It seems like the homeowner here is also a criminal. They mentioned that his renting out that part of the home was not permitted in the township. So he illegally tried to rent out that part of his house and then he ALSO did an unofficial, verbal agreement with her for tenancy, which is ill-advised. And as far as people in foreclosure, it can also take years for a bank to be able to put the owner on the streets. Quite complicated.
There are countless ways to remove someone - willingly or unwillingly - from your property mostly legally. Normally you can't cut off utilities even if they are not paying rent from what I know. However I can think of so many ways to get them to leave by their own decision that I won't mention here. I'm sure most people will get very creative in a situation like this.

There’s a way around to make them leave legally. Someone else other than the homeowner (close friend, family member) can break in and squat in the house at the same time as the other squatter. All they need is a legal paper from the homeowner that they are new renters. Some homeowner did this and it worked. Squatters ran out because the “new squatter/renter” started doing a disturbance in the house and making life miserable for the original squatter. Renters/squatters have more rights than owner. Fight squatter with squatter.
You are right. This works. The son moved into his mother's house along with the squatters and started harassing them. They moved out. I'd steal their stuff the minute they left the house and change the locks. Moving truck, all gone to Goodwill. They come home, its locked with a new tenant, preferably holding a shotg*un.

He did not (still doesn't) have a LA County Planning Department short term rental certification, therefore he violated the law first and does not have any legal ground to evict. @@noble604 If an individual is living in the property and has been identified as a squatter, you cannot knowingly turn utilities off. There may be some situations where this is permissible, but it's very complicated and depends largely on local landlord-tenant laws. However, I'd suggest the owner just not pay the utilities and that's not knowingly turning it off. It's not accommodating the criminal. Squatters have more rights than homeowners. If they're at said place longer than 10 years, they can claim it as their own. Whoever allowed that rule come to be, should be fired as a lawmaker....and that law should be abolished.
The story was a bit hard to follow, but it seems like the squatter is exploiting some kind of technicality related to the space not being permitted. There's probably a lot more to this story than what's in this video.

The people who make the news "squatting" are mainly just immoral people leeching off society in any way they can. The problem in CA is that they have too many loopholes such as taking advantage of honest laws written to protect tenants but which laws are too loosely written, leading to loopholes. Had a rental in CA in a rural area. Rented to two young people who turned out to be swindlers. They stopped paying so we started the month's long process to evict. Court date came and they told the judge WE turned off the water. It was on a well with a switch for the pump located in the house. All they did was turn off the switch (we don't even know if the water was actually ever turned off) We told the judge this but the judge just held his hand up and said we were harassing the tenants. Judge made us pay them. NEVER be a landlord in CA. The state always sides with the squatter.

If I'm the judge i would always side with the homeowner. If your name is not on the deed and the owner wants you out, I'll order an eviction, no appeals.
If you are judge, you don't get to pick sides. You'll make the decision according to what the legislation says. In landlord and tenant law, there is always a right to appeal which cannot be revoked.
I had a friend ask me to stay on my couch for 2 weeks so they can move out of state. She got comfortable and then the last day, she pitched to two more weeks and because I knew the law, I said no. We are no longer friends.
Our laws need some sort of reasonability clause. This is clearly not what the law was intended for, it's reasonable to kick her out and charge her for the damages regardless of what the law says.

You can not do that in my city/state either, not just in CA. You will be arrested. The only course is to go through the court system. Judge has to sign eviction notice within reasonable time to leave which can be extended by the tenant. Even then, once the eviction date expires, and the tenant hasn't left, then you would need a sheriff to come in after a valid court notice and at his convenience when the sheriff is available. This can take years if the tenant is smart and can get hearing after hearings rescheduled and other demands to the LL to provide documentation of everything. This is the American way.

Wait something doens't add up, AirBNB for SIX MONTHS!? That's your first problem there, because that's no longer classified as a short term rental in fact there's a reason why a lot of hotels have a maximum stay that you can be there.
Usually they just move in an elderly person or someone disabled. It takes a year, court costs, and usually a hefty bribe to get them out. It's been going on for years and grifters take full advantage.

When this happened to my aunt, we cut the power. They used flashlights and batteries. So, we cut the water and gas. They used bottled water and propane. Nothing worked. We finally wound up giving drug addicts money to bang on the doors every hour after 1am until 6am. That worked. Because the guy had a job that started at 8am. He became sleep deprived and exhausted. Then he found another place to squat.

Ha ha ha! Good one. I had a boa constrictor. I used to put him out in the small lemon tree for exercise. He slithered down one day and went under my neighbors fence into his garage. I asked if I could search the garage for my snake and he refused. It was cold so I was very worried about him. For one week that POS would not let me search for my snake. So I told him that the snake would get into his toilet system and when he sat on it would bite his a*ss. This worried him sick so he let me into his garage finally and I found my snake. So relieved! People are deathly afraid of snakes. All you have to do is say your pet got loose and likes this room.
And this goes on all the time. There are people who are expert at renting and not paying rent and then staying as long as they can before they get kicked out and go search for the next victim. Sadly, they usually trash the place before they leave.
What others have done is they send out someone they trust to squat on the squatter. When the squatter leaves, the trusted person enters the residence, changes the locks and puts the squatters stuff on the curve. When the squatter calls the police the trusted person shows them a signed lease agreement. Police can’t do anything then.
This is another reason I moved far away from California. My friend/neighbor also had this happen to him at his Laguna Beach house on the water. Had a rental agreement in place and the tenant stopped paying rent. This went on for two years and my friend couldnt do anything about it. His only option was to sell his beach front home. California is such a shit show.
Exactly Arizona has a 3 day rule. My friend owns many units. He serves all his 3 day notices with 3 or 4 of us all strapped. Files down at the courthouse- 3 days later , if they are still there. A call to the sheriff- and they show up and take them out however they want to go.
Just get a bunch of friends and force her out. Thats how it has to be done. Once you force the squatter out, it doesnt matter. Break in and retake the compound.
Did the parents of this Harvard-educated elite write her out of the will? Her harassment of her former housemate to the point that he abandoned his home in Oakland tells me she is malignant. While her current address is known he should check with an attorney to see if he has a case against her. Flip the script on her if possible. The idea that LA's rules would permit her to stay because it isn't a legal unit is mind-boggling. If it isn't a legal unit, cancel the contract, make him refund the rent, and evict her. Or fine her what the rent would be and fine him the rent he collected and put it into affordable housing. Neither one of them should profit from this. My takeaway is only to build an ADU for your parents or disabled child. California rental laws are insane. They will make the housing crisis worse.
I live in Texas . One of our neighbors had someone rent their mobile home and wouldn’t pay rent. He knocked on the door one day and told them he was going to rent out 2 bedrooms in the house and move them in . They left quickly 😂😂

In Cali You can’t let them stay past 30 days. Get them out by day 28. When I negotiate contracts with buyers renting back from sellers. I always advise to only allow 28 days. Day 30 there a tenant. Hotels and air bnb owners make them check out for a day or 2 and then let them back after a 1day break. Reset. No long term staycation.

The people who make the news "squatting" are mainly just immoral people leeching off society in any way they can. The problem in CA is that they have too many loopholes such as taking advantage of honest laws written to protect tenants but which laws are too loosely written, leading to loopholes. This is part of the problem here because the fool of a homeowner initiated a loose unofficial lease beyond the scope of the AirBnB, giving the renter all sorts of freedoms they would not have had otherwise. If the tenant had merely stayed longer than their reservation with no agreement, they'd have been removed ages ago
My friend also has had a nightmare with a renter turned squatter. It's cost him over $20,000 in legal fees and all the lost rent money. Staying in someone's property when they've asked you to leave is no different than theft.
Had a rental in CA in a rural area. Rented to two young people who turned out to be swindlers. They stopped paying so we started the month's long process to evict. Court date came and they told the judge WE turned off the water. It was on a well with a switch for the pump located in the house. All they did was turn off the switch (we don't even know if the water was actually ever turned off) We told the judge this but the judge just held his hand up and said we were harassing the tenants. Judge made us pay them. NEVER be a landlord in CA. The state always sides with the squatter.

I had a friend ask me to stay on my couch for 2 weeks so they can move out of state. She got comfortable and then the last day, she pitched to two more weeks and because I knew the law, I said no. We are no longer friends.
Yup after a month they establish residency, she knew what she was doing. She was never your friend, trying to take advantage of your niceness.
Our laws need some sort of reasonability clause. This is clearly not what the law was intended for, it's reasonable to kick her out and charge her for the damages regardless of what the law says.

You can’t do that in California.
You can not do that in my city/state either, not just in CA. You will be arrested. The only course is to go through the court system. Judge has to sign eviction notice within reasonable time to leave which can be extended by the tenant. Even then, once the eviction date expires, and the tenant hasn't left, then you would need a sheriff to come in after a valid court notice and at his convenience when the sheriff is available. This can take years if the tenant is smart and can get hearing after hearings rescheduled and other demands to the LL to provide documentation of everything. This is the American way.

I am an Airbnb host. He built the guest house without the proper permits. He rented the guest house without the proper Certificate of Occupancy. He made a side deal with her after the Airbnb stay officially ended. She took advantage of his mistakes.

When this happened to my aunt, we cut the power. They used flashlights and batteries. So, we cut the water and gas. They used bottled water and propane. Nothing worked. We finally wound up giving drug addicts money to bang on the doors every hour after 1am until 6am. That worked. Because the guy had a job that started at 8am. He became sleep deprived and exhausted. Then he found another place to squat.

I asked if I could search the garage for my snake and he refused. It was cold so I was very worried about him. For one week that POS would not let me search for my snake. So I told him that the snake would get into his toilet system and when he sat on it would bite his a*ss. This worried him sick so he let me into his garage finally and I found my snake. So relieved! People are deathly afraid of snakes. All you have to do is say your pet got loose and likes this room.

And this goes on all the time. There are people who are expert at renting and not paying rent and then staying as long as they can before they get kicked out and go search for the next victim. Sadly, they usually trash the place before they leave.
What others have done is they send out someone they trust to squat on the squatter. When the squatter leaves, the trusted person enters the residence, changes the locks and puts the squatters stuff on the curve. When the squatter calls the police the trusted person shows them a signed lease agreement. Police can’t do anything then.
This is a state issue. If he had nads he'd kick the door in and remove her off HIS property. Which he has a right to do.

This is another reason I moved far away from California. My friend/neighbor also had this happen to him at his Laguna Beach house on the water. Had a rental agreement in place and the tenant stopped paying rent. This went on for two years and my friend couldnt do anything about it. His only option was to sell his beach front home. My friend owns many units. He serves all his 3 day notices with 3 or 4 of us all strapped.
Files down at the courthouse- 3 days later , if they are still there.
A call to the sheriff- and they show up and take them out however they want to go.

Did the parents of this Harvard-educated elite write her out of the will? Her harassment of her former housemate to the point that he abandoned his home in Oakland tells me she is malignant. While her current address is known he should check with an attorney to see if he has a case against her. Flip the script on her if possible. The idea that LA's rules would permit her to stay because it isn't a legal unit is mind-boggling. If it isn't a legal unit, cancel the contract, make him refund the rent, and evict her. Or fine her what the rent would be and fine him the rent he collected and put it into affordable housing. Neither one of them should profit from this. My takeaway is only to build an ADU for your parents or disabled child. California rental laws are insane. They will make the housing crisis worse.
I live in Texas . One of our neighbors had someone rent their mobile home and wouldn’t pay rent. He knocked on the door one day and told them he was going to rent out 2 bedrooms in the house and move them in . They left quickly 😂😂

I don't know why his lawyers haven't advised him to do this, you give her a notice to leave to make repairs on the guest house in order to get all the permits needed to bring it up to code, or tear it down, and start over with the correct permits. Apts do it all the time, they kick people out to fix, or bring things up to code. 🤷♀️ I would at least try that route. Beats having a loafer on your property.

In Cali You can’t let them stay past 30 days. Get them out by day 28. When I negotiate contracts with buyers renting back from sellers. I always advise to only allow 28 days. Day 30 there a tenant. Hotels and air bnb owners make them check out for a day or 2 and then let them back after a 1day break. Reset. No long term staycation.
When they sue for rent and utilities they should sue lost earnings from the air b&b.
