உரிமையியல் நடைமுறைச் சட்டம் கட்டளை 21 விதி 84 ன்படி நீதிமன்ற ஏலத்தில் கலந்து கொண்டு சொத்தை ஏலம் எடுத்தவர் ( Acution Purchaser) உடனடியாக 25% தொகையை நீதிமன்றத்தில் டெபாசிட் செய்ய வேண்டும். விதி 85 ன்படி பாக்கி ஏலத் தொகை மற்றும் முத்திரைத் தாள் தொகையை 15 நாட்களுக்குள் நீதிமன்றத்தில் டெபாசிட் செய்ய வேண்டும். விதி 86 ன்படி ஏலதாரர் விதிமுறைகளை மீறினால் அவர் டெபாசிட்டை இழக்க நேரிடும். சொத்து மீண்டும் ஏலம் விடப்பட வேண்டும்.
இந்த கட்டளை 21 விதிகள் 84, 85, 86 ஆகியவை கட்டாயமாக பின்பற்றப்பட வேண்டிய நடைமுறைகள் ஆகும். ஏல விற்பனைத் தொகையை செலுத்த என்ன நடைமுறைகள் பின்பற்றப்பட வேண்டுமோ அதே விதிமுறைகள் முத்திரைத் தாள் வைப்பீடுக்கும் பொருந்தும்.
கட்டளை 21 விதி 85 ல் கூறப்பட்டுள்ள விதிமுறைகளை ஏலதாரர் குறிப்பிட்ட காலக்கெடுவுக்குள் நிறைவேற்றவில்லை என்றால் அந்த ஏலம் தானாகவே செல்லாதாகிவிடும். ஏலதாரர் அனைத்து உரிமைகளையும் இழந்து விடுவார் என்று இந்த தீர்ப்பில் கூறப்பட்டுள்ளது.

Your analysation of judgements ate praiaeworthy and wish you continue your journey..Then this 25% of auction amt shd be deposited immediately means on the auction date
itself or the next day..Because, we dont know the exact amount of auction,then the court may not accept cash..In such a situation to take DD or something like
that we need at least one day.Is it not?

Sir please reply நான் schwing stter நிறுவனத்தில் team lease என்ற hr நிறுவனம் மூலம் இனைந்து பணியாற்றி வருகிறேன். கடந்த மே மாதம் 21 கம்பெனியில் விபத்து ஒன்றில் கால் மூட்டு ஜவ்வு கிழிந்து விட்டது, சவீதா மருத்துவமனையில் மருத்துவம் பார்த்தது நிர்வாகம். மூன்று மாதம் ஓய்வு தந்துள்ளது மருத்துவமனை.
தற்போது ஒரு மாதம் முடிந்தத நிலையில் நிர்வாகம் சம்பளம் தர மறுக்கிறது, என்ன செய்வது?
