- In the discussion series by Karwan e Mohabbat on the state of the Indian Republic, this week we ask - How Free and Fair are India's Elections Today?
Here peace worker and writer Harsh Mander meets with one of India’s leading public interest litigators Prashant Bhushan, and one of the country’s most trusted right to information activists Anjali Bhardwaj.
India’s elections have never been perfect. But until now, the overall fairness of the elections was not in serious doubt. Today for the first time, many voices of doubt and scepticism - sometimes covert, sometimes open - are being heard about whether India’s elections continue to be fair. The discussion reflects on to what extent these doubts are justified.
Both Bhushan and Bhardwaj speak of how openly partisan the process of appointment of election commissioners has become, and the ways in which their conduct fails to inspire confidence about their fairness and impartiality. The commission is doing nothing to punish or restrain both the flood of untruths and the openly communal statements made by senior leaders.
They speak also with concern about the integrity of electoral rolls. There are complaints and worries about the exclusion of vulnerable populations such as Dalits, Adivasis and Muslims. And that this raises doubts that this exclusion is deliberate by the executive to exclude sections of voters who are likely to vote against the ruling party.
And on the question of the EVMs, while it is difficult to confirm that these are tampered with, Bhushan underlines that there can be no doubt about the possibility of their tampering.
Democracy is admittedly more than universal adult franchise. But if the foundation of fair elections are in reasonable doubt, the discussants underline the enormity of the dangers this poses to the survival of Indian democracy. This is why this discussion is essential viewing for all those who care about the health of democracy in India.

Interesting drawing room discussion between the lawyer and two activists. I took part too and was the silent listener. I admire Harsh Mander for his compassion and work with the poor and downtrodden, Anjali Bhardwaj for her unrelenting search for the truth, and Prashant Bhushan lawyer and activist whose interventions and arguments in Court I love to watch. I have forwarded this to family and friends who I'm sure will appreciate this as much as I did
Unfortunately, even if the current government goes, it will take many years to set all the wrong of this government right.

Prashant is forthright in expressing his opinions and Anjali is unstoppable in her quest for the rights of the citizens. Great show. Institutions are surrendered to the government. EC is subservient to the government. This government has corrupted all the major institutions of the government, whose independence is paramount for the welfare of the country.

Remember that this is a country where election of Smt. Indira Gandhi was cancelled on the ground that sarees had been distributed during election campaign.

It couldn't get any worse, but it got even worse, far breaking minimum threshold of Free and Fair election. But upsetting thing is the judiciary, defined as a guardian angel of the Constituion, have recurrently gone on to ignore the issues related to this fundamental question, except for some rare occasions that too too late.

If election commissioner of India is working in favour of Modi in power then it is the duty of supreme court and the chief of Army to look into the matter seriously so that impartial election can be conducted in the nation

The only few ways in my opinion is to strengthen democracy is to make our counsellors, MLAs, MPs answerable to their respective constituency people. We should hold monthly meeting etc. Secondly we should elect a govt/MPs once not twice, even someone had done great work.
India is categorized as Flawed Democracy. That’s bec of all the reasons mentioned by Bhushan saab
I feel that the Election Commissioners should nor be given any other office after their term ends. This cooling-off period can be for, say FIVE YEARS

All polling agents must be educated about obtaining form 17c and then votes mentioned on them be cross verified with the actual votes polled and evm votes counted etc.

Free and fair elections in India is only an utopia. We do not have descency, discipline, desire, maturity for all that. Even before Independence Nehru i was implanted on Congress and India by Gandhi ji against the result of voting in the congress working committee.
Impersonation, not allowing people to reach polling place. Lòting ballot boxes, replacing ballot boxes, fire in the place of stalking ballot boxes has been our culture to which we proudly say we are Sanatani, vishwa guru and largest democracy in the world.
Earlier, " Godi Media " and now " Erectionless Commission of India ".

शुधारने कि तरिका पर बहस होना जरूरी।
यह चर्चा अच्छी है मगर अभी इसका कोई मतलब नहीं है। supreme court ने इस संबंध में दायर याचिका को चार साल तक लंबित रखा और फिर Justices Khanna and Dutta की बेंच ने चुनावों के बीच में ऐसा निर्णय दिया जिससे समस्या का कोई ठोस समाधान नहीं निकलता।
अगर देश में लोकतंत्र की आज ऐसी खस्ता हालत है तो उसके लिए spineless top level bureaucracy के अलावा Supreme Court भी बहुत हद तक जिम्मेदार है जिसने Ruling party की brute majority से डरकर समय पर और लोकतंत्र के हित में सही निर्णय नहीं दिए, जबकि Supreme Court को Indian Constitution ने full justice dispense करने के लिए enormous powers दे रखा है।
पिछली बार Emergency के समय भी Supreme Court ने ऐसे ही डर कर ADM Jabbalpur जैसा घटिया judgment ( except Hon'ble Justice H R Khanna ) दिया था। मगर इस बार तो High Courts, Lower courts सबका डर के मारे बुरा हाल है।
यह तो देश की आम जनता और चंद सम्मानित Activists , Advocates और Judges हैं जिनके दम पर लोकतंत्र यहां आज भी सांसें ले रहा है, वरना Courts और Institutions ने in general तो विगत दस वर्षो में लोकतंत्र को बचाने में शायद ही कभी अपनी रीढ सीधी रखी हो। सचमुच बहुत अफसोस की बात है।
