    in Utah, being near the car and having the keys or them being in a place you can reach is a DUI. guy got one washing his car in front of his house with keys in in his pocket. >..< i think we all know where good intentions can lead?

      That Law should specify "With reasonable suspicion the person would be driving" since the point of the D in DUI is Driving.

    Idaho your keys can’t be in the ignition or in your possession. So cup holder is totally fine.

      In Maryland they can’t be within reach! Sometimes even if you are just in the drivers seat they will get you. Worked at a bar and one dude would bring a sleeping bag and lay in the bed of his truck!

      What I don’t understand about this law is… even my 2013 Toyota is push to start, so the key could be in the trunk and the car would still operate…

    This reminds me of an episode of Cops where I guy was stopped in the middle of the freeway late at night. The driver wasn't drunk. He had worked a 24 shift and simply fell asleep while driving. Luckily, his car was a stick, and when he fell asleep, his foot slipped off of the accelerator, and his car stalled in the middle of the freeway.

    Its not just one state that thats the law, its federal
    The police have to prove that the person was actually operating the vehicle rather than simply occupying it
    Doesn't stop them from wrongfully arresting though

    I heard a story about this. A man got pulled over, he was drunk so he took out the keys, ran out of the car with a bottle of vodka a few meters then opened and chugged the vodka down. Since he surely got drunk now, while not driving, there was no way to know if he was drunk while driving and he got away with it.

    In Maryland you can’t have the keys in your possession! It’s best to lay in the back seat and have the keys in the glove box or trunk

    In utah you cant even have the keys on you and I believe you cant even be in the drivers seat, parents made sure to tell me if I ever got drunk just call them or put the keys in my backpack/trunk and sleep in the back or passenger seats

    I live in NC. The law is, if you're in the driver's seat with easy access to the keys, you're driving under the influence. As long as the keys are not within easy reach, you're fine. Also, you don't really have to be in the driver's seat. You can be arrested from any seat in the car if you have the keys on you, so leaving the car on for the AC while you pass out in the back seat is not gonna cut it...well, I suppose a limo would be different maybe?

    My friend once called me to come get him home bc he was Abt to pass out drunk..when I arrived bro had the keys on the trunk, doors all open and him laying in the car upside down..thank God he didn't throw up like that but it's still funny rethink of the memory😂 I got him home and threw him on the couch then walked all the way back to get my car😂 thankfully it was nearby so u must understand how bad it was for him not to be able to drive 5 minutes away from home.

    That's a strangely rare level of responsibility for a person too soused to make good decisions. I hope she is okay these days. I know many people with much worse stories, and this is... Well, it is some amount of forethought.
    Not even bad to be reminded that even this is better than actually causing harm. Even if it didn't work out quite as well, it would still be better than causing harm.

    Fricken hate this bs. Saw some guy blacked out behind a wheel,my brother and I had to take the keys out. Cops showed up and said pretty much that. Since no property was damaged and the guy wasn't able to drive because we had his keys, dude was let off Scott free

    It used to be that technically, in NJ, if someone was sitting at a bar with their keys in their pocket and are over the legal limit to drive, a cop could arrest them for intent to drive. I used to encourage the customers to put their keys on the bar so they could say that they were giving them to me, the bartender. If you so much as put your key in the car door to unlock it, same thing, intent to drive. The penalties were much the same as an actual DUI.

    In my country you can get charged with a DUI if you’re sitting in the drivers seet with over 0.5% alcohol in you. Doesn’t matter if your keys aren’t even with you or that you’re parked

    They could still charge her since she was parked in the middle of the road, regardless of if the keys were in the ignition at that point. The cops and the courts could reasonably believe that she was operating the vehicle . How else did the car get to where it was in the middle of the street

    I was parked at a traffic light and passed out. I was not drunk, but my medic alert tattoo gave the cop the reason. My blood sugar was extremely low. My tattoo is the medical cadecus in red with diabetic TYPE1 underneath it. Its on my left forearm. It happened 2 times in about 8 days. The first time had been a week earlier, and I was parked at the side of the road. Lucky me and lucky (smart) for her.

    The keys in the ignition thing has always seemed really stupid to me. I know so many people who sleep it off in their car, but that's discouraged so i also know people who drive home cause sitting in their car could get them a ticket anyway. Seems to me that sleeping in the car is alot safer than driving drunk.

    The key in the ignition thing is true my buddy and his wife was in NC for a concert they went to the car my friend got in the passenger seat she turned car on to run ac then decided to run to a Porta potty b4 they left the parking lot my friend got a dui he had no intention of driving but lost his license anyway

    Me being me...I've gotta ask...what if someone were in the same situation, but (in the rare instance) being in a vehicle that was made before key ignition was was a thing...1910's automobile coming from a bar crawl or something and pull over to "sleep it off"..no key required, just a crank or starter pedal....

    Do not take legal advice from CZcams shorts. That was the case in that jurisdiction. In mine, even if you have pulled over, turned off the car and you have the keys with you you are deemed to be in control of the car while impaired and will likely be charged.

    Here in Colorado you can get a dui even if the keys aren't in the car but you're sleeping drunk in it. Hell you can get a DUI on a bicycle, scooter, even a skateboard. How ridiculous is that?
    If you have neighbors that hate you, you can get a dui-per say while drinking in your house. That one usually never goes further than the first court hearing because there's no proof but still.
