As a former Deputy and TCOLE Instructor. When asked if you know why you know if you were pulled over, the answer is always No. After that, be polite, follow the officer's lawful instructions, give your ID and proof of insurance only. Do not answer questions. Once your property is returned, ask if you are being detained. If not, go on your way.

much thought and wisdom with your comment.
i retired after 20yrs in 2008 from an urban florida dept.and then went to the sandbox of afghanistan for another 9yrs. the 2nd career was by far.."far" better than tickets, DV calls, accidents.
i believe i was always proper, fair and respectable. Mr. PI guy is spot on with his advice. could tweak right or left, but that is just me.
yes-at the auto store get a visor gurney that holds insurance, registration and a color good copy of your DL. yes, people do forget the DL. at least before DEI, many cops were former military-they see something organized It is "good to go" and "squared" away.
laminate both the registration and insurance. a $5 pack of laminate once ever 5yrs will not harm you.
each person should be independent to assert themselves (assert is the word). here is all the docs you asked for officer. i chose not to answer any question. if you pulled me over for XYZ, please provide the citation and can both leave.
yes today most is on bodyCam that is good for both. believe me such. i will say this:
Mr. PI is working with the assumption that you are dealing with a proper, educated and trained officer. folks-it is not so. especially today. you have persons becoming an officer hence it is paycheck and they can push their personal agenda of XYZ of whatever it is.
remember that. yes, follow the rules he provided and insight here..but many with roid rage, attitude and many female officers that will speak to you like you are their 10yoa child with a dirty room. i get it Mr. PI can not do a PC dance and say those things. they are a factor usually in bigger city's.
anyways-informative information. mr PI is spot on. one reason this will never, ever and i mean EVER happen to me and pulled over and such.
i retired and moved to argentinia. 60% less cost of living. no crime in my ocean side city. cops sit in the park with an empanada.
3+yrs here and have seen three traffic stops. 2 of them was hence the car broke down on the road.
      paradise.
      otherwise "enjoy"!

      @krane15 Před 28 dny +6

Correction: the response should be as little as possible. The means "no comment." Or just plead the 5'th. My lawyer has advised me not to talk to the police unless they are present. Now the argument is with the lawyer, not you.
Too many people talk too much, and tell police way more than they need to know. The more you talk, the more likely you will be to incriminate yourself. Not only that, your taking will also prolong the traffic stop. The cop, has all day. Never try to outsmart the cops. He has nothing to lose, even if you prove him wrong. He can (and many do) still arrest you just out of spite.
Remember, silence is your single greatest defenses against a tyrannical system and the cops. Never let a cop trick you into surrendering that.

There's a video on CZcams that shows three or four AAMs being stopped on a Door Dash delivery in Wisconsin. Why were there four people on a food delivery? I don't know, but it's not illegal. There were several officers and a considerable amount of time passed before an officer asked a backseat passenger for ID. After the passenger asked if he was legally required to show ID, the officer answered honestly but it was also the first time the order of marijuana was mentioned.

You're not obligated to give any explanation of why you don't consent to a search. The fact that the officer has to ask is proof that they have no legal claim to search. If they had a warrant or reasonable suspicion of a crime in progress, they wouldn't need your consent, and they wouldn't bother asking. So, in keeping with the Fourth Amendment and the Supreme Court, you can just refuse to grant consent. Be aware of the ruse they often use in asking, "Do you mind if I search your vehicle?" If you say "No," linguistically speaking, it means you don't mind if they search, even if you meant, "No, don't search my vehicle." If you say "Yes," meaning you DO mind, the officer can claim your yes was consent to search. So just say, "With respect, officer, I do not consent to a search of my vehicle." This leaves no ambiguity.

So what happens when the citizen choses to exercise their first ammendment right to free speech and ends up not being polite?
Is it at that point that the taxpayer funded servant gets butthurt because the now soon to be victim doesnt bow down and worship the cop enough that he/she then retaliates and escalates?
I understand the advice given and it does actually make sense but why are we encouraged to be polite and say Sir when they steam roll everyone and call their prey by their first names.
My opinion is that if theyre cool and respectful as servants should be, theres no reason not to return the favor.
If they treat citizens like gatbage, use your mouth, stand your ground then file a lawsuit for whatever rights his worshipfulness violates.
These days, its the American way.
They do not own we the people!
We can let them do their job but we are not accountable to them, they are accountable to us!
Also whenever they go to walk away, always make sure to give them permission by dismissing them.
Sorry to sound bitter but just my two cents and the one time I got pulled over, I stood my ground and told them that beyond providing legal documents as required by law, nothing else was their business and I dont answer questions so dont bother asking!
Law enforcement in this country, our country have gotten totally out of control. We need to exercise our constitutional rights and keep them in their box.
This bending over and placating their brittle and easily wounded egos I - WILL - NOT - DO!
    But to each their own.

AINAL TINLA. Do not say "This is not my car" under any circumstances and especially not under the threat of a search. The best answer to "May I search you car" is simply "With due respect, No you may not". If you say "This is not my car" then it will create a suspicion that the car is stolen and also will diminish 4th amendment protections. It is important that your "No" is clear and respectful. Saying something like "I'd rather not" or "I'm not comfortable" may also diminish your 4th amendment protections. Being clear about saying "No" makes sure that anything further that you might say won't be construed as implied consent. Also, at this stage, don't volunteer information other then your name and drivers license while being polite and respectful.

When pulled over, keep your hands visible. Don't give them a reason to have concern that you are reaching for a weapon, even if you are searching for documents. You may want to search for your documents as they approach but they will only see you frantically searching for something and won't know for what ... papers, a pistol, a can of pepper spray? Sit still and keep your hands visible. Let them know, verbally, of every action you'll perform, then do it. As noted, don't make their job easier by confessing to the crime. If their radar gun wasn't working but you admit you were speeding they can confidently issue you a ticket without evidence beyond your confession. Their lack of evidence will more likely get you off than cooperating and confessing to a crime of which they weren't even considering. When asked for documents, tell the officer of your intent to, say, open the glove box and get them. Open the compartment and pause. Let them look inside so they can be assured you don't have a pistol for which you'll reach. After a pause slowly get the documents. Be polite, but not obsequious. They won't be fooled by fawning behavior. If you make t clear tht you want to allow them to do their job quickly and safely (nonetheless while still defending your rights) they'll often make an effort to make it easy for you. Make their life difficult and they can legally hassle you ... they'll claim you crossed a line, that they smell alcohol, that they smell drugs, call for a K-9 unit, or pressure you to submit to roadside sobriety tests and searches of the vehicle. Never perform a roadside sobriety test. They are not mandatory and are completely subjective. If the cop wants to arrest you and you perform a roadside sobriety test they'll invent an error you committed ... and be allowed to do so. Refuse to do a test and they'll be without cause. Be polite and somewhat agreeable, but stand up for yourself with respect. By the way, I've been pulled over half a dozen times and never gotten a ticket. Ever.

You do not have to answer any questions…. You also do not have give them your driver’s license or registration… you can press it against the window for them to see
You really do not have to be polite. Police are not your friends and should be treated as such

First take out your cellphone, and start recording before he gets to your vehical. even if its just sitting beside you and not capturing any good video. If your asked to get out of the vehical, there are mist often 4 simple things to bribg with you, Always take your phone with you, your car keys, roll up any windows, before shutting off your car and getting out, lock the doors and put key in pocket.
Your wallet and all money resorces. Last a coat in cold or bad weather conditions, because most often they may not let you go back inside the car. If people are with you leave keys with them but also tell them to take them with if they are asked to get out. A #5 I even seen people grab a water bottle to drink and set it outside on the roof or hood.
If your uncomfortable hold it up at least place it in your pocket with it still recording. This is why you automatically start if by,
I am sorry officer I dont answer questions that are not lawfully required ones. Anything else I say could be used against me, I would need legal representation. Also your responces should always i am not comfortable with anyone going threw my personal things, as they are not valued or respected as I personal do. Make sure you keep the officer on task, do not let them dtand around waisting time, especially uf there are two on site. Second always keep asking if your still detained, while reminding them a ticket should only takes15 to 20 minutes max, anything longer is a unlawfuly detainment, this is why if this is happening you keep asking if your frre to go. If theycdobt answer you then state out loud, officer if you do not answer weather I am beibg detained or still being, I am going to take your none responce as I am no longer being detainedxand I am free to go. Then at that poibt you thank the officer, wish him a good day and slowly attempt to be on your way. You must of course use resonable judgment as you attempt to go about this method. Example if he stated your getting a ticket and and has not started on the process, you instruct him that he is not engaged in his responsibility and his reasonable amount of time for this trafic stop is being timmed and he his reasonable time remaining is down say to 10 minutes and 15 minutes has already passed with nothing being done. All this can be used as defence if necessary in court. Also at this point you keep asking ever 3 minutes if he is present, the same gies fir any officer who may be assisting on scene.
Always remember you're not required to assist them with their investigation and not doing so does not make it legally into not cooperating.
Here's one that people Overlook all the time. You are not legally required to roll your windows down to allow them to test your darkness of your windows, that can be done at a later time with a certified dealership if necessary. Just take the ticket and worry about whether it's true or not later on. The crappy thing about Vehicles today is that there is no locking glove boxes or center consoles, you might want to consider buying a box or device that you can lock in the car yourself to put personal things into that you don't want snoop through. Warrants are needed in order to go into locked items. I myself have purchased two sholder over the shoulder sling daypacks, to put my personal stuff in, I ordered ones that included lockable zipper close with setable combinations for the main compartments. Plus I also got some simple self setting small 3 digit rotery padalocks I can also place on other parts on the bags or secure the back to a fixed spit so no one can just run off with them. Anything locked inside these bags requires a warrent for them to lawfully open. These bags work great for your wallets, other keys, personal medications. Also makes it 100% lawful for carring your personal firearm in a vehical with no actual trunk. This way if you do not possess a concealed wepons permit but want to take your fire arm with you and keep ut loaded, you will not be charged with any sort of gun crime. Remeber since you do not answe questions as youvstated to them you then also do not have inform them about what cobtebts are inside your vehical and you are totaly within the law and protected by the laws. Just always make sure the case is locked, even if the comb is as simple as all 1' and you only have a of them set on say a 3 and the others on the 1s, its legaly locked. Last do not make the mustake and buy the specialy marked locks for airports as they can easly be opened with a airport key devices and most law enforment will likley posses, they are normaly marked in red to notify you their a airport locking device. These sre usedxso your bags and cases are not damaged or locks cut off and then your stuff us no longer secure after inspection. These special locks also let you know or indicate weather anyone looked inside your stuff, only good part.

Why should drivers be polite to an official who is trying to ruin their day, or possibly their life? I'm not trolling; I think people should consider this concept they've been taught their entire lives. Especially if they live in the _"Land of the Free and Home of the Brave."_

Here is a little trick that works
    You're doing 80 miles an hour and a 55
You see a police officer ahead and it's obvious he caught you
Pull over the moment he knows you are speeding
90% of the time the police officer lets me go either with no ticket or something much less punitive
One time I pulled over so soon the police officer had to do a three-point turn to get behind me. :o)
However all this can be in vain if you admit to them that you were speeding or whatever the offense was
You can make small talk with them but do not admit to a violation
Also another little trick is this only works on male police officers not female
    YOU'RE HAVING WIFE/GF problems
Too many police officers that are reading these comments you know exactly what I'm talking about
You guys love honest people after being lied to 99% of the time every day

By law. Even if you give consent for a vehicle search, or tricked onto giving consent. You can resend consent. Once you do, by law, the police must stop the search immediately. If they don't, anything they find from that point forward. Cannot be used against you. The officer just broke the law. Then file criminal charges against them.
