The renter probably will not win a suit against the homeowner as they violated the agreement. But the guests can sue the homeowner unless there was a posted weight limit. It was the responsibility of the renter to keep to the guest limit but guests are not responsible for the host's mistake. Even a burglar can sue a property owner if they are injured as a result of a hazard in the home they broke into. The exception is if there are posted warnings.

I've lived in one of those houses. Always aware of the weight on the deck. Even 5 or 6 people might be too much for those decks, this is precisely why the homeowner had a guest limit. The idiot that threw the party and violated the guest limit rule is completely to blame.
The renter is to blame but the guests can sue the home owner but not the renter. The home owner can then sue the renter to compensate for the pay out to the guests. The insurance company will end up paying the guests but then they can sue the contractor who built the deck unless the deck is out of warranty. At which point the insurance company may have to eat the settlement because they should not have insured the home without a proper inspection of the deck. In construction, the failure point should always be five times the rated amount. If the deck was rated for 6 people then the failure point should have been 30 not 15. If the deck is old and rotted then the insurance company should not issue the policy to insure the home for liability. Of course all of this is assuming they had insurance which is a reasonable assumption if the house has a mortgage and most homes have mortgages. The lawyers are going to have a field day with this case all the way around.

If the homeowner has all the permits and the required maintenance was up-to-dated this is not their fault. Another example: Elevators also have a maximum weight/person limit. As soon as I saw the deck full of people, I said "too many". Even if the wood was getting old, they still overloaded the deck. Both were probably contributing factors.
The owner can now also sue for income losses on the rental as well as suing the person who held the party for the deck. The homeowner has a solid case all the way around.

The guest limit is likely to prevent parties like this one where a drunk guest can fall over the balcony. Signs posted, rental agreement says the same PLUS the homeowner calling to plead with them? The renter clearly is at fault. I’ve seen fully new structures collapse due to too much weight. The renter’s liability insurance is going to be the first one hit with all the claims
Unfortunately for the landlord, the jury probably won't be permitted to know of the existence of the contract or the 6 person limit imposed by the landlord due to that not being relevant to the guest's ability to sue the landlord for having an unsafe structure. The only thing that would save the landlord in such a case is a posted notice specifying a weight limit and the weight limit specified needs to be 1/5 the failure point. Since we know the failure point was 15 guests than there should have been a posted weight limit of 3 guests (x average weight of an adult which is 137 lbs) so the specified posted weight limit should have been nor more than about 411 lbs. Without that the landlord will lose in a lawsuit brought by guests. The landlord can than turn around and sue the renter but they may not win due the not having a specified weight limit posted.

The guest were invited to an event that was breaking the law as it was. Guest should get denied suing the home owner and make them sue the person who hosted the event. Imagine if they win money. California liability laws are rather straightforward and the specialty clauses apply to specific situations. The guest limit is likely to prevent parties like this one where a drunk guest can fall over the balcony. Signs posted, rental agreement says the same PLUS the homeowner calling to plead with them? The renter clearly is at fault. I’ve seen fully new structures collapse due to too much weight. The renter’s liability insurance is going to be the first one hit with all the claims

The only thing that would save the landlord in such a case is a posted notice specifying a weight limit and the weight limit specified needs to be 1/5 the failure point. Since we know the failure point was 15 guests than there should have been a posted weight limit of 3 guests (x average weight of an adult which is 137 lbs) so the specified posted weight limit should have been nor more than about 411 lbs. Without that the landlord will lose in a lawsuit brought by guests. The landlord can than turn around and sue the renter but they may not win due the not having a specified weight limit posted.
