  • An Omaha PD detective got incredibly annoyed when a citizen started filming him and the police department and proceeded to illegally pat him down just for filming him.       Police can not investigate themselves; it requires intervention from an outside agency, F.B.I. Homeland Security, N.S.A., Foreign News Services, Royal Canadian Mounted Police, Russian Mobsters, Yakuza, Isrealy Secret Police.................U.N. is inept. Try the Chinese Communist Party, they are good at keeping their police in line....along with their entire population.

      Also, “I feared for my life”. People using that to shoot and kill people who have a broken taillight and no criminal record or because someone threw popcorn at them.       Most cops think because they have a gun it makes them Lord and Master of the rest of us. And they demand respect. My answer to the last cop that used that phrase on me heard me say, “ What have you done to earn my respect?” He turned and walked back to his squad car.

    I was on my way to a protest with a large black flag and got stopped by a big group of a dozen cops who told me I was being detained and ordered me to surrender my flag as a "weapon." I declined and told them to get a supervisor. A cop started putting on his gloves and I asked him if he was getting ready to go "hands-on." He sheepishly took them off, looked around at the other cops who were now staring at him, and then even more sheepishly put them back on. As all this was happening, a reporter on his way to the protest happened to be walking by and asked the cops if I was being detained. One cop said, "Uh, no, we're just--"
    So I immediately turned and jogged away with my fl(A)g.

      @@thomasr2188 'We the people' are not about the law either. There will always be corruption one way or the other, it's only a question of degree (acceptable or not acceptable degrees). Also, it's pretty easy and cheap to dish out criticism of something you don't know from the inside: first be a cop and live in their shoes for a bit and only then offer up some positive idea on how to make things better.

      I think useless is a big of a stretch. The police is important to combat real crimes like drugdealing, robberies, murder, etc. The only problem is that they aren't well trained. Thus, the result is false arrests and abuse of power.

      Not sure what animal right is all about but people are filmed all the time continuously by government; hight tech satellites, traffic helicopters, survelance drones, street corner cameras, traffic light cameras, all government buildings, news agency cameras set up in parks, recreation areas and beaches, police body cameras, home survelance systems recording street activity, industrial survelance , commercial, personal and private are ALL subject to government acquisition.................

      Keep "shuttering" since slavery was practiced in the open until the later 1960's and is still enforced in some states. Keeping the slaves in line is what the police understand. For the whites, slavery is called "endentured" and the debt is never fully paid.

    Yet another cop that’s long overdue for retirement. Why is he still on the force when it’s clear that he’s not fit to be a crossing guard let alone facing the public, carrying a gun. I seriously doubt that this “detective” could find his manhood or backside given the size of the doughnut ring around his paunch!
    It’s awfully sad to see these state sponsored thugs that prefer to use their own version of the law, which, unsurprisingly have nothing to do with actual laws or crimes (unless it’s contempt of cop which is justified in this case).

      @@jayjaynella4539 Sad to say this but you’re quite correct in this respect, but I don’t think the minorities communities are comfortable accepting that their community can be just as racist towards POC as any white cop. Ignoring this aspect might cause more damage than anything because whilst it’s currently white cops that are recorded acting illegally, as time moves on there are more CZcams videos of African American and Mexican American cops (I really hate those titles/descriptions) behaving just as badly towards people of the same skin tone - it’s not clear or ever explained if it’s due to their own racism or if they just like to fit in with the blue brotherhood and training brings out their worst actions.

      Just because you have the right to defend yourself doesn't mean it's the smartest move. Even if you somehow manage to successfully defend yourself from one cop, an endless supply will come after you because they are too stubborn and obsessed with their power to let citizens that don't submit to their power defeat them. You're better off letting them take you in, then challenging them in court afterwards. Better to live and fight another day than trying to prove that your rights actually matter in the eyes of an American policeman.

    As a police officer for 24 years, we are sometimes our own worst enemy. Some of these guys need to forget the ego and pick up a law enforcement handbook! If it was a security issue such as the floor plan of headquarters or a school then recording could be a security issue, but filming police vehicles in the back of HQ has already been addressed and determined its not a security issue. He has every right to film the vehicles and the officer, even though we don’t like it. I tell all the officers i work with to assume you are always being recorded and you will never have any issues.

      Not legally.
      The SCOTUS ruling in Salinas v. Texas (2013) stated that silence can be possibly used as evidence against the subject, if:
      1. They are out of police custody (and not Mirandized)
      2. Voluntarily submit to police questioning
      AND
      3. Stays silent without expressly invoking his Fifth Amendment rights.
      If you are not meeting both conditions 1 and 2, then condition 3 isn’t applicable. In this case, it was not a voluntary interaction. So remaining silent and not specifically invoking the Fifth Amendment cannot be used as evidence.

Terry V Ohio Does not give police officers the right to Frisk you for officer safety! You must be suspected of having committed or committing a crime and they must suspect you of being currently armed and dangerous, There must be a reasonable suspicion, and not just I’m putting you down for officer safety. And they are only allowed to pat you down in very specific ways, your outer clothes. I suggest that all citizens read and re-educate them selves on this specific court ruling and please reread this paragraph below very carefully and we all need to stop this bullshit of being Frist for officer safety! Please read the law:Police may stop a person if they have a reasonable suspicion that the person has committed or is about to commit a crime, and may frisk the suspect for weapons if they have reasonable suspicion that the suspect is armed and dangerous, without violating the Fourth Amendment prohibition on unreasonable searches and seizures. Supreme Court of Ohio affirmed.

    i disagree with the aclu's last statement. if a cop reaches for or tries to grab your phone, DO NOT just give it to them! move it out of their reach. without a warrant, the cops do not have any right to your personal property, let alone look through what may be there. i would suggest that you tell the cops that to take your phone without a warrant would be a violation of your 4th amendment rights against illegal search and seizure. they are then put on notice that taking your phone would negate their qualified immunity, and now you both know it.

      Haha, and you'd be wrong and facing a charge of obstruction as well as the original charge. When arrested, police have the right to search you and your surroundings without warrant for 3 things in relation to the arrest.

    Know your rights!
    They don’t include resisting arrest if you believe your innocent or being mistreated.
    Record encounter if possible, gather witnesses, do what you need for later.
    You can then complain or even sue in court….
    DO NOT FIGHT WRONG ACTION WITH ANOTHER WRONG ACTION.
    you will lose every time!

      Not all cops are bad, but there are bad cops among good cops.
      Many have become victims.
      They can detain and beat anyone without any reason and they can makeup any reason for their pleasure.
      These are unacceptable.
      You and your family or relative could be victims too.
      Therefore let all the people in USA be gathered together to invoke AMENDMENT of police authority/SOP/supremacy/brutality/lies /arrogancy against people. For the purpose to protect the people.
      Police Department has a good system to maintain safety of the public, but bad people have entered the body. They misuse their authority for their pleasure.
      Let this topic be spread across USA and let there be great movements against bad cops (bad practices) who are using their Authority to oppress people.

    I have a question, why is it suspicious to not have an ID on you? If I’m not driving or doing anything that would require an ID, then why it is suspicious if I say I don’t have one? Example, when I run, I don’t have anything except my headphones, my IPhone and my keys to get back into my house. If stopped in the middle of a run, I could not produce ID b/c I am not doing anything which would require me to have it. Asking for a friend.

    This is why you file a complaint or a legal brief with the state agency that certifies police officers requesting that the involved officer’s certification be suspended until they are retrained and tested on Constitutional law because some agencies merely brush off complaints with no repercussions to poorly trained or misguided officers. Take it out of their hands and go to a higher source for law enforcement accountability.
