    • @19Prometheus89
      @19Prometheus89 Před 3 lety +6

      @@jamiewilson5162 In the UK, only if the information was obtained legally. Capita/BBC, if prosecuting you for TV license offenses, would have to have obtained that phone information through petitioning a court for a warrant to gather that information. Yes, your phone is spying on you. That has been known for some time now. But that information cannot be used in a UK court of law without that warrant. Without the warrant the information was gathered illegally. The only other way your information could be used is if you are being surveilled by the intelligence services, but if they are looking into you then dodging your TV license is the least of your worries.

Their reply was unfortunately we cannot refund as we cannot monitor your usage so don't know if you have or haven't been watching BBC content at home. Even tho I sent them proof of me being in hospital. Even virgin media gave me 4 months credit eventually after a few emails and phone calls to them as they can monitor my WiFi usage but for the BBC the main wording. We cannot monitor you usage is the important part so they have no way of telling what your watch and when. I'm doing it legally and only watching catchup TV and Netflix which is only a little more expensive than a TV licence and far more content worth watching and of course no BBC iplayer 👍👍👍

    Have yet to see anyone get court summons or prosecutions when they are addressed to 'Dear sir/madam' rather than your actual name, and they can't do that if you don't answer the door or talk to them. I have been 'investigated' by them for over 15 years now and they still don't know my name (the most primary piece of evidence they would require to prosecute me) - excellent detective work there Columbo. The letters just go round on a circle ramping up the threats before the cycle resets itself and they start over from scratch again because they run out of words and things to say, so just ignore them. They just end up unopened in the bin now with all the other junk mail whenever they come through my letterbox now.

    Goon turned up at my mates house while I was there in 2018 and had a police officer with him. Police knocked on the door and demanded my mate open the door as he had a warrant (WRONG!) . My mate panicking was going to let them in. I calmed him down and asked if he wanted ME to deal with the situation. He agreed and I told him DO NOT OPEN THE DOOR UNDER ANY CIRCUMSTANCES!!. I went upstairs and stood on the windowsill and opened a small sash window. Asked the cop and the plain dressed bloke what they wanted. Again police officer shouted to open the door as they have a warrant . I asked the cop to identify who was with him he stated it was a licencing officer from TVL . I told the cop to STOP and listen to me for 1 minute . I told the cop 1) that his job was as an observer in a peacekeeping role ONLY and 2) the goon had LIED under oath to obtain a warrant without proof. I suggested he quickly contact his superiors to ascertain the exact role he was to play . Cop said you are pissing me off pal. I told him to go check ....he did ! He came back to the house and told the goon he couldnt do anything as this smart ass (ME) knows his rights. I was quick to point out to the cop its not my rights...its the law ! They decided to go licence free too, since you can pretty much get everything other than the BBC via on demand services without a licence. Still one of the telephone operators who phoned her about it insisted that she would need a licence for watching BBC shows on Netflix! Fortunately she knows better, but I know a lot of people would be scared into buying a licence by that behaviour.

      This makes me wonder. If you watch netflix on a tv, then do you turn the tv on and then go to netflix? If you do that, and the TV goes to a normal station before you hit the netflix button, hey presto, you need a licence. The only way to avoid this is not to have an aerial on your tv. I wonder how many people who say they only watch netflix have an aerial plugged into their tv?

    • @AlanEvans789
      @AlanEvans789 Před 3 lety

      @@rusticpartyeditz No no aerial plugged in. They got a new smart TV as a wedding gift, it hasn't even got a freeview receiver built into it. They just expect you to use Sky for live TV, or a streaming service. My old TV with a Roku dongle doesn't have an aerial plugged in. It always comes back on using the previous input channel. You have to manually switch it to a different input with the remote. As the Roku remote will also turn the TV on, and adjust the volume I'm not even sure where the actual TV remote is.

    • @rusticpartyeditz
      @rusticpartyeditz Před 3 lety

      @@AlanEvans789 When I turn my TV on, it has to go to a tv channel. You can then change the input. You could leave the TV on a radio channel which avoids any issue. • @cyclist68
    @cyclist68 Před 3 lety +1

    2 points.
    1 If you have been ignoring the letters and not responding the first thing they have to do is to confirm you are the person on their register and still living there.
    How do they do this?
    Its easy, You open the door and the first thing they say, ( before they identify themselves, ) is your name .
    Smiling "Mr Fred Bloggs? "
    Most people will automatically say "Yes"
    So teach yourself to never do this when opening the door, always respond with "Who are you?"
    When they ID themselves its "No thank you" and close the door.
    Unless they can confirm you are the name on the register at that address they cant progress the file.
    2 If you are going to watch live TV without a licence ( which I highly don't recommend) be cognisant that if they see the TV showing live TV, through a window or door that is enough for them to proceed the case against you. This and whatever comes out of your mouth on the doorstep is what all prosecutions are based on and why far more women than men are prosecuted. Women score much higher on the what sociologists call the agreeability scale and are far more likely to stand and talk on the door step.
    Men on the other hand are far more likely to be abrupt and tell them to FO.

    Actually, if they're going to interview under caution, it brings along a few major pitfalls for them.
    "This interview is being recorded and may be used in evidence if this case is brought to trial"
    That's the first line of the splurge of an interview under caution. How is that interview being recorded, and what authorization do they have to do so?
    The next part is, "you may halt this interview to consult with free and independent legal advice at any time either in person or by telephone"
    They are license salesmen. Who is going to pay for your free and independent legal advice? Remember, they started this shtick by claiming you were being interviewed in pursuance to a criminal prosecution. An interview is designed for you to answer to evidence presented to you. It is not a fishing expedition. You also have the right against self incrimination.
    They cannot at any time investigate your computer in order to carry out their investigation anyway. You are covered by privacy of information.
