  • THE HAGUE - The International Court of Justice (ICJ) holds public hearings in the case South Africa v. Israel - Oral argument of South Africa
    The UN’s top Court today (16 May) heard a new request from South Africa to issue more constraints on Israeli military action in the Gaza strip.
    South Africa's Ambassador to the Netherlands Vusimuzi Madonsela, delivered the reading of the concluding submissions of South Africa.
    He said, “As a matter of extreme urgency, South Africa as a State party to the Convention on the Prevention and Punishment of the Crime of Genocide, respectfully request the Court to indicate the following provisional measures, the text of which has been amended to reflect the ever-increasing gravity of the situation.”
    Ambassador Madonsela continued, “South Africa respectfully request the Court to order the State of Israel as a State party to the Genocide Convention, and as a party to these proceedings, to one - immediately and further to its obligations under the Court's previous orders of 26th January 2024 and 28th March 2024, cease its military operations in the Gaza Strip, including in Rafah government, and withdraw from the Rafah crossing and immediately, totally and unconditionally withdraw Israeli army from the entirety of the Gaza Strip.”
    He added, “Two - immediately and further to its obligations under the provisional Measure four of the Court's 26th January 2024 order and provisional measures 2a and 2b of the Court's decision of March 2024. Take all effective measures to ensure and facilitate the unimpeded access to Gaza of United Nations and other officials engaged in the provision of humanitarian aid and assistance to the population of Gaza, as well as fact-finding missions, internationally mandated bodies and officials, investigators and journalists in order to access and record conditions on the ground in Gaza, and enable the effective preservation and detention of evidence, and ensure that its military does not act to prevent such access, provision, preservation or detention.”
    “Three - Submit an open report to the Court: A - on all measures taken to give effect to these provisional measures within one week, as from the date of this order; and B - on all measures taken to give effect to all previous provisional measures indicated by the court within one month, as from the date of this order,” the South African Ambassador concluded.
    Israel will respond on Friday at the Hague.
    The hearing came after the request for the indication/modification of provisional measures submitted by South Africa last week.
    The International Court of Justice (ICJ), the principal judicial organ of the United Nations, holds public hearings on the request for the indication of provisional measures and the modification of provisional measures previously prescribed by the Court submitted by South Africa on 10 May 2024 in the case concerning Application of the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip (South Africa v. Israel) on 16 and 17 May 2024, at the Peace Palace in The Hague, the seat of the Court. Session held under the presidency of Judge Nawaf Salam, President of the Court.

    I am 61 years old, my parents lived through the sordid period including the genocide of the Jews in Europe. I did not believe I would experience this in my lifetime and my parents are no longer here to see the pattern reproduced in this place.. Thank you Nadeli Pandor for your tenacity, the UN must absolutely send peacekeepers to save those who can still be saved from this monster who has absolutely nothing of a prophet. Yesterday I saw a baby's face completely torn apart, disfigured, I can't believe we can see this in 2024!! I won't get used to it, I don't want to get used to it... Stop this monster.. 😔😔😭😭

There’s also a background issue in play too, and that’s the ongoing apartheid of the last 70 years. I’m not condoning Oct 7, but it didn’t happen in a vacuum. It seems to reflect a sort of desperation. Do you believe the Palestinians should just accept apartheid? What do you see as the solution?

    In her book, "Next Year in Jerusalem," Daphna Golan-Agnon asserts, "I refuse. I refuse to believe that it is acceptable to imprison an entire nation [Palestine] in the name of our security...I refuse to believe that the only choice is force." The ICJ has asked Israel to enact provisional measure to stop the ongoing genocide. If Israel continues to breach the binding resolution of the court and the UN Security Council, those who use force to colonize Palestine and incite genocide should be arrested. Canada needs to stop weaponizing the use of force against students protesting this war on college campuses and instead, weaponize justice and international morality that targets the Israeli agents of genocide.     In fulfilling South Africa’s international obligation towards the Southern African Development Community (SADC) mission to support the Democratic Republic of Congo (DRC), President Cyril Ramaphosa ordered the employment of 2900 members of the South African National Defence Force to assist in the fight against illegal armed groups in the Eastern DRC.The employment will cover the period from 15 December 2023 to 15 December 2024 and it was authorised in accordance with the provisions of section 201(2) (c) of the Constitution of the Republic of South African.The budgeted expenditure to be incurred for the employment amounts to just over R2 billion. This expenditure will not impact provisions for the defence force’s regular maintenance and emergency repairs

      What about the Palestinian continous relentless bombing of the border region that has been going on since 1947? What about the Israeli casualties since 1947 resulting from their attacks ? Nekba? Jews were also displaced in 1947. Jews had to evacuate, leaving their homes behind and go to Israel. Muslims were alllowed to stay in Israel and become Israeli citizens.

    How is it that people can see exactly what is going in Gaza from numerous angles practically live and somehow they STILL refuse to even acknowledge that the response was disproportional let alone actively genocidal. As was said in this argument self defense is justifiable BUT there has to be limits to it. As an American I know there is real resistance to the idea that self defense has limits, here people think a disproportional response to something minor constitutes self defense(like flat out shooting someone for trespassing for example). Israel knows the American government won't check it's actions because Israel is doing exactly what America has done and still is.

    We are all in need of renewal. One of the many benefits of being in therapy is excavating fears, anxiety and resentments that are holding us back, trapped in a past that can never be changed. We cannot become freer and lighter in the present while dragging around resentments from the past. Please let them go - for your sake, no one else’s. Resentments make us physically and emotionally vulnerable. It’s an old tired pattern and now is a good time to become renewed, to become lighter and healthier. Give up those dark thoughts. Be born again as a humble and happy person who is free of the pain of the past.
