    A relative (by marriage) drove by his grandmother's house and found a British family living in the house. He spoke with the couple and was told they had bought the house. So he said "no you didn't, because I'm one of the owners and I didn't authorize the sale." Grandmother had died receny and one of the cousins sold the house without probate. Case went to court. The British couple had to vacate the house, the cousin, who had sold the house, had to refund the British couple. The house remains off market and occupied by the great granddaughter as designated in grandmother's will.

    Veronica... You are so thorough! I have wanted to look into an ocean front property or something very close for myself for over a year, my Sister found you. I have seen a few of your videos and they are super helpful. I think a buyers dream is to find someone like you to help oneself through the process and appreciate your willingness to help.     Exactly right on agents! Some builders ask 50% if the condo is in the process of construction. ..paid over the time it is under construction. Always speak to the agent before looking at any or considering any property. You CANNOT get a buyer's agent in Portugal if you sign the contract first. How much did you pay your attorney to close the purchase of your condo? You said there is no title? What shows ownership besides being registered or listed with the city government?

      The deed should be under your name and put in your name when you sign. The standard price for an attorney is about 1 percent of the purchase price. Well worth the investigation.

    This is an incredible video Veronica. I made a trip there in May and it was crazy with the real estate scene.I had inquired online About various properties and then they captured me and said I was their client.
    Then they won’t let you go with the buyers agent if you just inquired. I get to choose who do I work with not them decide I’m their client.
    I was told that you need different agents because they only work their own inventory. There was no MLS, you are completely correct that you cannot see what it sold for. We are stabbing in the dark.
    The fact that you have a software program that gives you that information is a gold mine.

      You've hit the nail on the head Janis. NEVER inquire about a property prior to engaging your One and Only Agent. The good agents will work together and those who don't then you don't want to support. Many times the same property is listed by up to 30 agents (can you believe it, it's crazy). So when my fabulous agents see a property which will be a fit for you they log into the system to see all the agents who have it listed (you can't only sell your own it isn't the ethical thing to do) we pick the agent who is the best and most ethical agent in town to work with. Never go direct to the listing agent or you have two things happen 1. to your point they log you and now you are stuck with them, 2. you lose the opportunity to have a good agent work for you (a good agent will ask if you have worked with another agent and won't work with you if you have). This is because it's a waste of their time if you're contacting agents all over town (shows that you are not loyal and why should they waste time and money on you if you're just going to go to the next property and agent) and you get a bad name around town so none of the good agents will return your calls or emails. The best way to have the best agent is to get a referal (from me if you want the East Algarve) and then to stay loyal. They will take great care of you.

      @@elizabeth4914 it's just the culture of real estate here, it will change in time and we will eventually have an MLS type of group here soon...working on it. Ethics and we can brand the groups so you know you're working with the highest quality and experienced agents.

      I know, it can be a lot. They just need more protections in place like we are used to. But it works well with my little checklist of survey, pulling permits, checking finances, attorney (personal not the agency) writing the cpcv, etc. my people have been protected. It’s copying the model I’m used to from CA and plugging in missing pieces and it’s streamlined. Attorney and agent have the most time consuming jobs but it protects the clients. People here don’t even think of ch coming the homeowners association funds for proper operating capital and no debt before they buy. We are so protected in CA that people assume every country is the same.

      @@AmericanInPortugal I need to be 55 for full pension. So just under 3.5 years to go. I've never been to Europe but I do my research before making big decisions. Portugal seems like the place to be. I do know a lot of Brazilian Portuguese since I've been there about 14 times (again this December until February). I'm definitely not a Canadian winter kind of guy. I'll probably plan a trip to Portugal next year though.

    I agree however, there are several other prominent CZcamsrs in Portugal, stating that seller agents won’t even acknowledge buyer agents. They say it is due to the sheer number of people looking for a place versus how many are available. The agents do not want to share their commissions. And one more note here in the Midwest, US, very few people use a buyers agent.

      We have a program which works great, also we purchase a program which lists every agent who lists the property so we can pick the ones who work best with Americans. The program is a big success so far. We have a system just like the states and pick only the agents who are the most reputable and responsive. The ones I use understand that they are not "sharing" commission but earning their "commission" standard here is 5% so 2.5 to the listing agent and 2.5 to the agent with the buyer. I try to avoid dual agency when possible.

    I just want to say kudos to you for trying to create an MLS program and some integrity in the whole process. I so appreciate everything that you shared. We definitely will want to have a consultation after we arrive. We are renting a place in Tavira for six months or less if we find the right place to buy.
    Your attorney sounds like the right one for us for our immigration situation. My husband has an EU passport and I will have to get a residence card through him or some so family unification. I saw on one of your videos that he helped with that process and went with you to the immigration office or camera. So we definitely are interested in hiring your attorney for that.
    I also want to say that you light up the screen. It’s amazing really. I watch many CZcams videos about Portugal but I have to say you radiate more than anyone I have seen on CZcams. This would be a new good career for you😉
    I know you want to retire and so do I but I also see that you are providing a good service for ex-pats in Portugal. You called it the wild west and I agree. I think you should be interviewed by the other CZcamsrs with this specific Contant in mind. Just a suggestion.

We are thinking about settling in the central coastal or northern costal regions, roughly from Figueira da Foz up to Viana do Castelo (but are interested in what a local expert would recommend given our wants, etc.). We understand you have a good community of reputable folks in the Algarve area...do you know reputable buyer-realtors, attorneys, surveyors, etc. in the north coast or central coast areas?       I have resources all over the place but it's best you know exactly where you want to live before we engage them. Huge difference between real estate professionals and tour guides...I don't even give out my agent information until I've confirmed that the client wants to live in the area and has been vetted. There are just too many people who want to move here (from all over the world not just America) so we maintain the best service by forwarding only the clients who are ready today. Other than that I offer consulting services hourly just to review wants and needs and expectations.

    Are there areas in the Algarve where you dont have any buyers and listing agents you would recommend? I ask because im not certain of where we want to land. Can you do the same with rental agents? Applying for D7 , need a year lease first.
    Sounds really dodgy in Pt to work in r e. And to go through the buying process .
    I was a realtor in California for a long time. So I understand the drill here. So glad to know we have trusted person as you for guidance and you have done the research for us finding ethical agents. TY

    Do you know if Portuguese contracts have any conditions on appraised value? I know A lender I briefly spoke to from Portugal mentioned that they require an appraisal on homes. I just wondered if there are any else if it doesn't appraise?

    Hello from SoCal:) We have invested in a property in Tavira that is being renovation. Should be completed next month. Wondering what your thoughts would be on short term vs long term rental (its two one bedroom apartments). Not even sure how to get the AL license needed for short terms. Also, we may considering selling due to potential market conditions. Do you have recommendations for an agent in the Tavira area? Thank you for all your help and content!       Hello Landon. Email me privately at info@americaninportugal.com. The AL licensing changed this year so I hope your agent and attorney explained that. If it’s a residential building with common areas then you can not have short term (air bnb etc rentals). I believe you should always invest for the long term not the short term as market cycles for real estate are generally 10 year cycles.

    I recently discovered your channel and I'm really enjoying it. I have a complex question, and I understand that you're not a specialist in Portuguese tax law. However, suppose I relocate to Portugal and then decide to sell my main residence in the U.S. Would I be subject to tax in Portugal for that sale? I'm concerned that I might be. As you may be aware, the sale of a primary home in the U.S. is not taxed. My spouse and I are considering living in Portugal for a year before selling, just to ensure it's the right fit for us.

      Email me at info@americaninportugal.com. I don't give tax advice but don't become a resident here before selling your property there. There can be capital gains taxes on the sale there. Try selling now with a rent back provision so you don't have to move multiple times, but of course only if you are sure of your move. Again email me and to everyone make sure to talk to your home country CPA and one in Portugal to make a solid plan BEFORE becoming a resident :) Great and important question. And the laws keep changing.

      @@AmericanInPortugal I appreciate your message. Although I'm not planning to retire for another half-decade, it's important to note that many assumptions don't hold true in Europe. For instance, even straightforward matters like withdrawals from a Roth IRA could be subject to taxation in Portugal, as per what I've heard. Therefore, it might be advisable to withdraw all funds from the IRA while still residing in the USA. Do you agree with this strategy?

    The housing bubble in the USA has burst in many areas and Europe is facing a castrophic economic decline with no end in sight. Caveat emptor is important for anyone buying during this collapse from the Portugal RE bubble.

      Yes…still planning my move to Portugal in 2023.. Have my tax Id and having multi citizen ship with Irish passport by marriage am all set. Chaotic times globally but Portugal is the best spot to hunker down all things considered…in my opinion. Thanks for all your great content!!

      Had a medical practice in Ca in the past as well as a Ca real estate lic.I never used and have seen things turn in boom times in Northern Ca go from people camping out in line in front the sales office…to collapse of the market and blocks of unfinished footings…all in the space of 12 months

    Great info! You must be from California. I have purchased and houses in California, Arizona, and North Carolina. Purchasing a home in North Carolina sounds a lot like Portugal - a very different process than in the west. Awful experience, very unethical realtors and practices - would never be allowed in California or Arizona. Thank you again!!!

      Ahhh yes I’m licensed in CA and I wasn’t aware that it was bad in N. Carolina. I’m sorry you’ve had bad experiences. You can write to their board and remember to use a Realtor nos just an agent as they have a higher level of requirements to be a “Realtor”. If you have a complaint you can write to their licensing board, association and if they’re a Realtor you can files a complaint with the Realtor Association (local, state and national).

      I haven't made a guide yet but it's a good idea. The problem with anything printed is that people use it exactly as it is printed and the reality is that every transaction is different. It's why I recommend: first a consultation with me then using my recommended attorney, real estate agents and financial experts.

      It depends on where you want to live and your own personal situation. Portugal used to have lots of properties in the 100k range but many of those are inland now. Financing is different for different situations.

    Thank you so much for your help for information. We're considering moving to Madeira island and I definitely had concerned about Realtors and buying homes. I've been a licensed real estate agent for over 20 years in three states so I understand the difficulty. If you have any Madeira contacts I would love to hear them.

    You mentioned 10% down. We have heard that before, but also We have heard 30% is required down for foreigners. Is it 10 or 30%? Thanks

      It’s not a 10 percent “down” it’s a deposit when you write the CPCV (purchase contract). Mortgages are an entirely different discussion. It would take an entire video on mortgages. I can do this in the future.

    I found a house which in the past had actually belonged to a friend of mine. The house had been updated and I wanted to buy it. The agent in Albufeira actually told me it was easy, his agency had an attorney, a financial officer, and even worked with a company I could use, instead of a bank, and save 10% on the exchange rate. He also wanted me to sign a blank offer form and he would write in the information later. I refused. The exchange company he recomended was based in London and doesn't do business in the USA where I live... he didn't know of anyone doing inspections before purchasing...

      It is unfortunate but there are people out there who just want to take your money. Some online scams can be perpetuated by people who are not even in the country. The internet has made some things so much easier but other things need serious vetting and local professionals.

    Veronica, I have been following from west to east across the Algarve the videos made by Nick Robinson (AlgarveAddict). I first encountered you in his video on Vila Real de San Antonio. As part of my continuing research of the Algarve I rewatched that video today and thanks to the God of Algorithms I was led to your other videos. I have just finished watching this immensely informative talk in which you address concerns which up to now were unaddressed in the other videos I’ve seen: Is there buyer’s agency? Who represents whom? Do buyers have homes inspected prior to purchase? Who handles escrow? Is the Earnest Money put down? How is a title transferred? And finally, how does one go about even choosing an agent? Not knowing the answers to these questions or even where to go to find the answers has shaken my confidence as I approach a decision whether or not to relocate to the Algarve. Thanks to your video I have enough clarity to proceed to the next step which is a 2-month dive into Algarve residency, the month of this coming September in Portimaõ and the month of October in Tavira which, along with Vila Real de SA, I have identified as my areas of primary interest. While staying in Tavira I intend to visit Vila Real for an in-person look. I would love to sit down with you at that time to discuss my relocation timeframe and strategy. (There could be a free cup of coffee in it for you - or, if things really click, a glass of wine!) Nick Robinson speaks in his videos about referring people to real estate agents he knows and trusts. I’m not an agent but I have a process to match as closely as possible what we are used to in the states. It’s will help protect you. Just referring isn’t enough, I can coach and pony you the resources you need like your own attorney, a survey and other important pieces of the puzzle. Most agents here don’t do these steps and it’s new to them when I add it in but I have amazing people who can help.

    Portuguese and Brasilian real estate agents are the MOST DISHONEST in the world
    They have NO idea what MLS is. If they were smart they'd share ALL of their listings with all the other agents in town and make a lot more sales. But they hold their listings close to their chest.
    I had the idea to start up a MLS system here in Brasil

      In fact if they had 50 other brokers showing their listings, they'd sell 3x more in volume. Selfish thinking.

      I always say what is half of nothing? It’s a dis service to the sellers of their property as they won’t get as many showings and the people who would buy their home and pay top dollar may never see it. If the right buyers don’t see it then it sits on the market and doesn’t sell or they are forced to drop the price. It’s greedy and shameful.
