  • “It was a careless mistake”.
Nadhim Zahawi, who has just stepped down as a Tory MP and was sacked as Conservative Party chair in 2023 over failing to declare an HMRC investigation into his tax affairs, has admitted his “mistake” cost him £5m.

Zahawi was investigated by HMRC, the National Crime Agency and the Serious Fraud Office without any party encouragement and was found to have deliberately avoided paying £3.2 million of tax and was penalised 30% of the amount as well as having to pay the tax owed. Further clarification of Zahawi's tax misinformation:
'Careless' doesn't mean what most people think, when used in tax matters.
To most of us, careless means bumping our shin on the coffee table, putting a hot cup on a polished surface.
    Whoops! How careless!
In tax terms, 'careless' means a failure to take the expected level of care, but without leaving enough clues that we are confident we could defend a higher penalty for deliberate actions, if it went to tribunal.
If Zahawi thought his shell company arrangement was lawful, he could and should have disclosed it to HMRC, and asked for advice.
Of course, if he had asked, he would have been told that's not lawful, so he didn't ask, and is using the 'Nobody told me I couldn't' defence.

Compare to the plight of unpaid carers who inadvertently go a few quid over the threshold and then have their lives destroyed and are viewed as criminals. It's OK to make mistakes if you're rich and powerful.
