Rajgopal, a land owner living in a village in Tamil Nadu wanted to sell out his agricultural land to pay the debt. But the sub-registrar office told him to get a NOC from the Tamil Nadu Waqf board because according to the government, the land of his village and a lot of other Hindu villages comes under the ownership of the waqf board.
Waqf board has some special legal rights only for Muslim society. According to section 85, if the waqf board promised their right on your property, you don't have any right to sue them in civil court, and your property will be transferred to them without any notice.
You have to file a lawsuit in their own Tribunal court. Along with this, the decision panel includes IAS, MLAs, and MPs of their own community. They order to enquire your property by the people of their very community under section 40.
Waqf board claim that they got the land of these Hindu villages as a donation in 1956, hence they own it. But being 1300 years old, who come donated this temple to the waqf board?
From 51000 ongoing cases, what came in front is that this board is trying to implement anarchy by disturbing the peacefully leaving societies. Similarly, the waqf board promises the ownership of around 8 Lacs hectare of land across the country.

the apex court observed that if the Waqf Act is struck down, it will only benefit the encroachers. The petition objected to certain provisions of the Waqf Act that allow only Muslims to be members of Waqf Boards.
The Waqf Act regulates Islamic religious and charity properties; the Waqf Board administers them.
“I feel pained that you can put your challenge down to religion,” said a bench headed by Justice KM Joseph. “We should go beyond that and certainly not bring religion as a ground to strike down the law.”
The Waqf Act, introduced in 1954, was enacted with the purpose of regulating and declaring Waqf properties. In 1995, the law was modified to allow formation of Waqf Boards in each state and Union territory comprising of members who are Muslims. Besides, the Act also provided for tribunals headed by a judicial officer drawn from the state service and two other members (not necessarily Muslims) who are to decide disputes related to Waqf properties. Why the land should be leased to the government? Please understand all the land or any property under the waqf isn't the property of the waqf board itself. Waqf board is just a regulating authority. There are many types of waqf properties ,depending on who will look after the waqf property. Information given in this video isn't complete. Nobody can claim someone's land in that manner. All the land records are there kept in every district headquarters dating back to pre independence. If property isn't waqf Nobody can claim it.
Infact, scores of waqf properties are being encroached , doesn't matter who the fraudsters are.

@@parlok it is body incorporated by law to register land which are donated by Muslim to build mosque, and all the properties doesn't go straight to waqf, it needs approval from government, that's why once government approved it. It can't be taken back
