Health and Safety in the Workplace | What Happens if an Employee Dies?

  • Working across Construction, Aggregates and Waste industries we are well aware of the importance of Health & Safety in the workplace. This video aims to raise awareness for company owners/directors and those of you starting out in business to understand the depth of your responsibilities once you employ staff.
    After a fatality in the workplace in UK it is the Company Director that may be taken to Court and may be charged with Corporate Manslaughter by the Crown Prosecution Service (CPS). Note: there are other types of legal action that could also be taken. (Health and Safety at Work Act 1974)
    In this video we have created a dramatised fatality scene in the Ashville yard. This is followed by a mock Court scene with Prosecution Barrister Dr Tunde Okewale MBE acting as the Prosecution Barrister holding company director Daniel Louisy accountable for the death of an employee.

    Spine chilling video. It just shows how we all have a responsibility to make the workplace safe. Absolutely well done to Daniel and all involved in the making of this very important message. Although nobody was hurt in the making, it brings it home how quickly situations can turn sour and affect a lot of people. Well done Ashville Team.

      100% agree but it is a diversion. All HGV drivers know that safety is paramount. Who told him to do this. - Money talks. DVSA, ROSPA and HSE will come after you.

      I would be interested to know if an accident occurred or fatality of a sub contractor. Who is responsible? The main contractor or is the self employed subbie and his family on their own? I worked for a company as a subbie engineer, and they ask me to do all kinds of “dangerous” tasks of which I have now left as the last job was just profit above safety, and I walked out.

      @@Metal05 I'm unsure who is legally responsible as I'm not in that business. However, I would imagine there is someone responsible for the whole site and everyone working within it.
      I'm glad you have been able to walk away from somewhere so dangerous but I imagine that they've now got someone else doing their dirty work.
      It may be worth contacting HSE.

    Im a 54 year old man, that video brought me to tears. I was run over by a lorry 1995, the driver was not at fault, the owner was not at fault, it was me at fault !!!!!! George whom run me over has never driven a lorry to date 😞George will never listen to me when i say IT WAS ""NEVER"" Your Fault.... """I WAS THE IDIOT """ Not George!!!     This is terrifying, and can so easily happen. I saw a guy I worked with crushed by a pallet falling off a forklift a couple of years back, broke his pelvis detached his bladder so has to pee in a bag for the rest of his life, in a wheelchair for years. All in a split second. Have eyes everywhere, and if you feel somethings not safe, walk away

    As a Safety, Health and Environmental advisor, this is extremely refreshing to show how traumatic things like this can be, it’s especially important to show that even though people think Health & Safety is overbearing, it is in place to protect people from these incidents occurring and also showing how everyone has a responsibility. Fair play Ashville already enjoyed the channel before this.

    Seeing pictures of Cora just sent shivers down my spine, it’s far to easy to let a mistake go with sharp words, that is until someone dies because those sharp words were ignored. H&S dominates what we do for good reason. I hope this video does go viral and is used as an example to other companies as to why things are put in place and why breaching those rules is gross misconduct. Well done Daniel for putting yourself out there again and again

    I’m working in a company where the danger is every were, starting with industrial vehicles, suspended loads, operations in height, and vehicles moving with dangerous loads, from heavy to molten metal.
    The key message is to guarantee that everyone and the end of the day go home safe and healthy.

    Very good video, employees of a company remember there is a reason why a decent MD/CEO gives you a stern talking too every now and then, you may feel a bit peed off after a grilling but you can not imagine what they have to go through every day and night, where as you can switch off at 5 o clock when you go home and not have any worries until the next morning, the boss is probably answering phone calls and emails well into the night even though he has to be back in work in a few hours time. Just a few wise words (I think) , I am not a MD/CEO i am an employee of a company with a good boss and I see how much stress he has to deal with on a daily basis.

It’s sometimes easy to think you’re simply extending responsibilities to those under you and that’s that, especially if you’re not on site at all times like myself but you really have to document EVERYTHING for instances like this.

    Never forget being called in by a senior manager, many years ago now, and told off for reporting too many faults (not construction industry). My reply was "If you think I'm bad now, you've seen nothing yet". I'd previously let more minor things pass but after him telling me off, I reported anything and everything. It was my livelihood at risk and ultimately, as this excellent video shows, I was partially protecting him as well. Well done Ashville team, that brought a tear to my eyes when Daniel screamed out to Terry and ran towards him.

    That was a great video, I think what we learned from it is that we can never cut corners when we are entrusted with high responsibility. The HGV driver was supplied with a concrete lorry to perform the daily operations of the company, and did not follow proper protocol whilst reversing. This shows the deadly consequences and proves why protocols exist in a workforce, not following them may have devastating consequences. Thank you for the video Daniel, once again Ashville has made an amazing video highlighting the consequences of not following proper protocols. Amazing use of the courtroom dialogue, well done Dr. Okewale

    Not enough serious raining and neglegence is always the top two when it comes to (fatal) accidents on the job. Mostly because people will say "Ah, that'll never happen to me".... until it does.

    Wow! What a professional production! I was alright till it got to the part that showed Terry and his fam…with a lump in my throat and a tear in my eye I watched on!
    I don’t work in the construction industry but where I work we have lots of vehicles moving around the site (car dealership) driven by technicians ,deliver drivers & customers! It seems your team talents stretch far beyond construction etc.. ❤️

    When I joined British Telecom in 1985 I was sent on an initial safety course at Edinburgh House it was 3 weeks long and included a H&S Film called “Who Killed Susie” and it was based on the similar lines as this, I congratulate everybody involved in making this training video, we had to watch the film and afterwards we had to answer questions based on the content and what we saw & it’s absolutely amazing how much we take for granted the other film was called “Bish, Bash, Bosh” another more light hearted film based on corner cutting & shoddy workmanship again congratulations to everyone who was involved

    Wow Daniel this video brought tears to my eyes, at the thought of losing Terry. I don’t believe for one minute that you would stay away from the family. Seriously though H&S is for every person to comply with including visitors that come to the site. You could say that terry should not have been in that area on his phone. Prevention is always better than cure. You have made me even more aware of the H&S practices that should be taking place on construction sites an even when we see houses being renovated an heavy equipment is being used. These days there seems to be many people setting up construction companies but H&S is not at the forefront until things go wrong. I hope that everyone at Asheville has seen the video and taken it very serious. An everyone that watches it looks at their own companies H&S policy to make sure there are no holes.

    This got me thinking of the time you actually did fire the driver who did that very reckless overtake you showed us on weekly. That was a real risk and would only have ended in catastrophe. A good decision on your part.

      @@solshields sorry, don’t know, but in short a driver tried to overtake while another vehicle was approaching from the other way, almost resulting in a collision. Ashville showed us dashcam footage of the incident.

    As someone who has witnessed similar scenarios at a young age, from watching co workers getting pierced by speeding forklifts to warehouse racking collapsing on them im glad to see this video because a lot of my generation don’t really pay attention to the dinosaur explanations the typical workplace gives so when you have a modern video portraying Health and Safety I think it’ll help in many industries⚔️

    Very very good video this should be shown to everyone to explain it all in detail like you have freat work as always guys amazing, I have to deal with this sort of thing on a daily basis due to being a LOLER and power inspector for lifting equipment and machines to ensure there safe to use.

    I find with every achievable training or things put into place to avoid these things happening.
    People/staff just don't listen or follow their training guidelines.
    Which then makes a boss liable to prosecution.
    You wonder why some people won't employ staff.

    Really good concept. I work for the railway and we regularly have to watch videos with dramatised fatality videos. It always hits home and reminds you when out on the track you need to follow the safety protocols all the time. This video should be shared with other building/construction firms. We are always taught on the railway,
    The most dangerous thing within the workplace is familiarity. When you do the same job, day in day out, switching off is easy. These educational videos are reminders not to switch off.

I work in the industry driving PA, MEWP's and Cheery-pickers and never realised that with all the toolbox, induction and training there's so much that isn't highlighted or said.     No one really thinks how fast one can actually die at work. One of my father’s coworkers died a couple of months ago. He was operating a small remote controlled crane and wanted to pick up a heavy load (3+ tonnes). He didn’t attach the rope evenly and when he picked it up, the load tilted towards him and smashed him against the wall. The man was 5 years away from retirement, what a shame.

    Continuous risk assessments of the work place are absolutely pivotal. This along with processes and policies installed to prevent people from bending the rules can prevent most accidents. Most importantly people need to take their own health and safety in their own hands. This comes with education. Great video Dan, sublime. I’m going to pass this over to the trainer who trained me on my IOSH course a while back.

    There's no record of the conversations he had with the driver, so deny it's ever happened, and this is the first time. Relinquishing all responsibility from the Director putting it onto the driver for sheer incompetence

      It's in the accident book which is probably why the Barrister new about it, or came out in interviews of all the witnesses, so that would have been worse. Knew about the accidents but did not take any action at all either on or off the record

      @@intelligentgardening and could be prosecuted for perjury on top of corporate manslaughter, seems like denying something that you knowingly knew happened could go badly in court, who knew, why take that risk to start with, honesty and remorse are the best way forward.

    That was excellent only thing is you failed to mention the outcome of the driver at fault, I would imagine he was looking at a lengthy jail sentence?hopefully this will help drive home to other companies how important health and safety is and also how much pressure HGV drivers are under

    Great Video and I really hope it helps to bring the message to a wider audience. I’m a manager in the waste industry and operate in very similar environments. In 2020 I hade to deal with a fatality at our site and my BIG learning from the whole sad episode was the wider impact it had on the rest of the team working on site. Three weeks after the incident our weighbridge operator SAW the deceased sitting in her passenger seat on her drive home!! Six people had to have counselling for a long period of time to get over it. The memories never go away. They fade but they are always there. I really hope that this video makes everyone stop and think that we are all responsible for safety. Not just the directors and the managers….EVERYONE!

    EXACTLY MY THOUGHTS . I was passing a site today ( houses & flats ) almost completed. There was 2 dumpers , 1 flat bed & a HGV not one of them had a banksman and there was ground workers doing service trenches, as well as landscapers doing pacing .. I could see a accident in the making . I also seen a site manager ( or at least he had black hat on ) standing talking to a guy jetwashing a completed driveway. He could obv see what I seen and just let it happen that way .. H&as starts from the top 🔝 same as everything you lead by example. If guys see managers doing nothing then why would they . THE GOOD OLD GREEN CROSS CODE “” STOP LOOK AMD LISTEN “” ALL THE PRICEWORK NOW REDUCES WORKERS CARE ABOUT H&S ALL THEY CARE ABOUT IS THOER FRIDAY PAY . Why wait till that barrier is moved if u can jump over it to do the job attitude..

      So what's your suggestion...for every machine employ a driver plus a banksman??.. by that logic every bus and truck on the road they either need to remove reverse gear or put a second person with every vehicle.. its a nonsense suggestion

      @@AbcdEfgh-zp1sn on sites where u have multiple HGV’s etc reversing & guys working then yes if they move off the vehicle routes then yes .. esp when guys are working eg the ones doing paving and dumpers buzzing about . Don’t take much to miss a guy working on knees if you are at high level ..

      @@AbcdEfgh-zp1sn sorry you obv don’t get what was said on his video.. it’s compulsory for a banksman to accompany on sites that’s why he has them at gates … or did u miss that bit .. Not putting any measures in place would lead to corporate manslaughter as easily proved u completely neglected your duty of care to employees and site visitors. More people die from being hit by moving vehicles on sites than anything

    Outstanding Daniel, spine chilling video should be used in training classes going forward for what could happen might happen and has happened out in the industry. I work in the railway industry and health and safety is a massive thing and we see videos all the time of things like that happened but this one was a real eye-opener from another industry and it’s taught me a lot about your position and your industry. Again outstanding.
