The PDGA is an organization that people have to join and pay a membership fee, similar to joining the Elks club or Fraternal order of Eagles.
When you join and pay a membership fee, you’re agreeing to their rules and bylaws.
So I’m perplexed how someone is able to sue them when they agreed to their rules, divisions, etc when they renewed their membership for 2023.
The PDGA isn't a social club, it's the governing body for a profession. Membership is a requirement for the job. Legally, it is not and does not even come close to meeting the definition of a "private" club, which is very important when it comes to claims of discrimination.
Rules can't run counter to law. I like your common sense notion of justice because it makes sense, but not in the realm of governing law. I suspect on the merits (actual case claims) the issues will be the business of sport and "divisions" versus business for all purposes. TI is to maintain the status quo, Ryan was already with tour card for 2023 when policy was changed.
Private clubs as you think this is cannot act illegally, this is though not a 'private club'. What next all-white golf is back in the form of the WPGA?

Fwiw, most companies have liability insurance that pays for their defense, up to and including judgment awards that aren't considered intentional acts. I'm a mere insurance adjuster, but this much I know from experience.

No matter how you slice it, NR has been and continues to burden disc golf in so many ways. It doesn't matter if insurance covers Cale or not, the expense is real and the cost is felt somewhere.
Where the hell is Natalie getting the funds to be suing everyone? Lawyer retainer fees are expensive as hell and add up quick.

Can anybody, particularly the content creator, explain this from an "equal employment opportunity" standpoint? Isn't her sponsor the only "employer"? PDGA, DGPT, and tournament hosts are private "clubs" that host "invitationals" and offer "cash prizes" and not "paychecks" so what legal obligation do they have to allow her to participate in whichever field she chooses? I had this thought when first hearing about Ryan specifically initiating a lawsuit in California for the OTB because it had more inclusive laws that included discrimination protection for trans people, and right away I thought...but the tournaments aren't the one who is or isn't hiring her, she still has her sponsor as an employer, so what grounds are there to sue?
Sponsors aren’t employers. I think the best way to think of it is that the defendants are businesses operating in MN and Natalie’s claim is that these businesses are engaging in unfair discrimination under MN law.
So athletes are like independent contractors? Or maybe something along the lines of professional gamblers (who can also have sponsors)? My legal mind is puny. The hosts and tournament directors being named as public "businesses" and not private institutions giving her more rights to sue I do understand, though.

I like the term " Invitational" . All Elite, silver and majors should be invite only. That gives the right to exclude anyone. Is it dissimilatory? A large group of the FPO players should get together and file a lawsuit against Ryan for punitive emotional damages for having to compete against a male.
They should do more than that. Any number of suits could be filed. NR's threats should also be considered in litigation / potential charges.

Merits of the case aside, the gamesmanship and calculated delay in filing these suits and seeking emergency relief really bothers me.
I understand using the legal tools available to you, but its just seeking the releif ultimately sought with limited time and resources available to the court to try and obtain a rushed decision in your favor is just shameful.
I don' think the court should encourage people to sit on their hands for a decision that was made last year, for them to file this month and seek relief a few weeks before the tournament that was scheduled even further back.
There is no evidence of either in this case...you will have to show evidence of your weird claims here beyond 'feels', conjecture and circumstance.

The PDGA can also limit their tournament venues to exclude MN CA and other states not conducive to their policies. Remember Bud Light? If PDGA modifies their policies to allow Transgender athletes to play in FPO, you will see a mass exodus and boycott of the PDGA and their membership will plummet.

Between there being a MPO and the fact N stated that it was too difficult to compete due to all the men says everything we need to know about the motivation here.
She is a trans women who has undergone medical transition. Studies have shown that trans women retain no biological advantage over cis women after undergoing medical transition so it is totally in keeping that she should be able to compete with the other women. Her motivations are as simple as wanting to compete and being herself.

HEY DGDL! This case is being held in Wright County which is MUCH different than Ramsey County where the powerlifting case took place. Wright County is a VERY Red county and extremely conservative. Ramsey is just the opposite, extremely Liberal. Could this have an impact on the ruling even though their is precedent?
I just can't imagine being such a selfish person, I don't care that there is an open division I can play in, I don't care that I have an obvious physical advantage over these women, I don't care that I'm not good enough to compete in mpo, everyone else should have to deal with my clear and unfair advantage so i get what I want. How does the timing work between a response from the courts and the event date?
Probably very similar to OTB. Waited until a week or so before the event to file, unsure when it was actually filed, trying to get a TRO but Defendant’s don’t even need to file a response until after the event is over, could be a problem that solves itself again by NR waiting to long creating a fake emergency

Thank you for these videos! As a non-American it is sometimes really hard to even try to follow these cases and how they differ from one state to another, and then you throw the federal stuff in the mix. Your CZcams videos are very well and clearly explained, and I thank you for that.
Though I have a question; If Natalie now loses the case in Minnesota, can we expect another lawsuit in another state? I am just trying to figure out whether this will be an on-going thing for the foreseeable future until she eventually wins in some state, or is there a possibility that the court (in some state?) just bangs the door shut and allows the PDGA to make the decisions for the sport they govern?
As a second question; What if PDGA just revokes Natalies license and forbids her from playing like that? I know its very extreme and not something I would imagine PDGA doing, but what if?

The one thing I cannot comprehend is how people support Natalie and somehow do not see how much of an advantage Natalie has over the Biological Females in the FPO division. This year Natalie has entered 8 FPO tournament, has a 4th at memorial, the DNF at OTB and has won the other 6. If you take on the C-Tier which Natalie was the only one in the division the average victory was around 8 strokes with one being a 10 stroke win over Macy Valediaz who is ranked 16th via UDisc world rankings. There is clearly an advantage that comes from being a Biological male that can be backed up by science. To me I do not even view this these law suits as a Discrimination issue at all but that Ryan wants to compete in FPO for the money.

With the treble damage part of the lawsuit it looks like a desperate money grab to me.
This is standard punitive damages in cases, you ask for treble as a judge will likely reduce that to the figure you actually want. Lawsuits always include all claims to their fullest extent. See prosecutors asking for decades in jail for convicted criminals and the judge giving a decade...it is standard.

Much thanks to Mr. Clark for covering this issue, again. One problem is the DGPT issued NR a 2023 FPO tour card, then amended that card to MPO when the PDGA changed the rules. MN Judge issued the Injunction to maintain this status quo (having an FPO tour card for 2023). We'll see, in the end, how this issue is treated under the very broad MN law. If you take the NR position to a logical final conclusion, then no actual divisions are appropriate in sports competition. Recent 2023 MN amendment of "gender identity" definition says it means a person's inherent sense of being a man, woman, both, or neither. The old definition was under "sexual orientation" and was broad as well on self-image and identity. We currently have a democratic legislative majority along with a democratic governor.
Ryan's position is not that there shouldn't be protected gender divisions but that she is a woman and deserves to get to play with women. I think both sides agree that testosterone is an important hormone in regards to athletic performance. Natalie is on testosterone blockers which regulate her testosterone level below that of many cis women.
@@benjoselyn4268 - Yes, that is one issue. It has not worked out well so far in swimming, track, MMA, and cycling. Study out of University of Sao Paulo, Brazil, published in British Journal of Sports Medicine, October 2022, Leonardo Alvares, et al showed that long term post-puberty hormone therapy transgender women enjoyed a 20% increase in strength and respiration over regular women. I proffer that NR has not been playing long enough to be a dominating presence, yet, but is performing much better than many life-long women FPO players.

A judge has ruled that Natalie Ryan WILL be allowed to compete in the Preserve Championship. There were 52 FPO players signed up. That's a full deck. If it goes to 53, I think there's a joker in there somewhere.

Based on his recent comments, NR should be banned from the PDGA, pure and simple. This would have nothing to do with how Nate "identifies" and thus no discrimination taking place - it would be entirely about his unprofessional and hateful comments toward the organization, for which any athlete should be similarly treated.
It really needs to happen. I don't know that unprofessional and hateful are big enough reasons. But vowing to sue them at every turn and various other incendiary threats definitely qualify.
There is no sign of this tantrum stopping.

@@NFS305 gender is not black and white. Acceptance of the fact that you cannot fully comprehend the experiences of another is a mature understanding of individuality. Transgenderism is a natural phenomena that exist throughout many known plant and animal species. Has been, and always will be. So instead of being callous and dismissive of their lived experiences understand and accept that they are an individual who is deserving of acceptance and inclusion. I agree that Natalie should be disallowed from competing in the FPO due to being born biologically male and the physical differences between the two sexes. No issues there. But have some understanding as to why transgendered people might prefer to be acknowledged by a particular pronoun. This life is hard enough without feeling like most the world is your enemy.

Even Darts and Pool have women's divisions. How stupid do you have to be to believe that women are physically equal to men? There are only TWO Olympic events where women and men compete on an equal footing: Sailing and Equestrian. Jam a sail on a horse and go take a slow ride in the Pacific, dude.
I'm all for equality for everyone, including transgender people. But in the scope of athletics, it should not apply. Gender identity simply should not be able to precede biologically proven physical advantages. Women have fought too hard, going back to Title IX and beyond, only to have that all undone by transgender women who transitioned after puberty, and subsequently inherited all of the physical advantages of going through puberty as a male.
I don't see why Natalie doesn't just compete in the MPO. It is called the "Mixed Professional Open" so that there's no exclusion for her or anyone else.
Question for you, I know the PDGA does not ban transgender people but have a criteria like the Olympics. What is keeping Natalie from qualifying for FPO? I cannot find that information.

There is a percentage of testosterone you have to be under,or something of that nature.Not sure of the exact details but it's along that line.

Essentially you have to have under a certain amount of testosterone to play in FPO, and the only way to have that low amount of testosterone is: be a female or under go hormone treatment before puberty and even then the prenatal testosterone that men are born with is still more than a woman has her entire life.

The upshot of all this is that, going forward, the pro tour will stop holding FPO events in states with trans non-discrimination laws to avoid the headaches, hassle and financial exposure.

Seems to me Ryan is out to just ruin the sport and cost the community in the long run. We're going to be the ones footing the bill in the end, with higher prices, entry fees, etc... Business is business, and the rules are the rules. PDGA and DGPT have adopted the Olympic Committee rules on the subject... why is this even in question?? Many other sports leagues are doing the same thing...

Meanwhile, since OTB, this man dressed up as a woman has been beating up on poor women in a professional A-tier tournament in Minnesota (The Majestic, which ironically Cale Leiviska won in the men's division), and in local tournaments in Virginia and Tennessee. In Montross, VA he won by 24 strokes. He's amassed over $1,500 in three first place wins since OTB, a sum of money that some poor legitimate women would gladly have won a piece of. I hope this cancer on our sport will be cured as soon as possible.

I dont understand how this works. They say gender and sex are different and that woman=gender, and female=sex. The division is called FEMALE professional open. So it shouldnt matter your gender. Born female means tou can play FPO
Whats REALLY funny is how they claim that gender is a social construct, (so things like girls liking pink and boys liking trucks is all a "social construct) but then they use these things to claim that a person has a PHYSCIAL or BIOLOGICAL difference. So girls liking pink is just something that humans have made up, but if a boy likes pink it means that he's a girl trapped in a boys body?
This is why you're attacked and "cancelled" if you voice any opposition to them or if you even just try to bring up the logical points, because they know there's no defending their BS arguments. When someone is confident in their arguments/beliefs, they have no problem talking about it and the welcome opposition, because they know they can defend it.
