  • A woman in Oakland fired her gun into the air to scare off an intruder. She describes herself as a 'mama bear' who was protecting her family. But when police showed up, she says she was treated like a criminal and handcuffed. OPD said firing a gun into the air is illegal.

      @@crisleroi299 more defendable than firing randomly in the air because you can still kill or injure some innocent somewhere else. Bullets can travel up to a mile from the most basic guns and the bullets will come down somewhere. At least if she is firing at the intruders she stands a far better chance of hitting them.

    Yes, I learned the hard way too. You don't call the police when something like this happens. The same thing happened to me. An attempted murder, or attempted strong armed robbery almost happened with me. A BMW parked behind me as a woman distracted me while I sat in my vehicle. I was aware of my surroundings and got my gun in ready position. Said man in BMW quickly came up to my window with his hand in his pocket of his hoodie. Looked like he was holding a gun. I beat him to the draw. Got out my car. He stayed there in that position while I held my gun at him telling him to leave. He wouldn't leave. His woman accomplice came at me from the side and snatched my gold chain from my neck and said "shoot him." I'm sure she did not mean me to shoot her bf. I never took my eyes off the perp. They now had my gold chain. I thought I was going to die even though I had the drop on him. I told them to leave. Told them go ahead and keep my chain. Taking a life was not worth more than my chain. The perp would not leave. I told him not to take out his gun. He called my gun fake. He called it a bb gun. He was going to draw on me. I told him it real. Then when I made a choice that he was not going to listen and he was going to draw on me, I decided to shoot a warning shot. The perps finally left. I called the cops. The cops arrested me and took my gun. I had to hire an attorney. They treated me like I was the villain. California sucks. You don't call the cops. That's what I learned. And they wonder why it's getting this way.

      unfortunately a "warning shot" is an unlawful discharge of a firearm and proves to a jury/judge that you were not in fear that the threat was imminent
      because if the threat is imminent then you would only have the chance to use lethal force to defend your life

      @@CrazyGuyTray the very unfortunate thing here in California is that it's a Democratic state. The state would rather you kill someone rather than fire a warning shot. It really doesn't prove anything about you not being in fear of your life. You'd have to be in the same situation and then tell me if you were in fear of your life or not. Can't say it if you've never been in that predicament. The unjust part about it is that the jury is instructed on how to deliberate. Because any jury would 100% agree that shooting a warning shot has less of a chance of killing someone than actually shooting the person. Trevor Traynor (probably the DA in some county) agrees with prosecuting a victim of a crime, and that's exactly why states like California are sinking down the drain. They give more rights to the perps.

      The suspect didnt have a gun so he wasn't a "threat" to police so why chase him the armed black woman defending her home(refusing to give you her gun) is the threat. People shooting into the air leads to individuals dying every year from the bullet just landing on them on the way down. Her unwillingness to shoot at the person who was actually at fault could get a random innocent person killed just walking down the street blocks away and if not for this video and police report nobody would have a clue how that person died from a gunshot to the head.

You know kids die from errant shots like this if they're out hanging with their friends or family, playing basketball outside their house or apartment, whatever, if that bullet happens to land there. It's Russian Roulette where the person who pulled the trigger isn't the one at risk of getting shot and the person who may be at risk has no idea. It lands somewhere else a few minutes later, they have no idea it is coming if they are under it. Maybe if you thought about the possibility of someone you know being on the receiving end of the consequences of her not wanting to the life of the criminal at risk, you'd see why if you are going to pull the trigger it should be at something specific. She's in a residential area.

    I'm 100% 2A and her right to defend herself and family but warning shots are reckless and put innocent people at risk. By her own words, her warning shots didn't even deter the criminal. That's why finger off the trigger until you are ready to fire and you shoot to end a threat (kill if necessary). Self defense goes beyond scaring criminals with a loud bang, you have to prove you mean business by slinging lead in their direction, not into the air (and potentially on to an innocent). Better a criminal end up in the hospital/jail or dead (since they chose crime) than an innocent who had nothing to do with it get hurt.

      Problem is her action / response is border line criminal... You don't shoot unless you believe you (or family) are going to die or suffer great bodily harm. A warning shot means you were not scared of death/great bodily harm in the eyes of the law/judge/prosecutor etc. Cops don't give warning shots, cops are trained to eliminate/kill the threat - If a Cop shoots, Cop would claim he was scared of death, cop shoots and kills = open and shut case. She would NOT be in trouble if she had shot the intruder... she shot in the air which opens her up to all sorts of criminal charges... she better hope they don't charge her with anything. She went out and got herself a gun without understanding the rules of engagement... Just pointing a gun at someone under the wrong circumstances IS aggravated assault... I doubt she even knows that.

As a parent nothing is as valuable as your own flesh and blood. If you had children and family to protect like this poor woman, you would make the same decision. We are all living through violent times where criminal activity is as highest as it ever was. Many innocent victims suffer violent crimes and the criminal if arrested is treated with kid gloves. So what happened to rights in keeping family and self alive and safe. We also have human rights.

      @@annecinturati2794 They are not splitting hairs. It is illegal and dangerous to shoot warning shots. No matter what Biden tells you. If you have the ability to shoot a warning shot, you are not, by definition, in direct threat of great bodily harm or death and therefore can't use deadly force. ie. shooting any firearm in any direction. White, black, purple, that is how it works for everyone. That is the legal standard so of course when someone shoots warning shots, they will be treated like a criminal because by law they are, at that point, a criminal.
      If you can't manage to understand this, then I hope you don't own a firearm and you shouldn't be commenting on this video.

      The person was inside someone's home. The homeowner didn't break the glass. The intruder or burglar broke the glass. If the homeowner had an attorney they should have won the case.

      Cases are won like this because people don't have attorneys, or they don't get good ones. There are companies out there, like US Lawshield, who offer insurance policies for less than $11/mo that would guarantee you had a great lawyer for anything that involves self defense. I've had a policy with them for years now and it's worth every penny. I can even call my local self defense attorney any time I want and pick his brain about laws and to do/not to do that would help with my defense.

    Never EVER fire "Warning shots". It can land you in trouble. It will be looked at as "Intimidating with a deadly weapon" "Unlawful negligent use of a firearm." If you're pulling a gun to fire warning shots, it pretty much says you were not in immediate fear for your life, or else you would not have fired "warning shots". So, don't pull that gun out unless you mean to use it against a threat. If she would have shot the intruder, she likely would not have ended up in trouble.

    The same thing happened to my dad. He saved our lives and got jail time. Dude shot the front door knob down with a tec 9, my dad was waiting on the first set of stairs inside and caught him in the leg, but he shot at him when he ran out the house. So they arrested my dad and tried to give him like 10 years, he was completely legal. I understand. A stray bullet is dangerous but damn.       @Posse Ruthless yeah I understand what she was trying to do, but as a responsible law abiding gun owner, I know it is illegal and the severity and danger of firing a gun into the air and would never do it. I couldn't stomach injuring or killing an innocent person or child by shooting a gun in the air. I could deal with and move on with life if I injured or killed a criminal threatening my family or my life. It would still be hard though.

    I don't blame her at all whatsoever, however her mistake was shooting in the air instead of in the grass because what goes up must come down (and that bullet could kill and innocent bystander walking by, thankfully it did not). Having said that, it doesn't justify her treatment by police, she and her family were still victims of a home invasion. Smh

    No, that was RECKLESS!!!!! She should NOT have gone outside and definitely NOT fired into the air!!!!! I know of a child who DIED when someone did that, and across the subdivision, the bullets came down on the church, with one hitting and killing the child. Had she stayed in her home and fired at the woman while the intruder was still in her home or was moving toward re-entering it, Mrs. Gillam would be in the right. Mrs. Gillam was probably not thinking clearly and acted recklessly out fear for her family. We do not think clearly when our children are threatened and in danger. My prayers are for her.

      @@bwj1158 maybe for civilian I don’t know , not quite sure . However , in Florida security officers are now proceed and allowed to fire warning shot on the ground grass. I saw it with my own eyes and I asked the shreiff is he even allow to do that and they said yes because it’s a warning procedure to give the aggressor from bodily injuries or any other potential harm.

Cops take forever to respond. You don't know what the strangers intentions were, if they were also armed or not.       Bullets do tend to come back down and if that stray bullet happen to hit someone innocent I'm sure that persons family will be devastated as well.

    I heard of a situation in NY where a woman was trapped in an ally by three men, one of which was openly displaying a knife. They attacked her and in thr struggle she shot and killed two of them. She was arrested on two charges of first degree murder. Her lawyer was able to get the charges down, but do you know ehat they still absolutely wouldn't drop? Firearm use within city limits. Thats a slap in the face for a woman who stopped herself from getting killed/raped/mugged or all of the above.
