"have you identified everyone in the vehicle" all 50 states say they don't have to or have the right to since he's not in operation of the vehicle
He can ask. He can't extend the stop to identify. The passenger can say no as long as there's no reasonable articulable suspicion of a crime by the passenger. In this case, the woman yelled, "run Bryce!". When she took it upon herself to kick and assault the officer, I'm not sure that wouldn't then lead to ARS to identify. But before that assault and utterance, no.
They have the right to ask, you have the right to refuse identification. However, they do have the right in all 50 states to order you out of the car regardless of whether they are the driver or passenger. And you do have to comply with this or face obstruction/interference charge.
Beyond the Miranda Rights you are told upon arrest when they have the intent to question you, police aren't obligated to inform you of your rights and what you are allowed to refuse to comply with. Also, prior to an arrest, a police officer can ask you anything they want. Whether you answer or not is up to you. Only common case where you are legally required to answer a question in any legal proceeding is where you are the driver of the vehicle and they ask for identification. But you don't have to answer verbally, your license, registration, proof of insurance, etc will suffice.
They can only order you out for certain reasons
@@grahamlowe314 Pennsylvania vs Mimms describes that an Officer can order anyone out of a vehicle during a legal traffic stop. (aka, had a valid reason to stop you, even if they aren't telling you the reason) The only requirement is that it must be for officer safety. Which is vague and includes the example of the traffic on the road being a valid reason to pull people out of the car, which is a very low requirement for justifying it, essentially making it defacto law that you must exit the vehicle when told to. Any dissenting opinions on that ruling wasn't in relation to the exiting of the vehicle, but rather a frisk that took place afterwards, but as the court ruled in favor of the officer here, a pat down after exiting the vehicle isn't considered an infringement upon your liberties due to case law.
So no, not only for certain reasons, pretty much any reason that can be justified by "It was done for the safety of the officer" will be considered legal with the basis of case law for the defense of the agency. Which traffic passing by is good enough of a reason to justify it, per the supreme court.
As for a passenger specifically, not just the driver, Maryland vs Wilson holds that even passengers are subject to the ruling of Pennsylvania vs Mimms.
@@grahamlowe314"officer safety" to frisk you for weapons will always be their reason.

Agreed, but doesn't mean other communities (mid or high) shouldn't be policed for crime. Dirtbags live in every wealth bracket. Nolan Learned the hard way just because it's not low income doesn't mean you don't be ready for the worst like his Supervisor said.

I can't believe he would suggest crimes happen more in parts of the city where they statistically happen more.
There's a lot of people in this comment section that think asking for ID of the passenger is a rights violation..... asking for an ID is not a rights violation in any circumstance whatsoever. It is the forcing to identify that is the violation. Cops can ask you for whatever they want, you don't have to comply for things that would be a violation of rights.
He said he NEEDED his information. That's not asking.
@@sting582 That is asking when many people say need as a request.
@@MYSTERYBLACKROSE No, saying you need something is not the same as asking for something. "Hey, can I get your info?" Is asking. Where's the question mark in "I need your information."?
@@sting582 It's still a question that they can deny. But if you are driving and tou have been pulled over for something then you do need to five them ID.

well statistically…
I mean... most crimes ARE commited by people from low income neighborhoods. For pretty obvious reasons. They have less money and more needs.
And nature selected for low impulse control on their original lands...
Just because you're poor doesn't mean you're a criminal by default.
Just because you're rich doesn't mean you're automatically, inherently more virtuous either.
@@Briselance yeah, sure, not mutually exclusive.
@@Briselance He's just explaining why it's more common in low income places. They have less to lose and more to gain by going to prison/jail. Additionally, low income houses are less likely to have security systems, making them easier to rob.
Literally had no lawful reason to identify the passenger.
When the police stopped them for a routine traffic stop that gives them probable cause and you can see why 🙄

You can't trust old people just because they're old... here in the Airport there was an elderly woman that asked for help with her bags by Staff to go out of arrivals from airside to landside.
She did this a few times, with Customs ignoring her as she was 'escorted' by some Airport employee.
It took a new Customs fella to stop her to discover she was smuggling stuff through.
All Airport employees, with exception for those working with special needs, are now prohibited from touching a passenger's bag going through into arrivals.

The writers of this show do not know it's unlawful to ask for an ID without probable cause .
This show is the last place to look for police realism.
As the people of this show know, better than you, a cop can ask whatever the hell they want. It is unlawful to force you to show ID.
It’s unlawful to demand ID without probable cause. A police officer can request to see an ID really whenever they want to.
oh no they know, they're trying to normalize it
Police can ask for your ID whenever they want. But you're not required to give it to them. It's only unlawful to demand or forcefully take an ID under threat of arrest for no reason. I guess the creators of the show arent the ones in the wrong here bud.
