- In an interview with FRANCE 24, former ICC prosecutor Luis Moreno Ocampo reacted to the court's request for arrest warrants over the war in Gaza. The ICC has faced heavy criticism from Israel, the US, Germany and Canada since it announced it was seeking warrants for Israeli Prime Minister Binyamin Netanyahu and his Defence Minister Yoav Gallant for war crimes and crimes against humanity. Moreno Ocampo called this reaction "disappointing". For him, attacking the ICC prosecutor's decision instead of focusing on the crimes is a "huge mistake".

The former prosecutor is correct in saying that attacking the prosecutor instead of focusing on the alleged crimes is a huge mistake, it's actually the worst mistake they could make, because it costs them their credibility. You flex your muscles when you have no arguments, I'm pretty sure they teach you that in debate classes.

It is because they know they'll lose (at the very least their faces) if they go to trial. Flexing their muscle is to show whether the court can be willing to risk the Bden sanction and withdrawing of financial support. It is not to declare their innocence, it is to declare their control of the politicians of the most powerful superpower.

A court's job is only to prosecute crime.. not pass moral judgement. So the allegation of 'moral equivalence' is nonsense. Requesting an arrest warrant is simply a procedure necessary to prosecute crime.

There was not 1 single mention of "equivalence" in the application. There was barely any mention of "moral". It was all about law and human rights. In fact it can be read as 2 totally separate applications.

Discussion of facts and their relation to law is what counts. I believe this is what is contained in the ICC accusation. It is the Court, and not the prosecutor, which may then convict or absolve. That is how it should be. Let Israel show up and put forth a factual and legally based argument, and attend to consequence, including full exoneration/condemnation as warranted.

Title is confusing. Former ICC prosecutor approves the warrant and defends the current prosecutor. Critics of prosecutor is a huge mistake, arrest bid is not a mistake (it is the opposite!).

I think this gentleman is in denial. Khan quite clearly did draw some sort of equivalence, he even suggested the warrants were being sought in relation to the same underlying principles. We all heard this, and can play back prosecutor Khan clearly stating it.

Then thoroughly investigate and then only make a judgement.
You seem not to understand what's going on here. A warrant of arrest is not judgment!! It is issued to ensure that the accused is brought to trial. The evidence is produced during the trial where the accused gets the opportunity to defend himself and produce counter-evidence
As of now, the warrant has not yet been issued. The court has simply requested it. It's up to the judges to decide whether the warrant should be issued or not, based on the arguments presented by the prosecutor.
I can't follow this fellow's reasoning. Israel doesn't recognize the ICC, so there's no reason for Netanyahu to cooperate with it. Nothing will happen anyway, since politics will trump any legal concerns.

I think the ICC could have first issued arrest request against HAMAS leaders just when the October 7 incident happened with proof.
Secondly the issue of Bibi and Defense minister request to arrest them now could have been justified properly.
