I don't know about that. I'm not a lawyer so I could be very wrong here. But it seems like the prosecution has to convince the jury that what Trump did was willfully illegal. I can see the defense making the case that what Trump did was a sensible way of classifying the money he paid. Not legal, but not trying to cover anything up.

Witness testimony isn't important in this case because the paper trail is damning. There are checks to Daniels and MacDougal, and their are clearly falsified business records covering those payments.
