  • In October we posted an update on the Lawsuit against MCCEASE LLC that was filed by Florida disc golfer and shop owner, Trevor Toenjes. Since then there have been new filings and updated rulings from the court. We wanted to provide some analysis of these developments to the case and discuss the legal reasoning behind them.

    Being “hit by a disc” at a disc golf course was just absurd because everyone attending a tournament knows that this is a possibility. Gross negligence would have to be proven, I believe.
    The guy had $$ in his eyes.

      Gran Canyon, is dangerous in several areas, getting hit by a disc is probably the last things that might happen. Slipping and falling off 30-50' cliffs is more likely. The course needs a Lot of work to be worthy of an Elite event. So obviously opening the discgolf season at a subpar course is obviously based on Secret handshakes and dirty deeds... It appears the cows are still roaming the course on the down days and they don't even have concrete tee pads yet, same old lumpy pieces of carpet/cow bedding.

    I'm glad the case was dismissed, as from the little I knew, it seemed frivolous to me. I would have rather seen a court ruling on the merits though - as wouldn't that have have helped set precedent to protect other course owners from being sued? Good for McBeth and Cease on not just settling though.

    Glad to see this dismissed. It was almost certainly a frivolous cash grab to begin with, but I think all the stuff coming out about the dude's reputation in the local scene sealed the deal.

    At our local park there are signs that warn the public there are discs possibly flying to be aware of. Isn't it a basic assumption (to be aware of flying / stray discs) one should be on guard when you're a player especially one with roots in the game like a store owner? I don't care for the personal attacks on the guy for other reasons that's not part of the issue the internet latches onto ad-hom attacks of course and all the hero worship with Paul McBeth - but it does appear the guy is not playing nice. If he came to his senses.. good for him it can just disappear. No prejeduce is fine it also invokes the court doesn't hold a bias against him or Paul.

    I'd have a waiver at any course. You come on my land, on your own accord, and you accept all dangers. Should be that way everywhere.

      The course is still dangerous in fall off cliff ways and treacherous walkways and hasn't been improved as of yet.

      @@theairportstuff Rules are for the people who need them. And, you are there because of the experience that will include being observant and respecting nature for its inherent challenges which make the course UNIQUE.
      It's a pay to play private course, correct? Disc golf is in fact. Backpack hiking with colorful flying plastic toys and the hike includes a basket they eventually go in. It's not a simple hike either. Which is part of why the course is revered and has the interest it does.

      @@earthman808 The unmanicured property has some great views. But it is dangerous in many areas. The Pro disc golf tour has some standards as to course maintenance, amenities and infrastructure. Gran Canyon is subpar at this time in all aspects. It is basically a rough cow pasture where you throw colored plastic around the cow piles. And please be careful... Don't fall off the unmarked cliffs.

      @@theairportstuff If you are a local with so much knowledge. What are you doing to improve it then? Diamonds in the rough take years of constant attention largely BY people like yourself who volunteer that reality into place. Most ALL of the public courses I play on have been entirely manicured and brought to their enjoyable existence by constant selfless involvement of its locals. Same goes for the private courses.

      @@earthman808 Not a local, but played the tournament which was a huge let down. Not worth the hassle or the $$$. I have played c-tiers that were run far better than TDTM.

    maybe he got tired of everyone talking shit and how it affected his business but unfortunately for him the damage is done and not the first scummy thing he's done either if the rumors are true..
