      Hi fellow expat don't buy any building, structure or house if you don't own the land. Yes it's a fool's game to let a Filipino or any woman use love to con you. Never mine what pea is saying I am reading between the line. The entire Filipino strategy is gear on exploiting the expat. Don't make a move until their government change the law. In fact expat government should do the same as what their government is doing to expat- no land ownership. To own house/Building and land apply for citizenship and don't use trust and love to govern common sense. If you don't own the land out right don't build or buy the the structure on that land. Yes it's nice to live there but don't get played by feelings . Just enjoy yourself and get out of dodge. Why invest in a third world country that is unfair to expat or looks. If your not Asian your just a mark believe me

      Ex fipina wife bought 80% of our land
      Me..foreigner ; i put 20% money on it ( i also put my name on title as the foreigner husband)
      AFTER 5 years and DIVORCING IN CANADA..FILIPINA LAWYER in iloilo office TOLD MY EX FILIPINA WIFE and me THAT SHE SHOULD BUY ME OUT of title paying me my 50% marital rights. Otherwise with my name on title...she would never be able to sale without my permission...or my white kids fro. White ex could claim in future.
      if you do thing right...you can claim your 50%....pea and lawyer are 100% givin good advice.
      Just be smart guys...do everything with lawyer..but most important..marry UNICORNS.

      Or, if you've been married for a long time (15 - 20 years) and are in a loving relationship and are going to build a place to retire AND you didn't marry a woman half your age who would be a huge prize if she owns land and every guy will be trying to win her heart, AND you have made this a joint vision for both of you, then it's safe if she comes from good family and is a good person where divorce or even separation is not acceptable except for cases of abuse.
      My wife and I are doing that, already have the property and are building the home in a couple years. We live is the US and she makes a pretty good salary so it's been a joint thing for us and have been planning it for about 5 years now. About 3 acres (a little more than a hectare) with agriculture so it's revenue for her family. We have our own streams of money and don't want to make money in the Philippines which could then become a tangled mess with taxes. A big house, which includes her family living there. Keeps the expenses low, allows us to travel, I'm not worried about the property because her family is going to inherit it anyway, but house will be in my name so if something happens to her, I'll have the right to be in the house until I pass, and it was my wife who told me to do it that way (without mentioning negative sides that could happen because that's not the Filipino way in conversation).
      For the person who goes there to spend many years and wants to meet a person while there, you're 100%. I wouldn't do it any other way, and don't have a live in because they can take half your revenue streams. Not saying they will, but they can. And you can't get a pre-nup unless you marry.

      There are ways to buy and not lose everything read my posts. Use a lawfirm and corps. Put the house and improvements in your personal name 100%. Prenups and postnups. Don't be dumb! Do your due diligence and protect your investments and assets.

    Hi Pea, some of my comments concerning on building a house, here. I decided to build a new house, because I wanted to know what I was starting with. We bought 2 lots out of a large group of lots. We created a 600 sqm lot, and built a 200 sqm house. The first thing was, we went to a lawyer. The first thing she found out was, the owner of the large section of land owned back taxes. Here in the rural land the property doesn’t have what we in the US normally think of as a, “Title Document”. What we get is called a, “Tax Declaration”. It does the same thing. The lawyer had to go to court and make sure the property owner paid his back taxes so we could take legal control of the lots. When that was taken care of, the property was put in Kris’s name. I signed a 25 year lease with an automatic 25 year extension. The lease states that I paid Kris $10k for the lease. The lawyer told me the $10k statement would satisfy my requirement for my SRRV. She had processed other SRRVs and I would not need to make a bank deposit, before I bought the property lease. The PRA told me that I still had to make the $10k bank deposit. Once, I did that, I could take the money out of the bank and buy the lease, I had already purchased it. Two alternatives were to marry with Kris or keep getting 3 year extensions to my Visitor’s Visa. The SRRV typically for me would cost the $10k deposit plus $360 each year. What changed the picture was when The PRA happened to ask me if I was retired from the military. I just thought I would cover all bases. I mentioned that I had not been in the Philippine Military, so probably would not quality for any advantages. My first time to the Philippines, (1975), was when I was in the US Air Force. I spent a night over in Clark AFB outside Manila, on my way back from, half a year in Northern Thailand near Udon at Udorn RTAFB. PRA said my US service qualified me for only needing to deposit $1,500 to the bank and only $5 per year to extend my SRRV. So that changed the picture. If you are hoping to get a SRRV here, and you have been in the US military. Make sure you mention that, you can save a lot of money on your SRRV. I am not a medical doctor, but I play one on the TV. I think I had a microvascular ischemic, about a week ago. It kind of makes a challenge for me to write. Sorry for being so verbose. One more thing for me to mention. One of the things that I bought, maybe 4 or 5 years ago, was an electrical generator. Typhoon Odette came right over Dalaguete. This part of Cebu was without electricity for about 3 weeks. We became a, “Charging Station”, for a long way around. At first, we had to travel to Dumaguete to get gasoline and the ATM machine. That generator supplied us with our gasoline, electricity and food. We even had some PNP Officers come to our house to charge their phones. We also sold barbecue and soda to our customers who were waiting for their things to charge.

      Been there done that, lost a house and lot, foreigners don't buy the property it is not yours, one day she'll get rid of you, just rent period.

      I can only agree and advice any foreigner to rent - it has so many advantages over buying, it's cheaper in the long run if you get into troubles with your Filipina, and you have the freedom to move around the country at any time...

    Great topic and a ton of useful information! Honestly I feel that a foreigner needs to understand that any land, property, bank accounts and any purchases that he has made “in a foreign country” are at risk and obviously not protected to his advantage. He can do his prenup and hire lawyers and take every precaution possible but he is still at a disadvantage and should be aware that he could and might loose it all. My point is, he should keep his assets in his own country and only risk what he is prepared to loose.

      I agree with you, avoid the unnecessary bs and just transfer what you need when in another country and keep your principal assets in your native country. Just rent and don’t invest.

      Just Google who can own land in the filipines. Don't buy land or building there or any structure. Don't even buy a condo there you don't really own it you own a time slot and just for a limited amount whast a big scam

    As an American I would never buy a house or lease in any foreign country because you are at the mercy of that government and whatever changes they might happen to make. Personally I believe this law in the Philippines against foreign ownership protects the Philippines. If I were to take up residency in Philippines I would rent even though I have never rented in my life I have always owned. Good information. Think when you are considering living in another country and always be prepared for relationships to fail even if your relationship seems so perfect.

    The problem with all these comments here is that it mostly comes from foreigners who are with young, dependent Filipinas. I am a university graduate Filipina married to an American and currently living here in rural Missouri. Together we bought a 16 acre farm. I am gainfully employed here in the US as an assistant to the president of an investment firm. Before I met my husband, I have had an active career in Manila and even then, was financially independent. I have two boys that I raised that to this day, has never needed money from my husband. We are planning to retire in the Philippines and indeed, buy a good-sized land and build our forever home.
    The key to this wonderful life is to find a woman that is your equal and do not need you to survive even on her own. I understand that even here in the USA, there are white women who marry men because of that. So, anywhere you go in the world, the point of living life fully and wonderfully and happily is to find your equal. Use your head (upper) and your heart at the same time, and not one over the other. Mabuhay po kayo!

    Every man or woman who is thinking about purchasing a house (or any other property) outside of his or her own country should seek out a competent attorney. The money spent on attorney fees will save you money and a lot of future heartaches.     Gracie knows of what she speaks. Especially in regards to squatters. My filipina wife’s aunt had squatters on a coconut farm inherited from her ancestors. They had been farming the land for 25 years and felt entitled to it, even though they were paid by the aunt to farm it. A Philippine court sided with the squatters and they are still on the land to this day.

      Yep. I’ve seen this happen in Venezuela, Africa couple of countries , and Middle East. The people I knew in Middle East got them off the property but from what I was told weapons were involved.

    PRO TIPS: Don't get married just live together and always RENT, keep your assets ie: an owned property or properties in your Western country rented out to tenants or family members, keep your financial wealth in a Western bank account, and NEVER bring a Filipina and your children back to the West. NO EXCEPTION. If you stay in the Philippines you can be in charge and be the provider, if you bring her to the West she has all of the power and you're at the mercy of the government which ALWAYS FAVOURS WOMEN. YOU HAVE BEEN WARNED. Stay safe brothers & protect yourself AT ALL TIMES. Enjoy the Philippines, it's AWESOME. :)

      Its now safe to have money in a Philippine bank. as the international banking laws changed. At present, I do both. My main account here is in my name only. I also have a shared account with my wife. I transfer our cost of living needs each month. Every thing else I agree on. My money is insured for loss.

      Your talking nothing but the truth - well spoken. So many men are thinking with the small head than the big head. One think the only time to buy real estate there in the filipines is when the government change the rules and laws to allow expat to own land. The entire process of allowing native Filipino the right to legally steal your property is pathetic and western countries should do the same to them

    Only dats a Filipina. Live with a filipina for only 6 months or less. Never call her your 'wife'. Never let her use your last name. Never get her pregnant. Never buy her land as an investment or gift. Only lease land from the original land ownwr whos name is on the deed and only build a simple nipa style or A frame house. Or buy a Condo at 25 yr term. If you die its abandoned and the courts will give it back to the original owner. Or put it in a trust if its paid off and designate a RealEstate Agency to rent manage it for the profits to your estate.

    They sure have pretty attorneys in the Philippines! ;-) That being said, I wouldn't recommend anybody to buy property in the Philippines (been there, done that) for 3 reasons:
    1 - You can never really own it and constructions to protect your rights are expensive and complicated (as clearly explained in this video).
    2 - Every once in a while, the Philippines gets hit by a natural disaster. If you build or buy a house and it gets destroyed by a flashflood, landslide, earthquake or super typhoon, you will have lost everything. If you are renting, you just move on to the next rental.
    3 - The Philippines consist of 7641 islands. Do you really want to be stuck on one of them, just because you happen to have property there? After a few years you may have seen it all and prefer to move to another island.

    Us Westerners do not understand how important a house is to a poor women in an under developed country. It is not limited to the Philippines, but to most women in developing countries. We believe that buying them a house will result in an outburst of appreciation, when in reality there is good chance that you get the boot. This is properly more true when there is a large age gap. If you love your girl rent an apartment, stay single, make sure to have life insurance policy to take care of your girl who has taken care of you if you pass first.

      The problem with a life insurance policy is that you may find yourself getting offed prematurely by your girl or her family. It's better to offer motivation that keeps you alive, such as monthly contributions to your girls bank account while you are alive and well. The longer you live, the more she'll get for a house.

      A friend got a bullet in the head from his GF family ..... but lived. They hired a hit an who was conveniently killed in a police shootout so the family never paid for the crime (no hit man to testify against them) but kicked him out and stole everything he owned whilst he was in hospital....... I think the bullet lodged in his skull affected him mentally (they could not safely remove it)

    A spouse can not lease land to her husband under "Article 1490" under the civil code of the Philippines a husband or wife cannot lease or sell to the other in order to get around the land ownership laws. This is also reinforced under1646 of the new civil code of the Philippines.

    Many of the situations described could also happen in the USA, although not as common perhaps. Given that you cannot control what gets built around you, or who your neighbors may turn out to be, or needs will frequently change over the years, as already advised, just rent.

    Listen to the words on owning land in the Philippines 🇵🇭 foreigners because so many get angry and say that they can own land which is not true and they get so upset when told that they are dreaming. I wouldn’t buy land based on the attorney statement. 🙏🇺🇸

    Solution: Just rent the property that you live in, in the Philippines. Own the property you don't live in back in the west & rent it out. Also have a cohabitation agreement to protect your assets from resource redistribution.

      It would also raise the house prices to level where it's getting even more unaffordable for locals. I don't think its in general good to allow foreigners buy land. But they should have a loophole for small properties for foreign spouses.

      Yeah, this happens in the west as well. I have visited Vancouver and many foreigners especially Chinese buy real estate, and it has driven up the price that even local Canadians cannot afford to live in their city. I imagine this drives prices up in California and New York as well.

    So I guess I will address the elephant in room: She's almost at 10,000 subscribers and her first video was uploaded in early May of this year and her content so far has been informative, with parts humor and realistic. There are channels that are started by girlfriends and wives there, that lack effort and creativity and they are riding on the strength of the partners channel or how good their outfits and make up looks behind the camera 🤦🤦🤦

      If you buy land or house in the U.S, you don't own it. After you buy and paid off the property, you still have to pay taxes in perpetually. If you don't pay tax, the Government can take the property from you. In theory, you don't own anything.

    Great video. Foreigners beware. There are several channels on CZcams created by foreigners who buy their wives or girlfriends land and don’t appreciate what will happen if the relationship falls apart. I also see other channels where a foreigner claims he “bought” land and is obviously lying when in fact they have leased land. And congrats to you Miss Pea. 10k subs already.

    Interesting topic sweet pea ,I have a friend who rented a house 1 yr lease and my friend loves the house so he decided to put in new tile floors,ceiling fans in every room, painted rooms to his liking ,and did alot of landscaping planted many fruit trees.He really created A Shangri-la for him self ! BUT here is the bad news after the 1yr lease was up the home owner would not renew the lease ! The police came with the owner to Evict my friend so he was given 1day to get out then the owner moved right into Shangri-la 😧....renter beware my friend lost alot of $...

      That's not a Philippine problem, that's a stupidity problem with your friend. That same thing could have happened in the USA or Germany or France or the UK. It is perfectly legal for a property owner to decide not to renew the lease after it has expired. Your friend should have written a new long term lease with the property owner before investing in all the upgrades. Verbal contracts in these situations are worthless.

    Hi Miss Pea, this video is no surprise to me. My best advice for a foreigner is to just rent and do not get married. You cannot fight the system that was set up to fail you as a foreigner … lol … Other Asian country’s around the Philippines do invite foreigners to invest and own a little piece of paradise in their country. The Philippines are still living in the old-world system, still using pencil to paper receipts just about everywhere you go and they can’t live without a calculator. Please don't take this wrong because I love the Philippines, I have a life time of friendships there ... 😁😁😁

Your only justice in the filipines as a expat is personal justice if you know what I mean and not to expect anything . My advise to all expat is to enjoy the moment and cross your fingers bc your really never never never safe .     Thank you very much for the informative video, Pea. We have squatter's rights in the USA to guard against the owners ignoring their land. A person can take ownership of someone else's land if they occupy or use the land over a 10-20 year period, depending on the state. The government can also condemn the property and/or take ownership via eminent domain. I respect the Philippines for guarding their land. Keep up the great work, Pea.

    Sorry to say, but even with all the prep work, honest lawyer, and all the right paperwork it is still a legal minefield to buy real estate in the Phils. In my personal experience, it all comes down to what kind of judge you end up with when the 'excrement hit the aircon'

      In a legal action, you can be 100% right and lose, or 100% wrong and win, or anything in between. Not for the feint of heart. You have to be ready to fight for your rights if required, and ha e the funds for legal fees for those tasks you are unable to do for yourself.

    These conditions exist even in the USA. I lived in a southern state and down there, farmers that had too much land(yes, there were farmers who'd lose 2000 acre lots that they planted cotton on, and forgot where they were, too much land) and they'd turn them into "squatter farms". Basically, people could buy leases on the land for 20, 40 or 50 years. Now, this is going back about 30 years ago, but my family down there say it still is happening, just not as much these days. And basically, they could, for the duration of their lease, build on that land or do picnics on it or whatever they want on it as if it was there's, but they never had a title to the land. Only a lease. So even before my first trip to the Philippines and witnessing the many "squatter villages" here, I was already familiar with squatter communities.
    What I am waiting to see are the single unit condos, townhouse condos and duplex condos to start being built. These are popular in the south. There are a lot of them in Branson, Missouri. So instead of needing to move into a tower condo, you can get a condo that is in a format with less neighbors to worry about being pains in the butt.

    It's probably smart policy to not allow foreigners to buy land in the Philippines, because it keeps foreign entities from taking over entire provinces for development. It would be nice at some point down the road, though, if expats who intend to establish permanent residency could either buy 'X' amount of acreage like former Filipinos who move back after living abroad, or enter a contract for nationally leased land long term and own a home like in Hawaii.
    I'd be all in for a system that required a minimum of ten years leasing, and proof of both sufficient savings to keep the property from going into default, and applying for permanent resident status in order to own property in the Philippines, if it ever becomes an option. It's probably just a fantasy to ever think that will happen, but I still have ten or twelve years before I need to finalize retirement plans. Maybe things will change down the road. ¯\_(ツ)_/¯

      They mean to do all this by offering “retirees” the best quality of life in an attractive retirement/investment package. And, if you think you’re not old enough to retire in the Philippines, think again. The Philippines retiree’s visa is one of the easiest to get, with one of the lowest age requirements in the world - just 35!

      You don't want investers, and developers buying up land, but if you retire there, and plan to stay there and not flip houses for profit I wish they would come up with something. Not going to hold my breath however.

      I think it would be a good idea for foreigners to be able to buy and own land in the Philippines especially if you are married to a filipina.

      The Philippines land mass is equal to the state of arizona . Its a good thing only citezens can own land .
      If not Philippines would not be the Philippines. Its bad enough with swedish and Germans married to pinays
      Grossly over paying for lots thinking it was a great deal .when actually they got ripped of badly . Then the prices sky rocket . They then in turn try to sell a house worth 60,000 for 300,000 to recoup their over cost purchase .

    When I visit Philippines, my favorite hotel is THE GRAND OPERA in Santa Cruz Manila.
    But my favorite CONDOTELL is in Quezon City near Trinoma Mall - the GRASS RESIDENCE.
    When I stayed there last July, it cost me $15 per DAY to rent a one bedroom out of the Grass Residence. It had 2 bedrooms and multibedrooms, but I only needed one. The living space was small, but the amenities were UNBEATABLE for $15 a day. 6 large pools, basketball court, gym, etc - and very close to 3 malls.
    If I ever would retire there and was pulling in $1000 a month of spending money ($500 for rent and $500 for expenditures) I know I'd be comfortable there but I also know as a foreigner we can't buy anything there and own property. Considering what you can get for $500 a month, that's all I'd need.

    A foreigner would be a fool to build a house on land he cannot own unless he has a minimum 40 year lease. But better get an attorney to draw up the contract. Renting a house is by far the smartest thing to do as when things go south (and they eventually will) he can pack up and get out of dodge quickly and not lose anything but his time which he won't ever get back. TRUST has nothing to do with being Smart. Great info from the attorney here and good info as most land in the philipines does not have clear titles and many liens against it. Better a foreigner to hire this attorney if he's dead set on building on his gf or wife's land. PROMISES ARE MADE TO BE BROKEN THEY SAY..and they do.

    Note to anyone traveling to PI: the Western (well, American, not sure about other western countries) the "uh-uh" sound which mean's "no" actually means "yes" in PI. Pea's guest does this a lot, as well as demonstrates other charming characteristics of the Phil speech.

      It is my understanding the lease can be renewed one time, for another 25 years. State that it is renewable at your discretion under the same terms and conditions in 25 years and make sure you give written notice ahead of time, at least 90 to 180 days, that you will renew it. Make sure you state in the lease the property cannot be sold during the lease, or if it is sold with your written authorization, the lease remains in effect under the same terms and conditions. Additionally, make sure it is assignable and transferable for you. Are you going to be around longer than 50 years? Most likely not so who cares after 50 years. But the improvements can always be in your name so the house cannot be sold out from under you as long as you keep the original documents secure. Make sure you keep all these documents in a secure location away from everyone including your family. CYA! Do NOT trust anyone else! Have your own personal lawyer that no one in your family knows. You want to make sure they are acting in your best interest.
      If you are giving someone the money to buy the land and lease it back to you then make sure your name is also on the bill of sale for the purchase of the land, that requires the owner to have your permission also in order to sell the property.
      Double-check with a good real estate attorney there, but this is what I have been told so far from a couple lawyers I talked too. Keep in mind they were not retained they were just giving free advice so I am not totally sure all of this is exactly what the law is there. But they seemed knowledgeable.

      I think it was clearly stated it is possible to get One and only One 25 yr extension on the lease but those provisions must be stipulated and agreed to in writting by both parties at the time the original lease is written up.

      I heard that the Lease goes back to the property owner if the Foreigner 'dies', so imagine how awkward it is if the family had a feud with the Foreigner.

    It all comes down to common sense - something lacking in a certain segment of the male population. Your previous videos address the vast differences one needs to seriously consider before even thinking about transitioning to any culture sometimes polar opposite of his or her own. Traditions, customs and laws in the US and Europe are not automatically portable to either the Philippines or any other country for that matter and this is the first mistake foreigners make : to think that their hubris and sense of entitlement really are universal and apply to every country in the world and that their perceived grievances and ways of solving disputes take priority over the locals'. Couple that with the rosy glasses they choose to wear as soon as they get off the plane along with the sandals and flowered shirts plus the exotic young thing they are so proud to display to their geriatric friends back home and you have a recipe for disaster. There are so many undercurrents at play, especially when it comes to land ownership and its implied inroads into wealth, status and security, I am sure books have been written to bring light on the subject.     The unfair legal treatment of foreigners as to land ownership has dissuaded me from relocating to the Philippines. I had seriously considered it, but I prefer to purchase a house outright rather than renting it long-term. I'd not feel secure in such an arrangement.

    Sounds to me I need to rethink everything before I come there. My fiancée wants a house, wants to have a baby, wants to start a business with me as the financial backer, a car etc. She is 45. Me 62 and in good health. I’m very iffy on a car and business and now the house after watching this video. I’m thinking I might need to end this relationship and just come over on my own. Are there not any women there just looking for a nice, financially stable guy who’s looking for a long term companion to travel with and enjoy life together. I’ll buy us his and her scooters and pay our way.

    I have talked to attorneys there and it is my understanding, as a foreigner, that if I married a Filipina and in the prenup, it states that if she dies, all the property goes to me the foreiner, then I have a reasonable amount of time to sell the land to another Philippine citizen and not have to give up any of it to others. I also understand if I did not sell the property in a reasonable amount of time, then and only then could the family attempt to make a claim against the property.
    QUESTION: Did you ask her about a real estate broker from Los Angeles California USA, going there and getting a brokers license, what would be required to become a real estate broker there?

      what's the definition of "reasonable"? Does it change from city to city, judge to judge, policeman to policeman? The lesson this attorney clearly states is all the details need to be in writing in a legal document. I would run away from any attorney, or real estate professional in the PI who used this word "reasonable" when describing my legal obligations.

    this information is great as i have been looking this up for nearly a year and only got about half that info. I plan on getting land in 1-2 years around Roxas city when i get married to my pregnant girl friend and want to set it up so that if anything happens the land will go to our child with me as the guardian and with me owning the buildings. I will be contacting Gracelyn to see if she knows of a good lawyer in my area. Thank you for this valuable information. I plan on being in the Philippines for many years as i am 44 years old and even though i am a Disabled combat vet from the US i am in relative good health (i have a bad back and right leg).
