It is not a matter of the 1st Amendment. It's that SCOTUS Justices are *supposed* to be impartial and their job is to uphold the law and the Constitution. Can we agree that the peaceful transfer of presidential power falls under both these categories?
And if a SCOTUS Justice finds he/she cannot uphold their duty, has a conflict of interest, or if there is the appearance of a conflict of interest, that Justice is supposed to recuse themselves from connected cases. That is in the Constitution.
Alito and Thomas have both flatly refused to recuse themselves despite clear conflict of interest and appearance of conflict of interest. That is a violation of their oath and a dereliction of their duty.

Freedom of speech is not freedom from consequences. He has the right to fly the flag upside down, and he and Thomas has the right to associate with billionaires. But judges at every other level of the judiciary would be required to recuse from cases where their impartiality might reasonably be called into question; why aren't the justices of the highest court enforced to maintain the same standards?

It's true...when significant issues come before the scotus that have political implications. Roe, gun control, election question the media target justices they know that are prone to take positions that are constitutional text based . They do it every time any hot button issue comes before the court.
They believe they are above the law. Unbelievable in every way.
There should be a body of law professors who serve as a board to oversee the top justices of the country.

The Courts do not make law. Congress makes law. The Supreme Court determines whether laws made by Congress are Constitutional when a case is brought to them by a citizen of America.

He can't argue that he had nothing to do with it. She is his wife. Why did he not stop her. Not stopping her from flying the flag over his home makes him responsible. It is clear from this act that Alito is a supporter of the insurrection and to that end he will of course argue that he has a right to rule on all Trump cases. What has happened to this country and how long has this sickening behavior been in hiding? I'm a Gen Xer. The Boomers, who raised and educated me through childhood, and were raised by The Greatest themselves in Post War WW2, have become a frightening reality that should scare us to our core. From President 45, to the former and current GOP party and now even our Supreme Court; have they forgotten history? Did they really forget what the USA stands for? And stood for, so I thought? When will the mainstream media DO THEIR JOB? What we have today is not media or news, it's blatantly partisan and right-wing. I remember when news WAS news and it meant something. I remember when news told the truth and didn't opine 30 different ways with 9 other people to pick apart some news item to death. Gawd, I'm so tired of all this, when will good people start to do something and make it stick?
Alito's claim rings hollow. Joyce Vance has an excellent essay in her Substack yesterday on this topic. She wrote, in part:
"As though a sitting Supreme Court Justice, upon pulling up to his home and seeing the flag, wouldn’t immediately take it down and say, 'Honey, I understand your feelings, but as a Justice on the United States Supreme Court, I must avoid even the appearance of impropriety, and that flag conveys a political sentiment that is an affront to the rule of law I’m sworn to uphold, especially after rioters carrying it swarmed the Capitol a week and a half ago.'
I have spent a good bit of time in my life around Judges. My Father-in-Law was a federal judge, my Husband was a state court judge, and I have a number of close friends on the bench. I am certain that none of their spouses or other family members would have even considered placing a political symbol like this in their front yard because they would have understood the rules, just like I did. And the rules are, you don’t do that. At the time the Alito’s flew the flag in front of their house, the Court was deciding whether to hear a vote-counting challenge from Pennsylvania. The majority said no, but Justice Alito, joined by Thomas, dissented. They wanted the Court to take the case, whose theme, in brief, was that the Pennsylvania election had been stolen-stop the steal."

@billhuff131 married over 30 years, and yes, over matters I feel are important, she supports me to the last, and vice-versa. Of course, that helps explain why we have been married 30+ years where so many others fail.

In the late 50s & 60s to "run it up a flagpole and see who salutes" meant to tentatively present an idea & see whether it receives a favorable reception. The Alito household used political rhetoric to publicly signal their ideas; the gesture is a speech act.
This is such a threat to our democracy. I've actually experienced these red hats first hand and the trauma they cause. They drive around the community with those big American flags waving off the back of their cars while shouting USA and it's absolutely terrifying to experience.
