    How I obtained a copy of your VA Summary/Breakdown letter to include the diagnostic codes.
    I called the VA at 800-827-1000 and inform them that:
    “I would like a summary letter/disability breakdown letter to include, all my service-connected conditions, percentages and diagnostic codes.” (If you are not service connected, you will not have one). Also, you can have them email or fax (if you don’t have a fax at home, you can download a fax app in the play store on your phone) this information, if the person doesn’t want to email or fax it, hang up and call back and speak to someone else.

    Yup this is exactly what happen to me. My flat feet, bunions and tinnitus were all service connected but my ptsd got deferred. They needed a personal statement from me and they scheduled a c&p exam. Deferred is better then a denial.

    Very helpful Dewayne got one SC , three denials ( two denials because of error , C & P examiner used wrong MOS ) and four deferrals - going to reread my rating decision letter now very carefully . Thank you .

      Make sure you look at the regulations they used to deny the claim. Are they still active regulations.

    Thank you SSG. I served 40 years ago and last year was made aware of what is available for veterans. Filed claim over year ago for decision this week. Tinnitus 10% approved because MOS (11B) Hearing loss 0%. TBI cervical and headaches (tbi) deferred. Wonder if I need nexus letter. Your videos big help in all of this

    This was a helpful video. I now understand what deferred means. My deferred claim is now being examined by a QTC psychologist. They say I will not need to be present for this.

    Mr. Kimble you are the best. I have learned so much from your videos. I had a deferral and was granted service connection for the other two disabilities. I want to file another claim( asthma secondary to sinusitis). I was service connected for sinusitis with a 0 percent compensable rating. Can you file a secondary to a 0 percent compensable service connected disability?

    Good afternoon Sir, I got my rating back for my PTSD with TBI service connected at 70% but 8 of my other claims are all deferred for the following Information: Exam.
    But nothing else is on page 9. The 8 things differed 7 of them were with one doctor from QTC.
    The dental records for my Gerd and dental erosion is documented threw 4 years of my service.

    This is exactly the experience I had, I filed a claim for Gerd and metal health issues.once I got my initial decision letter I was service connected for Gerd without a C&P exam,however my mental health decision was deferred.ultimately I was service connected with a mental rating

    5:17 Came to this video because your work is informative. My migraines claim got deferred. I also got the neurology doctor to fill out a migraines dbq, personal statement and treatment plan is in my notes. This was done at th va medical facility. What additional and relevant info? Is needed

    I recently filed for an increase. Within a matter of a few weeks, all but one of my claims was increased. The one claim was sent to QTC for evaluation. I immediately started receiving the additional pay for the increased claims, but when I check my claims status, it's still showing as "Evidence gathering, review, and decision." They still haven't sent me a decision letter, so I'm assuming, and hoping that my claim will still be approved. That single claim decides if I'm at 100% or not.

    The last slide is where I am. How do I have until I have to claim or prove the stressor? and will I be awarded the rating that is already given?

    I recently got deferred as well for my TBI the C&P exam Dr ordered a PTSD eval with a mental health Dr as well than my claim letter said my claim for increase for tbi rating was deferred for further evaluation, I am thinking they are evaluating the results from mental heath DR determine a possible increase, not sure

    I just got deffered. The reason says" for the following information: Pact Act". Have you heard of this or how long that will take?

      If you call the 800 number and ask them to look in the notes section of you electronic claims folder (which is in VBMS-A), maybe the rater put the reason for putting the PACT Act in the rating decision.

      I received the same statement for 2 of my deferred claims and neither have nothing to do with the Pact Act. My VSO submitted a Higher-Level Review to have them removed from that category and adjudicated.

    Hi. I just got my ratings back. I am 100% P&T but for one of my claims it gave me 30% but it is also deferred pending VA exam so I am confused. Can they reduce my rating after the findings?

      There are more questions I have to that. For example, how long the the 30 percent has been in effect, if it's reduced will it cause the 100% to drop, and do you know the criteria for the 30 percent or higher percentage for that condition.     I filed three supplemental claims. Two were denied one was deferred. According to the m21-1 reference that should not have occurred. What can I do?

      I didn't hear you say you obtained a copy of your claims folder or where your conditions fall under the five ways of service connection or that you read the notification letter where it explains your options. This is a process. The VA gives detailed information in the notification letter.     So when you get more medical records do you submit it to your claim or what do you do to make sure it gets added to your claim

      @@DewayneKimble I made one mistake and I trusted my VSO and it but in rear, she submitted the wrong claim on two different claims. She was more about getting the claims submitted then get the right ones done correctly. Now I have to go and do it again but the right way. The biggest thing is that I'm not able to get my C file and review it. VSO won't let me see it.
      Second problem is I had a really bad c&p exams, and one I had over zoom for PTSD and she couldn't hear me half of the time.
      So now that claim is been deferred and I have another one deferred.

    Just did a C&P exams for migraine and given 0 percent. During the exam I explain to the examiner I have migraines once a month. I also explain that the headaches force me to lay down until the pain meds kick in which could be hours. I receive the dbq and the examiner wrote everything down as stated. He didnt mark my condition as prostrating but documented me laying down debilitated from migraines in the DBQ. He also states my condition effects me economically as well. Im I misunderstanding the meaning of Prostrating? Or did the examiner inadvertently check the wrong box?

    Got 3 deferred for medical opinion and clarification. VA called me and stated the raters need more info from my doctor (she did DBQs for me). Hard to believe they actually called!

      Thanks. Im % capped out😊, so deferrerals will determine a better retropay (back to ITF). DK I've pursued all my claims on my own. VSO did little to nothing. However, was impressed with my knowledge level. That came from research and study, video such as yours too. In a way, I looked at the process similiar to getting hired for a job. Study the company, what do they want and need, get informed, whats the hiring process and build a solid resume tailored to the desired outcome. Of course,, change my words to CFR, DBQ,
      appeals outcomes, etc. Just like you teach.

    I got deferred (additional development). I didn’t hear you address this. You said under development. Is this the same? What does additional mean. I sure hope I don’t have to add 4-6 months like you said.I already had a QTC appt for this back when I filed in January. Do you think I may have to do another QTC exam? In your experience, do deferred cases get more approved or denied? I know that’s not gonna be exact. Just asking what you think the percentage is on them.
    Sorry, I know that’s a bunch of questions. I guess if you want to just answer one of them, what’s the % of deferred cases being granted? Like a ballpark figure? Many thanks my guy. Appreciate what you do with this channel.

      I think I did mention it in the video. There are some many different types of development. Yours could be different from the next vet. When I rated, I would say to obtain an addendum from the examiner. Deferred can be a bad or good thing, it depends on what is going on with your claim. One would have to know all deferred claims, which is in the high six figures and what is going on with each one of those claims.     I just recently got the my decisons letter for supplemental claim. Tinnitus - continued and confirmed (denied). The issue for PTSD is deferred for the following information: further development. I called 800 number, they said they didn't need anything from me. What now?

      In the rating, they should have stated why they deferred and now it's a waiting game. Remember the people at the 800 number are not rates and do not know if the rater needs anything.

      That's not on combine but the rating would have to be reviewed, along with everything else you are service connected for.

    I filed a claim for OSA secondary to to service connected GERD & Type 2 Diabetes secondary to service connected Hypertension. C&P exam completed, claim deferred due to pact act. I am a Gulf War Veteran. Are these conditions related to the Pact Act?

    Goodmorning. I got 3 denied and 3 deferred. Should I contact my VA rep about this or will they contact me because for the deferred it says it “examination required” . I got denied my tbi residuals which I find weird because after I hit my head I started going to medical for migraines and got 50% for it but denied tbi? How does that work

    Do I still get paid for the approved claims while I wait for the deferred claim to process ?

      When the overall percentage changes, there should be back pay, unless there is a debt or something.
