I keep explaining this to my boyfriend: things have been skewed against women for a long time. More women began speaking out and the needle swung forward. Then Heard spoke up right in the midst of the MeToo movement, and we as a society were all shouting “BELIEVE WOMEN” and we believed her. Johnny lost jobs even though we had little to no proof. We overcorrected. I think we’ll eventually see the needle begin to move back towards the middle (and hopefully the Justice for Johnny movement is a sign that it’s already happening).

Remember when Johnny was ACCUSED of abuse and was removed from nearly every movie he was set to star in? Including ones that needed to nearly be rewritten to remove his character from even being mentioned? That was just when Amber put out interviews mentioning abuse. Now there is a court case with video evidence of Amber pretty much admitting, taunting and laughing at her victim WHILE abusing him and we are still 'struggling' to get her removed from a sub par DC movie? Johnny was blacklisted for someone just accusing him yet Amber seems wildly unaffected by being caught.

    • @thelogicaldanger

@@WeeScottishLass Regular legal defamation is more than that 1) it has to be untrue 2) it has to be something that most people would believe 3) it has to have caused the person harm 4) is a statement of fact and not an opinion. However, if someone is a "public" person, ie famous actor, their is a much higher bar to reach the standards, ie people are allowed to say stuff about a public person, that would be considered defamation of a non-public person.
Because Amber didn't directly name him in the article, Depp must prove that she was talking about him and that most people would have known she was talking about him--I don't think he can prove this. Depp must also prove that he suffered harm (ie lost movie roles) specifically because of her statements against him--again, I don't think he can prove this, unless he can get a director to testify that they specifically fired or didn't hire Depp because of the abuse allegations. I also don't think he can prove that Amber's article is untrue--the article didn't cite any specific allegations of abuse, and it didn't name him--for a defense, all Amber has to say is that she was talking about the abuse she has suffered in life in general (which is exactly what the article actually says,) not about any specific person, how is Depp going to prove that she was specifically talking about him?
So, while I think Amber is a horrible, narcissistic person, I think she is very cunning, and was careful to write an article that anyone who followed her and Depp's relationship would know she was talking about Depp, but which Depp will never be able to prove all the elements of in court.

I'm Canadian, and I hold a pretty unpopular opinion that the DP should be legal- but only in exceptionally horrific cases where doubt has been tossed out of every window possible.
Some examples of "damning" evidence for me (each one of these is a real life case):
Posing for photos in the underwear of a recently murdered victim (done twice).
Not one, but two torture films, created by the defendants themselves.
So many human body parts cut up that police don't even have full bodies to reconstruct.
Irrefutable proof you committed a crime, including eyewitness testimony that saw you get out of a car that just ran 10 people to death (later upped to 11).
Video footage of a terrorist act being committed by the individual in question.
Anything less than this I can't support the DP.

The second reason is because it's more expensive than just giving somebody life in prison, so it seems like a waste of money just to feel good about killing somebody.

The JD v AH case reminds me of my old foster home. Over the years I lived with them I was basically a frog slowly being boiled, I eventually jumped out the pot when leaving the day before my 18th birthday, this "day before" was in order to skirt the local pd's min 24 hour limit before reporting a "runaway". It wasn't until recently that I found out about the term "gaslighting" and honestly...that explains so much about why my mental health and "anger management issues" were so bad. It's been years and I still have nightmares and wake up with an awful mood for the day.
All that to say that I understand JD's reluctance to take action against AH. It's a weird mental space where you know for a fact that they did you wrong yet there's an internal resistance to make it a big deal. There's a subconscious voice that keeps telling you to just ride the wave and it'll go back to smooth sailing, but there will always be an ebb and flow to these. Sometimes it gets bad and others it's a semblance of normalcy, but the problem is that your inaction eventually leads to them pushing the line. The line gets moved further and further until it takes an outside perspective to realize that your "smooth sailing" is on the crest of a gigantic tsunami, which...means it'll all crash down should you not act decisively.
There is no more apt phrase than the frog being boiled really. The severity of the situation is hard to realize unless you have help. Then with hindsight you keep excavating the depths, realizing more and more red flags.
If you want an example of the struggles I had, let's just take one of the most obvious examples. I have Chronic migraines, and for the longest time I never figured out why some days I felt like it would have been better to rip my eyes out...turns out I needed glasses. I had glasses before this foster home but never got a replacement in the shuffle. My eyes were tested the year I moved in and they were at the minimum to use glasses but not "need" them. Years go by and I can't read the board in class even from the front row. It was an uphill battle to get enough "evidence" that I now need glasses. After finally seeing an optometrist they said that I needed glasses asap in order to stop my eyes from degenerating any further. The worst part? The glasses came in on a Friday and they didn't give em until a school day...meaning they legit acted ignorant of my struggles and didn't felt like I needed those for daily life. Yes the same ones the optometrist said I needed to keep on for as much as possible each day to prevent my eyesight from getting worse. The day I got them I was peeved at the passive aggressive act of witholding my glasses...but I was blown away at the beauty of the world, I never knew something as mundane as leaves on a tree could be so mesmerizing. They also never took me update the prescription which the optometrist advised I do biannually. Which reminds me I need to do that since I can't read my monitor without glasses now...
So many things I could have taken to court especially since I was under foster care/legal guardianship, yet I didn't...and I still don't know why.

It was oddly calming to see how such an ever present thing felt so revitalized. Clouds were like works of art, and the swaying fields of grass almost too mesmerizing.
I think the most mind boggling thing was how little changed at my recognition of people. I can't for the life of me read a sign but could instantly recognize someone from 4-5x the distance. Something about the shape and behavioral nuances made it so I could pick people out of the crowd. It was a weird adaptation to poor eyesight that became redundant with glasses. Been watching the Depp trial in full. I look forward to hearing Amber but I think I can speak for most survivors of domestic abuse when I say that we can tell who is the abuser in this situation. We can tell who the instigator is based on everything so far and it's Amber. She behaves like an abuser, not a victim. Johnny behaves like a victim, not an abuser. Victims of abuse often take on the traits of their abuser while with them as a survival mechanism so Depp's behavior in the relationship doesn't surprise me.
What matters is how they both acted in AND outside of the relationship. Johnny only lost his cool with Amber; everyone else says he was a good person. Amber, on the other hand, has been accused of hitting other people and treating work partners badly.
Amber is guilty whether the court rules so or not. She is morally guilty.

Everything that I saw about it was how hellmuth handled himself at the table, like how he started to go off on the dealer for not shuffling "correctly" or how he wouldn't call Alexandra by her name, instead calling her botez or chess girl. He also started to heavily target to the point that she stopped playing hands after she won a monster pot of $300,000 against him with Ace 9 to his Ace 8. Overall, he was behaving kinda shitty with all his complaining about poor hands or everyone playing bad because there were only a few actual pros at the table.

I love that Slime is popping up here, even if its for a regrettable controversy. To be honest, I am not surprised that the controversy that comes out of this is about a pro poker player, not one of the streamers - while it was really hype to have these poker pros, it was always going to end in some form of salt. If the pros win, its a shut out for the streamers and the vast majority of the viewers feel put out. Pros don't win, and they get shit for being mopped up by streamers. Easy to see.
End of the day, people being mad is understandable - Hellmuth made a motion that was clearly indicating a fold. Slime acted on that, and the misinterpretation cost him. But on the other hand, Slime (at least at the time) was dismissing it. I think we will have to wait to see what he says on The Yard to really understand how he feels, being put on the spot like that is never going to yield a completely honest answer.

RE: Poker Story - As someone who has been involved with poker for 22 years, as a recreational player, professional player, and a card room dealer/supervisor. I can confirm a majority of most poker players even professionals don't have a full grasp of the rules. Most couldn't even tell you what a minimum raise value would be after a raise and re-raise. Not to get too nit-picky as many venues have slight alterations to the rules at large of poker that suit the venue and players for their community. But in large the bold line on the table in front of the players is NOT an action line but a line to define keeping the table in order. It is etiquette preferred that players keep their chips and cards behind the line but not a necessity if the venue/dealer is a little loose on enforcing this etiquette. This also becomes looser for televised cash games where the aim of the production is to give a friendly and more banter-centric environment than a real cash game environment.
Furthermore, rules and etiquette in power are enforced by vocalised intent and assumed intent, if the assumed intent is a little too vague, the dealer should be asking for clarity on the actions, if they fail to do so or are too slow players may ask for clarification.
Slime mistook the intent as he wasn't paying attention to the conversation on the table at the time, with Tom Dwan asking to see Phil's cards (common on cash games), then Alan Keating asking for Phil to show his cards to all. This does not fold or void Phil's hand as there is no more action to follow the action on him. What does confuse me is that the dealer accepts the claims that Slim's hand was folded after he exposed his cards during the misunderstanding (which the dealer made no effort to control) and later explains this to the supervisor, which leads me to believe any hand all-in exposing their cards before action has resolved can be seen as trying to influence play (angle shooting) and voids their hand. This part was odd to me as most venues do not have this rule but I am aware of some that do.
In short, Slime was confused for not following the action on the table, the dealer was not paying attention and made 0 effort to control the table (quite frankly most of the dealers I saw need to be trained for dealing as their work was slobbish, lackluster and just horrible to watch. I have grabbed clips to show to my dealer when training on what will not be an acceptable performance), the conclusion to the hand of forfeiture of some of the chips from the all-in was confusing but again I think is specific to the venue. No cheating took place, just a quick hectic confusion.

It's fine if he doesn't wanna make a big deal out of it, but the facts are the actions Phil took were technically cheating. Even if he didn't mean to muck his hand, pushing forcefully the cards faced down forward across the line as he did is a folding action. Even the commentator first said "Phil folds". If he didn't mean to cheat he shouldn't have hustled slime for that 5k but should've instead acknowledged how the play he made looked.

When Amber Heard loses this case, she'll be the first celebrity to be legitimately "canceled." Her career is over.

    • @cluelessmango768
      @cluelessmango768 Před 2 lety +4

Plenty of celebrities have been 'canceled' over justified reasons. Also, I don't get why suddenly people want just Heard to have her career ruined, like, it is apparent to me from what I've seen that they both abused eachother, so if anything, they should both get canceled, or neither, or whichever ends up losing in court, though even then people should keep in mind that not getting charged does not mean you didn't do anything wrong.

I think part of the reason people kept talking about the Phil thing is because he was being such a stickler and playing like it was a group of professionals. He kept telling the dealers how to do their job, yet he pushed his cards over the line in a way that almost everyone at the table interpreted as a fold and refused to even say "My bad".

  • @KyrkRTG

With the Depp vs Heard case, while almost everyone has the consensus that Amber abused Depp based off what has been presented to the trial so far, it's still going to be an uphill battle for Depp. The lawsuit is not to prove that she's an abuser, but rather if what Amber specifically said in the Washington Post op-ed met all the criteria to constitute defamation, most importantly if Depp abused her.
Defamation lawsuits are one of the most difficult cases to win; if there's even a smidgen of evidence or testimony that convinces the jury that either Depp abused Amber - no matter what type or how "minor" it was in comparison to what Amber did to him - or that Amber legitimately believed she was a victim of abuse when writing that article, then it doesn't constitute defamation and Depp likely loses.
That being said, Depp and his team have been doing a good job so far proving their case and gaining the jury's favor and I'm rooting for him.

      @pollytix7271 Před 2 lety +1

I'd say that it's a good thing that the bar for defamation is so high. There are countries where you literally can be prosecuted if you factually point out someone's criminal record and criticize them for it. Facts are criminalized even though freedom of speech is supposed to take precedence.
