  • Suggesting that you never sign a contract with a contractor on a stamp paper. Contractors can make your life hell. We will be sharing a story where a contractor and client had made a very safe contract and followed all the things on a stamp paper. They tried their best that all the formalities should be finalized and written on the stamp paper so that both of them are secure. It was on the insistence of client that a formal contract was produced, printed on stamp paper and then signed by both the parties.
    Both these parties started work and construction of project very happily until something bad started to happen. Contractor started to cheat on the quality and quantity of material. Once client started noticing, the finger pointing started. The rift increased between the both and finally it took them to a stage where both of them had to separate.
    This is the stage where agreement came into play and we realized that the plot owner has more at stake then the contactor and the contractor thus has more bargaining power.
    I would suggest that in this case don't do a contract on stamp paper.

    It’s an incomplete contract example. The Client was supposed to have added Penalty and Exit clauses in the contract to ensure work per drawings, design, Quality and terminate the contract if and when required.

      agree and this guy is making outright statements that never enter in a contract, looks like the contract was poorly thought out and written just like his slides in the video, but that doesn't mean having a properly written legally binding contract is a wrong thing to do.

      Pakistani justice system at first place order a stay .....
      All related matters and agreement details are further discussed in the court for final decision...
      Stay is unavoidable

    Regrettably sir, you either have lack of knowledge of Applicable Law e.g Contract Act 1872 or you are misleading for reason best known to you. Nevertheless, the truth is that a Contract on plain paper is equally enforceable under law. Further, as you said you were appointed as third party assessor which i think you were "Arbitrator" meaning thereby the Contract must have had Arbitration clause (under arbitration act-1940). In that case, the Contractor could not have gone to court because the Courts would have referred the case back to Arbitrators or appointed Arbitrators itself. So, parties having Arbitration clause in Contract should not worry about Courts as Courts have very limited jurisdiction in such cases and decision of Arbitrator(s) invariably attain finality.

    My dear your point is valid to the extent if agreement is done with out ensuring ones own interests. If there is no written agreement on a Stamp paper there are equally big chances that the contractor can play even more dirty if he is not a clean person. Best option is that agreement should be made which safeguards one's best interest. A clause should be kept that if the owner is not satisfied with the work or quality of material then he will terminate the agreement and his decision will be final. Also that the Contractor will not claim any damages or resort to any legal procedure.. Best is that owner who is spending millions of rupees should spend some money and time to consult some lawyer before making any legal agreement which will save him future bigger headache. Moreover owner should Ensure that he lays down the mode of payment and never pays excessively so that he can never be on a weaker wicket on this account. I am in the construction business and follow the same practices.

      Thank you for giving a detailed feedback. My actual emphasis would be that focus should be on finding the right contractor. Getting it resolved in the courts at later stage is no option in my opinion

    As an aspiring house builder, I am learning a lot from your videos. Thank you. I wish you were based in Islamabad. There is too much dishonesty in the property business in Pakistan. I would like to suggest you to do a video series on A to Z construction of a house, if possible. Maybe on your next project. Showing the steps of how construction is done so when some contractor is lying about construction, we will know. There are some other Pakistani channels that have such videos but I think you would be able to do a better job.

We will try our best to make a video on complete process of construction but the hinderance is that all the team works on projects of clients and whenever we find some time, we do a video. Unfortunately, to record complete project we have to daily do recordings on the project and then edit it and do lots of things which effects the business.     Must establish and sign a contract but ensure it’s comprehensive (involve construction, legal, and risk management professionals) and covers all risks involved. This is important to select a right type of contract (Firm Fixed/Labour & Material/Cost Plus/ Hybrid) to suit and protect both the parties.

      @@GharPlansPakistan Actual se kum main kaam karwane kai chakar mai kaise tha? You explained that the work done for 38 lac was actually worth 23 lac. Means if the whole house cost 120 lac, the contractor would earn around 5 million straightaway on substandard work

    Very useful information but I guess the landlord should write clause that work shall be discontinued there and then if quality is compromised and no reimbursement shall be given to contractor on termination whatsoever!

      Yes you can write that but in that case courts can come in place and the whole process will be delayed. Secondly, badmash contractor is case main bhi win kar jayain gaye. The best thing is to find a good contractor

      @@GharPlansPakistan if it's documented then petition shall be cancelled within 2 appearances and no way the contractor will win if the quality is compromised, secondly Sharif insaan say bara badmaash koi nahin hota and only thing is that one needs to be financially sufficient. Agreed with that one should find best contractor.

    Right information but there are some instances where client creats problems for contractor especially holding the payments, not paying on time etc etc. I met a contractor who shared that everything was going fine and as we started woodwork in the house, owners asked for doors of mohagni which were not in the initial contract. Since it went all well till this point, contractor went on with the clients request and fixed door of mohagni. At the time of payment, the client refused to acknowledge any such request and refused to pay and held around 6 lac rupees of contractor.
    In short there must be a way to safe gaurd interests of both parties, both parties must sign a paper which can be challenged in court of law in case of breach of contract by any party. But that's worst case scenario, first everyone must ensure to fulfill their promised commitments.

    Very well describe , one query though if we should not opt for stamp paper , then general or plain paper agreement will not have any worth in terms of legal ? So what can be done in order to secure mutual interest legally.

      Actually it should not have any legal worth. I think going to court is not a solution. It is written down to make a moral obligation and document the things

    I was always of the opinion that such construction contracts should be on stamp papers but you have changed it all together. It will be great if you could suggest what methodology be adopted for such construction contracts.

      Thank you. Well the best thing to do is choose a good contractor otherwise you can understand that something that can happen over here is losses. I would suggest verification should be as strict as bankers do when lending to someone. Additionally write a paper which would only be moral obligation of both parties to follow

    I signed a labor rate contract on stamp paper with my contractor. The contract includes grey structure (including plaster, tiles & marble). Material procurement is my responsibility. We have completed both lenters. All dues to the contractor are clear which means I have paid him for all the work he has done so far. Is there any way for me to exit the contract because I'm not satisfied with the quality of work and therefore I no longer want to continue working with him for the remaining two stages i.e. plaster, tiles & marble . Please advise.

    Good info. There is nothing wrong with contractor on stamp paper. But owners try to save pannies when infact spending millions. Owners should hire civil engineer to check work at each stage. Owner should have terms in stamp paper if work is not done as per civil engineer requirement which owner hire then owner will charge penalty to contractor but the big problem is owner spent millions on plot and house but dont spent on quality of work always look for cheap contractors

      Actually 99% of the people don't hire a consultant in Pakistan especially for house construction. Your question is very valid and i ask the same question and that is why i said ke client ki bhi utne hi ghalti hai jitne contractor ki. Actually khowish paise bachane ki the :)

      I would suggest credibility banayain. I think agar aap nain sahih se credibility bana li tu it will pay off really well. Kuch cases main clients bhi unjust hote hain us case main aap ko pareshani ho sakte hai otherwise aap ko faida hi ho ga. Waise telling you frankly humare paas 50% clients aate hain tu woh kehte hain ke contract ki zaroorat nahin sirf eik saade kaghaz par details de dain ke aap kiya dain gaye

    You are damn misleading people. By saying that not to sign contract on stamp paper, let me tell you, court would not accept any issue later. Now instead to saying that people should not sign contract on stamp paper, why do not you explain them how to make contract proper and risk free where client secures his risk. Any client can put a clause in the Contract such as, if the contractor deviates from the terms and conditions (this shall includes the material quality as well), then the client shall have the right to terminate the contract and the Contractor shall have not right for x.y.z....When there is not stamp paper involved in the Contract then how can a Client even secure himself or go to court against the contractor. That way, if the contractor terminates the contract, the client can just call or talk to various people but will not be able to go to court. So my saying is that you should read a proper contract like FIDIC 1992 or Red Book and learn for yourself first and then teach your clients how to secure their risk and make contracts with construction contractors.

      I would still stay with my argument sir. Firstly, i was telling an actual story and this is what happened in actual day to day example. The home owner should not go to court in this situation. Secondly, i would never like my house to stop and then get a court decision in next few years are start it again. A much better approach will be to find a credible contractor. Lots of Government contracts got struck in court and of course they must have read the contracts and Acts much better than you and me. The costs of delays was much higher than any penalties. Also credible contractors have contract templates which they will amend but will never take dictation from clients.
      Lastly, there are politer ways of saying things. Of course it would be much easier to use harsher words than yours but yeh hi zarf hota hai. I would request you to improve a bit on it. Just a suggestion sir

    Stamp paper is not issue. Problem was documentation. In this kind big and sensitive works needed proper document like contract conditions B.OQ drawings specs. should attached along stamp contract and proper supervision. it should not verbally.

    on the other hand the owner can also file an FIR of fraud against the builder, pay 1 ,2 lac to the SHO and do his chitrol, contractor cannot take stay from court in such case this was just a bluff from the contractor.

    ایسے ہی پینٹ کرنے والے بهی دوکاندار سے خریدے گئے ہر مال پہ اپنا حصہ طے کرتے ہیں پهر زیادہ مال لے کر کچهہ تو چوری کر کے دوبارہ بیچ دیتے ہیں اس طرح وہ دوکاندار سے ڈبل منافع لے لیتے ہیں.

    This is a nightmare that all clients face, having to worry if the builder will scam you, and then if you catch him, he will try and walk away, and then you are stuck without a house, and to find someone to complete the job always costs more. To take them to court takes time and money too, and in the meanwhile you still have no house which a court case can drag on for more than a year. How can this be avoided?

      You are totally right sir. When i do videos on these topics some people get offended but the objective is that all the people are not like this but you have to see and find the right person. Some people have commented that go to court but i think that is not an option. People going in courts are still waiting for their decision and if the decision comes after 10 years you tend to loose much more than what you get even if you win the case

    Facing similar issues now a days. In my case
    Contract is on company pad.
    Material and work is ok but slow
    Issue is I have to pay per month (4 installments) .
    So payment flow is fast as compared to the work on site
    Can you plz guide me in this.

      This is front loading. Milestones ke sath payment associate karne chahiye the. Us ke sath bethain use se kaam karvain aur use samjhain. Yeh rationale use samajh a gaye ga aur woh ise adjust kar de ga as you are his customer

    @Ghar Plans Agar normal paper per agreement hota hai , aur is may signatures ho aur thumps ho tu bhi Court may accept ho jata hai case , App ka yah pata hona chaia , baad may court stamps duty lay layti hai.

      Meri suggestion contract paper par likhne ke yeh hai ke doonon jaanain ke kiya karna hai. Main tu keh raha houn ke focus on finding a very good contractor rather than thinking of court option. It is no option actually

      No matter a contract is signed on a plan paper, when agreed and signed by both the parties, the contract becomes a legal document and can be referred to settle litigation in courts. So no difference if one is using a stamp paper or plan paper.

    Ye method he galat hy k contractor ki mehnat wo apni mrzi sy owner k maal main sy nikalay ga
    1500rs/sq feet main grey bna rha hy tu kis hisab sy paisay apnay pass rakh rha hy, yani koi fixed chex nahi hy.
    Hum shopp walay sy koi chez khareedty hain tu humain nazr ata hy kia khareed rhay hain, laikin contractor ki mehnat ka rate fix nahi wo apny paisay tu leta he hy maal kam laga k bhi loot ta hy.

      I tend to disagree on that. Now you can find lots of good contractors. Masalah yeh hai ke at times clients bhi ziadti karte hain. I get lots of queries on daily basis ke hum nain ghar banana hai A to Z details bhaij dain. Of course it is not possible. Expectation level at client is too high and the contractor normally chosen is the one who quotes the lowest

    I don't agree with this video. Is mein maalik se ziada contractor phansta hai. Jab aik dfa agreement sign hogeya to material mehenga ho ya sasta contractor responsible hai k apni jaib se bhi material laana pray leker aaye nahi to us pe case hoskta hai aur agreemnet null and void hoskta hai. Aap ki information sehi nahi hai.
    Aap ne kaha k maalik ne saari cheezien likhwayien to us mein ye point b zaroor hoga k material A ya A+ hoga. Aur jab contractor ne woh material nahi lagaya wajha jo b ho beshak market mein available na ho ya phir prices barh geyee ho to contractor dosra material bina permission k nahi lagaskta aur agr woh aisa karta hai to us pe case banta hai k woh agreement k khilaaf geya. Pta nahi ye kahan se story aap le ker aage hain.

      Sir you have every right to disagree but this is something which is a true story. I will try to explain it a bit. Aap jab ghar banane ga rahe hote ho tu kiye aap ghar mukamal par focus kar rahe hote ho ya case karne par. One thing is for sure ke jab aap case karte ho tu aap ke ghar ka kaam ruk jata hai aur us soorat main malik makaan ko hi zaida nuksan hota hai. Mere khayal main is ke liye court solution nahin hota kyon ke decision main time buhat lag jata hai aur nuksan buhat zaida ho chuka hota hai tu malik makaan
