- David Seymour is a man on a mission. He’s determined that his controversial Tiriti referendum is on the negotiating table despite Mr Luxon describing it as divisive. David is delighted the the Aboriginal & Torres Strait Islander Voice to the Australian Parliament failed.

But Maori have special guaranteed rights under the treaty beyond normal property rights. That's the problem trying to put English definitions on Maori words and reason the courts have come to define the treaty as a partnership, because the 2 versions aren't possible to reconcile.

The treaty was set up for Maori so they could have equal rights Not different rights. When you have two people's living in the same land but they have different rules and rights that's when you get conflict. We are all indigenous to this country

@@andrewworth7574 the real problem with those stats is that theres no means by which to prove you are 'indigenous australian' as reported by several news outlets prior to this referendum, so conclusion of who is aboriginal is very difficult. I thought Anthony Mundine (actual aboriginal) summed it up best when he said he would be voting no and encouraged all his family to do so.....

We want everyone to move forward, not held back. Putting labels on people or privileges are gross because one particular group of people will feel they don't have to try too hard. As they often say, in bad comes good. Do the same with rugby, the end results will certainly not be what you wanted.

I love what David said about practical solutions. I have three maori children with probably a higher percentage maori blood than many of these flash maoris (yes thats what they at the marae call the woke ones). But I dont think they need special treatment because their canoe arrived here before mine. Actually at the time of the treaty, their chief encouraged inter racial marrying so we could become one people. So I feel based on what ive been told from that era that the intention was to move forward as one people. I think the leaders then would be disappointed to see this far down the line a separatist view being pushed.

My understanding is, that part of 'Titiriti" means a continuance to future generational settlements of all forms! I think originally, settlements were meant to be settled by the year 2000! Let us sort this out once and for all, yes "All"! Maybe the sooner the better, as a Republic, there would be no meaningful document with the crown! We need to acknowledge the Treaty for sure and not Monetize it forever!

The Voice referendum has proven that it was only a small group of indigenous academics living in urban areas who supported the YES vote. Same in NZ a small group of Maori academics wanting co-governance/ 3 waters ownership when the majority of Maori don't want it.
So many ignorant commenters here. The Treaty guaranteed to Māori rights to their land, forestry, fisheries, and valued possessions, as well as equal rights as British subjects. Except Māori were not treated equally when their lands were confiscated or otherwise dispossessed militarily, legislatively and judicially. Now these commenters are claiming that they’re being treated unequally when the opposite has been true. We’re in for a fun ride - I can only hope that it’s an informed one.

Indigenous people of NZ are not Māori. We just settled here before European. That term is only decades old so not reality. It’s NZ not Aotearoa - a transliteration by a white guy by some accounts and certainly not accepted by all Māori. Her interview comes from such a bias - not one I agree with.
What exactly is the referendum supposed to be? Is it a referendum on the Treaty itself [that would be bizarre], or a referendum on the Waitangi Tribunal... that has interpreted Treaty 'principles' a certain way [this would perhaps begin to make sense]?
He’s been very clear on this. Not about the treaty. It’s about all sharing a common interpretation.

@autumnrainn there's no significant difference in meaning between the Maori and English versions of the treaty, and there were Maori acting as translators to remove any ambiguity between the two versions.
Go read the treaty, Maori accepted the sovereignty of the crown over these islands in exchange, Maori gain full English citizenship with the same rights and responsibilities as the rest of us. There was no agreement of a "partnership" between Maori and Pakeha, claims otherwise are lies.
I'd like to see the treaty reprinted in the referendum, then the Labour/Greens version as to how they interpret it, the Act/National interpretation, and then people get to vote on whether Labour/Greens or Act/National have got the interpretation of the treaty correct.

As a European , ex pat kiwi what I will say is , David is extremely respectful in the way he puts a political word spin on what a lot, and I can't say all, to be accurate , non indigenous New Zealanders really want and what he's getting at . True equality , we are all equal , no one is more or less important than another . What that looks like in real world terms is , no ethnic prioritizing for indigenous on health waiting lists , do it on time , or alphabetically , no reserved seats in the job market or university places for indigenous members of society , you win the place fairly with everyone else . Unless we get rid of those unfair conditions in society the jealousy and anger is always going to interfere with becoming a truly united country on equal footing and those are just the facts , it's human nature. There's a reason when Indigenous AND non Indigenous come to Australia they succeed exponentially , and they do succeed that's almost entirely a fact , running successful businesses , buying property , lovely cars , getting wealthy , and it's not just the different economy , it's that there's no social support here , so you have no choice but to take on an attitude of refusal to fail , and then abundance flows . We need equal footing in New Zealand so that a refusal to fail becomes necessary , then attitude becomes the determining factor , not race.

You're right, what's actually needed to increase Maori life expectancy is for Maori to take responsibility for their own health more seriously. Fixing roads isn't really the issue when it comes to health. Personal responsibility is what makes the difference.

Building infrastructure in low income areas creates jobs, lifting families out of poverty. Seems like a good step forward to me.
Declaration of human rights derives from modern [French] philosophy [natural rights]. Earlier British thought saw a 'state of nature' without rights [solitary, poor, nasty, brutish and short]. Historically, from the Brits perspective, rights only came with lawa nd order, which came with the establishing sovereignty ergo the Treaty. Of course, it is all political now, but the reality back then was that sovereignty was established over NZ with the *declaration* in May 1840. The signing of the Treaty in Feb 1840 was to appease the humanitarians back in London... and was really just the nominal cession of sovereignty. But of course, this is history not politics.

Except the British acknowledges the United Tribal Declaration signing of 1835, in accordance with official practice at that time to make it official. Both the Monarch and the House Of Commons recognised its existence.
Which means those rights were handed over with that Declaration, and were preserved in Article 2 of the Treaty. It is the existence of both documents is why the Waitangi Tribunal stated what it did.
It is right when it said Maori never gave up sovereignty as a people with their beliefs and culture and language, and food sources. They just gave up sole sovereignty as a nation, instead sharing that authority with the Monarch.
Which puts todays Iwi leaders that meet at the Iwi Forum at the Monarchs level internationally, while Iwi as a individual entity is at the Parliaments level nationally, the regional councils regionally, and the councils level locally, and Maori individual persons are equal to the Scottish clans in Scotland, the Welsh in Wales, and the English in Great Britain.
In those nations, those people have first say on matters before everyone else. It is the same with Maori. Our say comes first, then everyone else has theirs. The main risk, is if David does this referendum without clear limits, he risks turning full political control over to Iwi, and the complete and permanent dissolving of Parliament.
It has been made very clear in Muldoon's time, that the Treaty is how Parliament has the authority to make decisions here. If the Treaty is ended, Parliament is ended, and power goes back to Iwi permanently.
He is risking even worse problems that Brexit caused, where we very easily end up like Israel and Gaza are right now.

Treaty between 2 distinct groups ,signed after due diligence ,are legal and binding.
Referendum combining both groups ,can arbitrate,renegotiate,but not revoke that treaty .
The principles wouldn’t attach to the treaty but sit alongside it, effectively blocking any current or future interpretation that would infringe upon the following:
