@@margaretthomason7824 I thought so to, but it’s not always that easy. One discrepancy from what the defendant, a prosecution witness or witnesses may have said under oath can easily be turned into a possible perjury charge against the defendant and the other way around. The jury could see it as a discrepancy as a lie, & it could instead help one side or the other. Most defense lawyers advice against it. Many high profile acquitted defendants did not testify. OJ Simpson, George Zimmerman, Michael Jackson(2005 trial), Casey Anthony, & Robert Blake. Even though they were all acquitted, some are still considered guilty in the court of public opinion. Wayne Williams testified in his own trial and came across as very angry on the stand. The jury saw that as someone prone to violence. Even if he was losing his cool on the stand just from being falsely accused of killing those kids, it most likely helped led to his conviction.
@@margaretthomason7824 that's a flat out lie. The problem with testifying is that you have no idea what is coming from the prosecution during cross examination. I think this was a mistake that he may later regret. Yes, there's a good possibility of reasonable doubt from some of the defense witnesses. However, I am sure that everyone on that jury really just wanted to hear from Chauvin over any other expert witness. They wanted to know his training, his personality, how much he valued serving his city for the past 19 years. What was in his mind for that 20 minutes (as well as the last 9) and whether at the very least he feels bad over what ultimately happened. I am sure some of that would require some level of admission of guilt...But it wouldn't have necessarily hurt him at the end. I don't think he was worried about taking the stand and speaking his side...I believe he was worried that this side would fall apart under cross. I still think he should have taken that chance because the evidence is more against him than not. Only time will tell now...
Just like they wanted to hear from Floyd's dealer who was in the van with him. But the prosecution refused to offer him immunity to testify. Because they know he'd face a fierce cross
Considering Chauvin got himself in this mess in the first place it's probably for the best he keeps his mouth shut and lets his legal team try and get him off. One wrong word could destroy his defence.

Why should he have testified? What part of "anything you say can and WLL be used against you" do you not understand? There is nothing you can say that will help you in ANY court case. No attorney in their right mind would advise their client to testify, especially in a sensational case such as this one. For starters, It opens the client up to broad and unpredictable cross-examination, of which little if any can be objected to by the defense. Plus, anything you say can and will be used AGAINST you, not in your favor. The prosecutor will use anything that comes out of your mouth against you, even if there is one silly inconsistency. You will be branded a liar if you misspeak even a little, and open yourself up to perjury charges. Anything you tell the police, the court, etc. is always used against you. Even in the rare case that you say something that can help you, unless it's during direct examination, the prosecutor can object to it on grounds that it is hearsay. People need to make their top lips touch their bottom lips when in court or dealing with the police, innocent or not!
No he wasn’t. It is up to the prosecution to prove he is guilty, he is not required to prove he is innocent, hence a defendant is best to remain silent, and let the prosecutor do their best.

I’m a law student. It’s semantics. The 5th Amendment can be called either a right or privilege. The underlying right protected by the 5th amendment is the right to not testify against oneself/be silent in a criminal action. It is both a US citizen’s right and therefore his/her privilege (as the Constitution is not available in many places of the world) to invoke the Constitution and its amendments to secure the aforementioned rights. So there are semantical differences between saying “my fifth amendment right” vs “fifth amendment privilege” but neither is incorrect to say.

Most defendants don’t testify anyhow. Nothing to see here
most defendants who are innocent are eager to testify and let the jury hear their side

He should testify while under someone's knee
Probably wouldn’t be a problem as long as 5 minutes before he doesn’t eat a handful of drugs.
@@mikezonic1147 NO, he just a killa
🙄
You do not have the brain of a 14 year old. The person that made that comment was probably at the Capitol January 6th
🤣🤣🤣...that is funny...they wouldn’t do that..that would be an unauthorized use of force for a white person.. that’s only for black folk that’s handcuffed in the prone position...
He did his job according to the MPD policy.
You never hear Chauvin talk or communicate with Floyd in the videos. He is silent, because he don't care about his health or condition. Also at the end when they bring him to the ambulance, they make no real effort to revive Floyd. Everything is done in slowmotion.
The 5th Amendment is not a _privilege,_ it's a _right_ guaranteed by the Constitution. Words matter.
Agree. It is a privilege when we compare the US to other nations however.
Anytime a person plead the 5th they just afraid they might say something that might incriminate them
I’m a law student.
Well, now we know what his voice sounds like. Ok
I thought the "You can't win" guy from the video was Chauvin.
Right we've only seen he's smirk and knee in action.
His voice IS in the video
No, people who are informed on the matter, who have watched the bodycam footage months ago know what his voice sounds like.
Yes!
In the body cam video footage though, I believe he says ‘What do you want???’ to Floyd.
I originally thought that he was the one yelling ‘GET UP AND GET IN THE CAR MAN..GET UP AND GET IN THE CAR RIGHT!’
This man is a monster just look at his face..
I never was told this so many times lol 😂
The facts that he knee on Floyd neck and all the cameras are recording...how dumb is he..now his going to cry in his cell for long time 🤷♂️🤷♂️
He a little to comfortable and happy
right...
He will go to prison not sure why you think he is happy. This is a nightmare.
Huh? Have you never been in a courtroom? Do you expect him to be crying?
@UCMjw-FgQZOstI14K8vc1vuA lol.... he won’t go to jail and no one will touch him on the streets..
Imagine being portrayed as the personification of “white supremacy” and your actions leading to months of protests/riots... this guy is as comfortable as an Epstein 1st Class ticket
How can this man be in the court room with a suit on instead of a orange suit and handcuffs. He does not look bothered at all. Wow..
Cuz his white that’s why white privileged
@@wendydescartes8251 Nah, a lot of white people suffer the same fate of a lot of black people who are now a perpetual part of the prison system. Dont make it about race. He is a cop, so he gets privileges far beyond the privileges of any old white person

What are you all talking about? He's def bothered, his life is on the line.
You're required to wear civilian clothes in a jury trial. Black, white or Asian. Hopefully you can figure out the reasoning behind that on your own.
I only wanted to give you that information so that you didn't keep fishing for victimhood.
Would be very different if the coolers were reversed

@@kristinekalinowski5348 nope, trial wise no. Popularity, Yes.
He has the right to appeal the verdict. I would if I were him because of the negative publicity in the Media and the negative influence on the Jury. Ask any Law enforcement person about subduing a person black or white. You do not let them back up once down until there is surrender and sufficient force to insure the prisoner can do no harm. Floyd died from a heart attack because he was on drugs that elevate the heart rate and BP and he had severe Cardiac disease and he fought and resisted arrest (for a criminal act)became uncontrollably emotional .
Oh snap ..this is what I've been waiting for. After this I hope we get to see: Derek Chauvin, What he was doodling on that pad.
🤣🤣
He was playing HANGMAN......🙄🙄🙄
He’s innocent
@@kevinconboy7387 nope he pleaded the fifth he has a lot to hide
@@mikeOxPhat Pleading the 5th does not support guilt.
When an individual takes the Fifth, her silence or refusal to answer questions cannot be used against her in a criminal case. A prosecutor cannot argue to the jury that the defendant's silence implies guilt. Did you not pay attention to the clip?
It's like elementary school. Repeat everything 5 times and then they will hopefully get it.
I think he knows he meant to do that
😂
And he has the nerve to smile. Oh dont worry yoi will have plenty of time to think about what you did justice served rip George floyd🙏🏼

Jury: uhhhhh I don't think so.
Maybe because he is a real man
