In California, speed limits outside of two-lane undivided highways up 65 mph/on two-lane undivided highways up to 55 mph, are prima facie (presumed), which means that a person may drive a vehicle above the speed limit if safe for the roadway conditions.

Exactly, pulling one care over out of a cluster of speeding cars is arbitrary enforcement of the law. I was in traffic court one time where another defendant used that as his defense and his ticket was thrown out. The judge said, "Pull them all over or pull no one over."

@@Macboy12321 that literally defeats the purpose of speed limits on limited access highways, which should be to ensure that there's not a lot of deviation from the average speed. by choosing to be the only person not going 20 above the speed limit, you become much more of a risk to everyone's safety than the person going 40 above the speed limit
