Arizona Supreme Court Delays Enforcement of 1864 Abortion Ban

  • The Arizona Supreme Court granted Democratic Attorney General Kris Mayes’ request to delay the enforcement of an archaic 1864 near-total abortion ban in the state. The law would criminalize all abortions, with the only exception being if the pregnant person’s life is at risk.
    ‘I am grateful that the Arizona Supreme Court has stayed enforcement of the 1864 law and granted our motion to stay the mandate in this case for another 90 days,’ Mayes said in a statement.
    Mayes’ office said the 1864 law had previously been slated to go into effect on June 27; however, her 90-day stay paired with an additional 45-day stay from a separate court case has now pushed that enforcement date back to September 26.
    Arizona Governor Katie Hobbs has signed a repeal of the law. The issue is that the repeal can only go into effect 90 days after the Arizona legislative session ends, and it is currently still in session.
    Per NBC News, last year’s legislative session ended on July 31, so depending on when this year’s session ends, the ban might only be enforceable for around a month, if at all.
    Mayes has said that she and her office plan to ‘consider the best legal course of action,’ which could include trying to bring the case before the U.S. Supreme Court.

    Republicans talk about how we’re “killing babies” while they ignore the mothers in danger. It’s a delicate situation and doctors need to be able to do their jobs and help save American lives. If a woman doesn’t have the choice, can doctors at least have the right to provide emergency abortions??

    One thing that isn't pointed out is this: in 1864, a woman generally didn't know she was pregnant until several months, and almost certainly past the first trimester. Back then, they were banning abortions of a potentially viable fetus. They were absolutely not banning or regulating a woman taking abortifacients in order to terminate a suspected early pregnancy.

    If you've got this situation coming into your hospital/office often then you need to really check out the issue of prenatal care and environmental issues.... this is not the norm and it's not even a high rate of occurrence Women aren't going to die. Babies will live.

      @@ladyofbast250 the majority of contraceptives are almost 100% of 95.97 if used correctly and if you can use the phone you can figure out how to use contraceptive correctly. If you make it a priority to use your contraceptives correctly you will not get pregnant

      No, she didn't. She was not allowed a choice. After 5 births, 2 miscarriages within ten years, she turned to alcohol to cope with children and a no show deadbeat dad. . And just to let you know, I wish she had been able to abort me. I wouldn't have been subjected to abuse from my dad's second wife. By nine I was hoping I could die, by 12 I tried to unalive myself a couple of times. By 14 I ran away from home and lived on the streets. Learn more about reality. Women should not be forced to have a baby they know they won't be able to properly care for. Unless YOU want to adopt them all.

    This isn't keeping doctors up at night. Again extremely rare. And in most cases they know what to do. Her job is to come up with these rare exceptions and then make a plan.
    But it seems like all she's interested in doing is trying to deny the will of the people and fear monger.
