- Malawi's Minister of Homeland Security Richard Chimwendo-Banda has signed the extradition papers for Prophet Shepherd Bushiri and his wife Mary Bushiri. The South African government asked the Malawi government to send the two to South Africa where they are to answer charges of fraud and money laundering. The two jumped bail in South Africa and the South African government has been pushing to have them sent back.
However, the court will have to issue a warrant of arrest for the two to be detained and sent back.

You are wasting your time hoping for Bushiri and his wife to land in RSA. The powers are in the hands of the Malawian courts. Bushiri's lawyers will give valid or strong arguments not to have them extradited. Once the judge says NO, the government can't do anything. Signing documents from South Africa is just acknowledgement of receipt of the documents but the battle will be in court- Malawi has got its own laws to protect its citizens and the country has an independent and a professional judicial system.
People must understand that he committed crimes where his ECG members want theire monies . South Africa as well ss Malawi are are following what the law prescribed. He must prove to the Court without resinable doubt that he is not guilty . This will be difficult for him since he run away

THE SIGNING OF THE SOUTH AFRICAN FORMAL EXTRADITION LETTER BY THE MALAWI'S MINISTER OF HOME AFFAIRS AND SECURITY DOES NOT MEAN MALAWI HAS AGREED TO SEND THE PROPHETS TO SASA AFRICA.

The Malawi's Minister of Home Affairs received the Extradition request from the Malawi State, on formal request from the South African State to act on their behalf, as South Africa currently does not have any power to use the South African laws to challenge the Bushiris as long as the Bushiris are in Malawi's territory.
In this case, by the signing of the South African Extradition Formal Letter, the State Of Malawi under the Minister Of Home Affairs has taken over the power of Extradition legal processes from the South African State, hence the State of Malawi will use Malawian Laws to face the Bushiris on legal battle of Extradition before the High Court Of Malawi.
That means before the Malawi High Court, the State of Malawi will be a main legal key player, while South Africa will be a mere Malawi State witness against the Prophets.
WHAT LEGAL ANORMALITIES/ MISTAKES THAT WILL MAKE SOUTH AFRICA AS A WITNESS OF MALAWI STATE IN THE EXTRADITION CASE TO LOSE BEFORE THE HIGH COURT OF MALAWI?

The Malawi High Court will declare the Extradition case, as AN INVESTIGATIVE CRIMINAL EXTRADITION COURT CASE.
What is the Investigative Criminal Extradition
Court Case?
It's a type of a case that Court of law obliges the criminal investigation on both sides, the accused, (the Bushiris) and the offended, (the State of South Africa), on how they treated each other from the time on which the HAWKS started and opened the alleged rape Case and Money Laundering Case investigations, until the time the Prophets declared themselves in Malawi.
What are the crimes committed by the State of South Africa against the Bushiris under the Investigative Extradition Criminal Court Case?
1. HAWKS Officials who opened the alleged rape case and the Fraud and Money Laundering case are the same HAWKS Officials who were accused by the Bushiris of extorting money from him so that they could not arrest him. The Bushiris opened the Extortion case at the South African Police, and the State of South Africa agreed on media.
On legal technicalities, This is a criminal investigation case that will nullify both the rape and Fraud & money Laundering case because these are the cases that were opened by the HAWKS Officials who were already accused of extortion by the Bushiris, and the State of South Africa did nothing to investigate the matter.
2. The lies by the South African Minister Of Home Affairs who said on media conferences that the Bushiris have 5 passports, and Fraud permanent residence, while the truth of the matter, the Malawi Minister Of Information defended the Prophets to have a permanent residence obtained through all legal proceedings, and holders of the only one each diplomatic passports, which protects them from passing injustices and judicial trial without imforming the country of origin, in this case Malawi.
On legal technicalities, this is also a serious Investigative Extradition Criminal Court Case that will expose the wickedness of South Africa before the High Court Of Malawi.
3.Improper adjournment of the alleged Fraud & Money Laundering Case against the Bushiris by the Kangaroo Judiciary without any legal technicalities.
Due to lack of evidence of the HAWKS and the State to accuse the Bushiris, the South African Court of Pretoria involved itself in the injustices against the Bushiris by not trying the Case fairly; leading to unnecessary Court hearing adjournments and strict unfair bailouts grants, due lack of evidence to incriminate the Prophets.
This reveals and exposes the Conspiracy of unfair judgment between the Pretoria Commercial Court and the State Of South Africa, with the HAWKS to make sure that the Bushiris are incriminated and declared guilty injustice fully.
On legal technicalities, the Malawi High Court will automatically disqualify the South African Judiciary to judge the Prophets, due to the legal negligence on fair trial and practices of judicial injustices.
This is a serious Investigative Extradition Criminal Court Case that will block automatically the whole Extradition Case.
4.The Bushiris Diplomatic Statuses.
Due to the nature of the respect, privileges and benefits accorded to the holders of the Malawian diplomatic passport by the Malawi State, the State of South Africa did not provide any security assistance to the Prophets as diplomatic citizens of Malawi living in South Africa.
This is a clear violation of diplomatic protection formalities by South Africa against the Bushiris which will cost a huge compensation that will contribute to failure to the Extradition Case before the High Court Of Malawi.
5.South Africa is still hiding relevant information from the Malawi State concerning the Prophets. As Malawi State will be a key player before the High Court Of Malawi, but it still doesn't have enough evidence to challenge the Bushiris lawyers before the High Court Of Malawi. Some days ago, the Malawi Minister Of Information accused the South Africa that they are not giving Malawi enough information to get the right legal action against the Bushiris.
South Africa cannot share the real legal agenda against the Prophets because they know that they don't have evidence to incriminate the Prophets before the High Court Of Malawi.
This reveals the weakness of South Africa which will lead to a shameless defeat on legal technicalities.
SADC LAWS ON EXTRADITION ARE NOT YET DOMESTICATED IN BOTH THE MALAWI JUDICIARY AND THE CONSTITUTION OF THE REPUBLIC OF MALAWI.
From the time that Malawi signed The SADC Agreement on Extradition with other SADC member Countries in 2002, Malawi never presented the said Treaty in Parliament to be debated and turn it into law, to validate the treaty into the Constitution Of the Republic Of Malawi, neither did the Malawi government gave itself time to amend its Constitution of the Republic to change its strict laws of Extradition to give room to accommodate the SADC LAWS ON EXTRADITION IN THE CONSTITUTION OF THE REPUBLIC OF MALAWI.
This means that even though the Malawi government signed the SADC Agreement on Extradition with other SADC Countries, The High Court Of Malawi will automatically follow what is written in the Constitution Of The Republic Of Malawi, without considering the SADC Agreement on Extradition.
Remember that the Malawi Minister Of Home Affairs signed the Extradition Document on behalf of the South African State, so that Malawi can use the Malawian laws to Extradite the Bushiris to South Africa, and not the SADC nor the South African Laws.
Now the Constitution Of The Republic Of Malawi, which is a supreme law of Malawi
Clearly States that:
SECTION 77.1
"No one shall extradite the Diplomatic Citizens Of Malawi unless for murder or treason."
This means that the High Court Of Malawi regardless of Malawi signing the SADC Agreement on Extradition will declare nullification of the Whole Extradition Court Case in favor of the Prophets because the Constitution Of Malawi does not agree with the SADC Agreement on Extradition.
LASTLY, with all the list of the Short falls of the South African State against the Bushiris while they were in the South African territory the High Court Of Malawi will declare freedom to the Bushiris with legal costs to the South African State for committing crimes against the Prophets before the Court Of Law declared them guilty.
