    You keep using the term home health care. That is not correct. Non-Medical Home Care is what you are referring to. Home Health Care is skilled nursing, PT, OT, and in home medical services and care.

    • @elderneedslaw
      @elderneedslaw  Před měsícem

      True. We could also distinguish between home care and custodial care. Skilled va unskilled care and more. Remember that I creating these videos for people not in the “business” - so I am using terms that are more widely / generically used.

      Hi Reko - one reason why is because the rates differ with different medicaid managed care organizations (they negotiate their own contracts). The point I was trying to make is that Medicaid will approve a set number of weekly hours. Medicaid will then pay the contracted agency directly.
      If you are interested in a family member or friend getting paid, there is a Participant Directed Option (PDO) that you can read more about here: www.elderneedslaw.com/blog/participant-directed-option
      (the rate is pretty low... approximately $11.00 - $13.00 per hour)

      To hire a person DIRECTLY (not an Agency) it probably depends upon your county. It's just caregiving. HOWEVER I didn't check about what Florida pays but would assume your County is not going to pay much more than min wage unless you reside in a very expensive area. In Calif, the Bay Area is paid a few dollars more than where we live. San Francisco pays very well but it's an arm and a leg to live there.

    • @elderneedslaw
      @elderneedslaw  Před 2 lety

      For Florida Medicaid Waiver services, essentially what happens is that the Medicaid provider will do an assessment to determine how many home care hours the Medicaid recipient is entitled to (note: sometimes they do not provide all hours that are necessary and an appeals process needs to be followed). The managed care organization will then pay their hourly rate based on their contract with the home care agency or to a family member/friend via the PDO program (PDO does not pay very well, usually something around $11.00/hour (sometimes less, sometimes more).

      @@AE-yt4lx I think Nautika may be referring to CDC (consumer directed care). I am not familiar with that program because it is associated with APD (who work with developmentally disabled children and only adults with very specific conditions). In my world (elderly and disabled) there is a program referred to as PDO (participant directed option). You can read more about that here:

    Wow, in California we just call the IHSS office and someone comes out to do an assessment. You'll get maybe 2-4 hrs per week is average. Enough to keep you alive. It's hardly ever more.

    • @elderneedslaw

      Its different in every state, for sure. Florida Medicaid usually pay for between 15-40 (sometimes more) hours of care per week.

    • @MelissaCoup
      @MelissaCoup Před 3 lety

      @@OneLife21 No I worked for a Supportive Living Agency so would hear about how many hours many of our clients received. And my own clients received about 10 per week. Considering I knew most of the clients of the company, you'd hear about it. Even with HIPPA laws it was open discussion for whatever reason. Of course some people had much more hours, some less, but if you averaged it out. most people don't get many hours. I'd also talk to some of the IHSS Workers around the subsidized apartments we'd work in (Clients lived in their own apartments). My Father in law used ot be an IHSS worker too. One GREAT perk in Calif is as an IHSS Worker in Subsidized housing, you are not forced to pay 30% or whatever percentage of your rent. HUD doesn't charge IHSS workers who live with their clients.

      You are very welcome! Usually when you accept Medicaid, you contract with one or more Managed Care Organizations (e.g. Humana, United, Sunshine, FCC, etc...). You're then on their "home-care-agency roster" and given to enrollees as an option.

    How can an individual become eligible for long term Medicaid if they have assets? Will said individual need to liquidate assets in order to qualify?

    • @elderneedslaw
      @elderneedslaw  Před 2 lety

      The answer is, as is often the case with the law, "it depends." Florida Medicaid treats different categories of assets differently. Sometimes assets need to be liquidated, other times not. The detailed answer is a bit much for this forum. Please schedule a consultation with an elder law attorney (our Firm covers all of Florida)

    Hi, can I ask... If a person also has an LTC insurance, and medicaid does not give enough hours , could this person use her LTC to cover the additional hours she wants? Thanks

    • @elderneedslaw
      @elderneedslaw  Před rokem +1

      This can be tricky. Florida Medicaid wants to be the "payor of last resort" - meaning that they want you to use other resources available before they kick in. So, if they find out about the long-term care insurance which pays, for example, up to $150.00 per day for home health care, then Medicaid can take the position that they are only needed to the extent that this is insufficient to cover your needs.
      You should ask the LTC carrier if they are a part of the "Medicaid partnership program" which allows you to increase your $2,000.00 asset limit to the extent that you use the policy before applying for benefits (links below for more information).
