Shiv Sena Verdict: Supreme Court Refuses to Restore Uddhav Thackeray Govt

- In the matter pertaining to the Shiv Sena rift, the Supreme Court Constitution bench held that it cannot order the restoration of the Uddhav Thackeray government as he resigned without facing floor test. Since Thackeray voluntarily resigned, the Court held that the Governor was right in inviting Ekanth Shinde form the government with the support of BJP.

Well read out, just to the points as though scripts are straight out of the text of the verdict.
India spends whole year, every year just fighting elections. District election, Panchayat elections, state elections etc etc. Give us a break for god's sake. What happened to one country, one election manifesto? We spend all the time fighting elections and changing governments, this is not good.
Uddhav Thackrey resigned . True .At that time he was leader of the party.The judgement against him as giving up post of leading Shiv Sena is on the arguments . None of the argument was on the entire ShivSena and govt. being ousted with him or facing the floor test implies he resigned from party .None of the opposition parties challenged or resisted Shinde to leas the party. Now the floor test is to be conducted.
Isnt supreme Court itself here to be questioned for its 29july 2022 verdict to continue trust vote before defection subjudiced till 11th july 2022..and now supreme court itself saying that calling trust vote was illegal
The pertinent question is , without a split in the parent party , can the elected members in the assembly override the whip of the party and stand with opposition to defeat his own ruling party.? Court should have been emphatic in giving a verdict that no intraparty split in the legislature is valid unless the split in the party forum is effected.
Bench made remarks which has no practical effect on the ground. Udhav shiv sena will have to accept defeat.
There's no consequence to shinde faction.
For Delhi, union government will bring another law that will up turn today's sc judgement.
As long as there is no cadre for Delhi. They cannot do anything.
