check, just one month and a few hundred in fees.

Would be nice if it didn't take a simple case 10 or 11 months to go to court... This could be handled in days if every state fast tracked these cases like some states are now doing.
I knew a landlord that would get 10 of his buddy's, remove the tenent/people in the unit, pack up their stuff put it in storage. Then change the locks put an armed guard at the location, done. Once they stop paying rent they should lose all tenent rights.

Airbnb makes it very clear to hosts that if guests stay long term over 30 days, airbnb waives any liability and the host must abide by all local tenant landlord laws. She should have known that already

My ex's ex did this very thing for years. She would rent nice houses, put down just enough to get in the door and then fight eviction for months on end. Their little girl said she never unpacked boxes or suitcases because it was always a matter of time.

They need clarity in the law that short term renters are guests and can be evicted at anytime.
Except we already have a system in place for that, it is called being a hotel. AirBnB wants it both ways where they aren't tenant rentals but also not guest stays, because then it would mean they would either have to admit that they are a fly by night shady leasing agency or running unlicensed hotels. They can only operate as a business because of the current grey area.
So someone could pay for a two week rental and then the landlord could have the police evict them after 1 day and keep the money? Yeah, that's a great idea. 🙄
AirBnB wants to operate like a hotel but they offer none of the protections of one. What they're really offering are short term leases but that makes their patrons tenants, not guests. If they want to have the same protections as hotels, then they're going to need to be registered as businesses, operate only in commercial zoned areas and play things like hotel taxes.
Courts need to hear these cases in days.. not months... Thats the real problem is most states won't fast track simple cases like this....

The simple solution to these type of rentals is having the power breaker and water shutoffs outside of the rental property. Ideally inside your own home if the rental is on the same property. Trust me once the water and power get cut the rental won't be so desirable anymore.

"They want better laws for short term rental properties." The only problem there is that they are attempting to use these residences as hotel room rentals, which isn't within the law as it is. No one is going to want to write laws that encourage the housing shortage even more.
2 responses: the Hotel ACT SHOULD apply, and you can get rid of non-payers immediately (short term) and in my recreational area short term rentals do NOT affect long term. ST are much more luxurious and high end; rental demand is on the low end. they do not meet. Prevent my assoc. from renting short, they simply will NOT rent, as they keep their homes for summer use for themselves and relatives. Now, in Omaha that might be different, maybe Oracle week only applies, but there's no simple answer.

My dads friend had problems with squatter in the 80s in california.turns out my dad's friend was the mechanic used by a local hells angels MC AND HE ASKED for a favor in trade of free work for the head of the chapters motorcycle. They sent 5 of their biggest guys to walk in the door and tell the people to leave its their place now. These people left but had trashed the place. Turned it into a meth head flop house. So the owner had them rounded up and put to work to repay for repairs and back rent. It really wasn't level by forcing the people to work but there were no tater laws back then. The guy just didn't want the cops involved. Now it seems squatters have more rights than the owners themselves.which is so wrong. Squatting in my opinion is breaking and entering and theft.
I would NEVER be a rental or short term rental property owner. It isn’t worth it anymore.

They're running a business, why shouldn't they get their money? Remember, every time you purchase something, someone is making money off of you. Ever buy a house or a car? After all is said and done, how much interest did the bank make off of you? Depending on the size of the loan, it could be 10s of thousands.
As someone who lives next door to a vacation rental, it amuses me that things like this happen. The owners don't care at all about the people who live around their rental but as soon as they suffer negative effects, they want immediate action. Hypocrites.

And does this man have a job? Can you apply a lien on his wages at his employer? Is is a legal resident? Or an illegal immigrant? Can he be deported? For cases like this there should be court fast tracking. Some of them are really cut and dry. You need to punish the offenders quickly or they'll just keep doing it. The longer you let the crime go on, the more money the squatter owes, that they're not going to be paying back.
Perhaps you should make a country wide 'registry' of known offenders so that folks doing a background check of a tenant can quickly have a place to go to in order to validate if they are going to be facing a problem or not.

A couple of years ago I saw this documentary about living in Russia rental property’s where very cheap new condo’s 3 bedroom had everything like in the United States. Anyways they showed this landlord having problems with an un paying tenants They didn’t pay rent for 3 months so the owner called people that would come out and by and remove the tenants out to the street they also move all of there things out to the sidewalk and it’s DONE. The documentary said there’s NO court’s renters protection if they don’t have the money they should be kicked out! This how it used to be in the United States in the 1900 to 1960. That’s when the government got soft. The government always takes the side of the none paying tenants!
I’m a landlord, traditional rentals. I understand the need for courts to intervene in evictions. It’s your home you want to make sure it’s being done properly.
Unfortunately some states use this to saddle homeowners with the responsibility of becoming homeless shelters. You wouldn’t want to be evicted from your rental unjustly right?
Here in FL for example I can have you out in 14-21 days. And about $3500. Sucks yes but better than 8 months of legal purgatory.

Who other than criminals do squatters rights protect? This isn't the 1700s or 1800s anymore. There aren't large swaths of uninhabited land in this country. All land is owned. We legitimately need to get rid of squatters rights.
