What Happened in Court Today? What Does it All Mean?

- Chandler (@remy_legal) is coming to you, after spending a full day, live, in the courthouse.
A grand jury in New Mexico has charged Alec Baldwin with a fresh count of involuntary manslaughter over a fatal movie set shooting in October 2021. Alec will stand trial in this series as we cover the case live.
The Allegation: Alec Baldwin received the firearm from David Halls, a safety coordinator and assistant director (not the armorer), and was told it was safe (He shouted 'cold gun', meaning the gun was not live). Interestingly, Halls had witnessed two negligent discharges (ND) in the days before the accident and had failed to take any appropriate action.
Also, in his position of Safety coordinator, he should have checked the gun was indeed 'cold' before handing it over, in my opinion. While the buck might stop somewhere else, he is still in the chain of negligence [and pleaded 'no contest' to the charge of 'negligent use of a deadly weapon',] and was convicted of that last year.
Baldwin did not check the firearm, and seemingly the person who handed it to him did not check it either. The armorer was not on set. The armorer should always be on set when firearms are being used to ensure safety protocols are being followed. Usually an armorer should give an 'all clear' once firearms are secured. There is scant information on whether Baldwin had the required on-set safety training mandated. Even if he had been using guns on set for decades, it's still required to go over things with an actor before the scene.
As an actor he may be culpable for the incident if it can be shown that he acted negligently when in possession of the firearm. However, an actor is not supposed to be a firearms expert. That's the reason why productions are required to hire someone who is. However, he was also a producer on the production, so in his capacity as producer, he might have some level of culpability. Especially as the armorer, Hannah Gutierrez, said that the producers overruled her and therefore created unsafe work conditions.
However, Gutierrez was found guilty of the misdemeanor of negligent firearm use. It is further alleged that she spent most nights drinking heavily and smoking weed and was very likely hung over when she loaded the weapon.
I was always taught to treat every gun is loaded , even if it is a toy gun you do not point it at someone else . This is part of Hunter safety .
Exactly!
Correction, "you don't point at anytime you don't intend to destroy"
@@cavemansnow4346 you should check out the Utah rule . My dad always got after me and my brother for this .
He's not a hunter tho.
He's an actor on a SET where nothing is real, and he's not even real. He's in character. You can see it on his face, when he's pulling that gun out. He's in that other reality.
To me, it's like me going to Disneyland, getting in their little cars, getting in an accident that kills someone because I steered it like it was a real car, and it went off the track, in the direction I steered, and killed someone.
Then I get accused of negligent homicide, and they say: 'You should've known that cars kill people if you steer it right into them!!'
Everyone knows you don't steer towards someone with your car!!
Well... Yeah... But
But in my mind, it was a toy on a set where everything is controlled, so it's not like a real car.
And what if they said: well you knew it had an engine didn't you?!
You knew it had wheels didn't you?!
Why didn't you check it?
You steered it and hit someone!
Yeah it has all the parts of a real car, I get it!! ...but, it's not supposed to steer like a real car! It's supposed to stay on the toy track!
I feel like that is the position Alec Baldwin was in at that moment.
I don't think it's a valid argument to say 'Everyone knows you don't point a gun at people' or
'Everyone knows to check it.'
I don't think anyone knows what it's like to be an actor on a set with a prop gun that someone else is paid to give to you for ACTING, not hunting. Not even for normal human protection. I don't think we can apply the 'everybody knows' rules.
Especially when we've already convicted the person who didn't do their job, and handed him a hot gun, but called it 'COLD!'
That's just my thoughts as we begin this trial.
But I'm still listening and learning.
Have you never seen a tv show or movie where a sidearm or rifle is pointed right at the camera?
I loved listening to Chandler. She’s fun and so pretty. Great time since it’s my first time knowing who she is!!
We love you Chandler ❤❤❤ (and Larry too🙂)-Great job today in court 👏 😊
When I took my gun safety course, I was told if you point a gun at someone, you need to be prepared for the consequences.
I can assure you the out of town attorneys will not get the locals at all. Native who lived in NYC… they absolutely need local help!
I agree also, Mr Baldwin should be accountable for both positions...actor and as the producer....death of a "employee" must have answers from every position....
AWESOME JOB CHANDLER. 👍
Chandler did a great job. She holds your attention, she's humble and she educates the listener.
Hi Chandler sorry I missed you earlier
The new power couple 😁
Welcome to NM - I got hooked during your coverage of the trial in MA, and this is gonna be an interesting one. ✌️
Great job, Chandler!!! Love you both
Good evening from Clearfield Utah USA . I hope to see you here in Utah i think that you guys would enjoy it here and see the beautiful mountains ❤❤❤❤❤❤

I understand it a lot better thanks to you Chandler, as an European it is a lot different over here and you explained it very wel and hook me in to follow this case❤❤
Between you and another friend, i cant get enough of court now. 😊
Great job Chandler 👏🏼👏🏼
You may not have noticed at the time of this livestream but you gave a good argument as to why they should have allowed “production” type evidence into evidence.
Had he started the chain of events as a producer that was not in keeping with safe practices before he took a position as an actor?
Supposedly the armorer Mr. Gutierrez, co-minguled live rounds from another set onto Rust's location and did not catch it when loading/unloading Alec's handgun. Sadly, this is why you always treat every handgun/rifle that it is loaded with real bullets at all times for safety. 😢
So if your never supposed to have live ammunition on set how the devil did the real ammunition get into the gun they gave Alex to use ???
He took her out because she was about to expose the pedophiles in a documentary. Dyor
I lived in Espãnola, North of Santa Fe. I loved visiting Santa Fe, the shops and art museums. That was 30 yrs. ago. Have fun and enjoy Santa Fe!!! ♥️😘❣️🥰💖🙏❤️🤗
I was able to watch the pretrial till the lunch break this morning....I have never seen something like this before and found it very interesting!! Thank you!!
What I did see, I liked the judge
Don't leave without seeing the Loretto chapel's staircase. It's amazing.
I very much enjoyed Chandlor. You hold everyone's attention. To touch on some great pieces. Thank you for your thoughts and opinions.
Do you think she even realizes what she’s done to herself? She was so dishonest. She didn’t even realize that she’s a liar.
Chandler, awesome job!!! ❤️💖🥰🙏🤗❣️♥️💗💓💞💞
They have acted like a corrupt courtroom already
You looked great on Court. Glad you e joyed it. Runette
Bruce Rivers, a "snitch" attorney on CZcams did this same thing on a gun range and proved how it wasn't possible to be an "accident".
I like this judge!
She listens and she's fair. She's smart!
Chandler can we call your new notebook, your 'Handy Dandy Notebook?!'
Please!!?
I like all of the attorneys on both sides so far.
Prosecutor is annoying sometimes, but she's mostly bringing her passion to the project, and i always love to see an attorney doing their craft. I liked how she prosecuted Hannah. Hannah is a piece of work. She takes no responsibility for anything. Her and her mom were a nightmare. At this point, i still think she is the catalyst and the direct reason for that live round being in that gun.
I think it's right to leave out his producer role.
They will all probably pay in civil court. And so that's where Alec should be held responsible for that role. I do think it's a separate thing.
They can't just target him as a 'criminal producer,' just because downwind of that role, he was the actor who did the alleged criminal behavior they are focusing on.
I feel like those roles do have to be separate, and since none of the other producers are being criminally charged for their roles, then Alec shouldn't be charged for his. I admit i don't know much about his actual role, and how that worked, so I could find out something that changes my mind on this.
You guys are great!
Thanks for your coverage of this case. I love how Larry stopped everything to tell us the Karen Read news yesterday!
He knows his priorities!😂
👍
What is really strange is how was Alex supposed to know that the gun had live ammunition in?!!
That's part of gun safety 101. You always treat a gun as of its loaded even if it's a toy or supposed to have blanks in it. Me personally If someone hands me a gun 1st thing I do is make sure the mag is out and there's not 1 in the chamber. A revolver you open the cylinder up and check it. Its called common sense to alot of people. Or gun safety. If you go buy a gun if you watch the person selling the gun 1st thing they do before they even hand it to you is make sure it's clear. It's common sense and gun safety.
@@gaylenrussell5793.. THANK YOU!! Some people's children 😉
Ultimately, it ended up in his hands so Check it his self. He's had 4 decades of experience. Besides the fact that you Never aim a real gun at someone, with your finger on the trigger unless you intend on firing. I'm not saying that he meant to shoot her. I'm saying he should have double checked. The gun was in his possession.
It was in his possession. You always double check and you don't aim and pull the trigger unless you intend on firing the weapon. Not saying he intentionally shot her but, it was in his hand, he should have double checked. He's had 4 decades of experience. He knows that.
I use to lose my 💩 while watching, “Perry Mason” as they pointed prop-guns in the show’s court room.
Didn’t Alex state in an interview that he took the low paying job as he was also asked to help out as a producer? I think it was one of the first interview he did after the shooting.
You two might become the new “Adam’s Rib” duo! 😃😂
My Dad taught all of us girls to shoot, early. Before being allowed to shoot it, safety protocol was followed. Every time. The big one was, no matter WHO hands you a gun, it is YOUR responsibility to check it before loading. We were also taught to unload, and hand it over "open" so it can be checked easier, and we know for certain that WE had passed it over unloaded. (Also part of his ass covering 101 course. jk 😉)
Bottom line: Last person handling any weapon, bears responsibility for safety check.
Who is that being so silly behind you? 😀
If a did what he did , I be a mess crying and freaking out. He didn't. The body language experts have an interesting take on Alex's story. 🤟
Alex was a mess when this first happened. He certainly did not shoot his friend on purpose.
Albuquerque has a tram to the top of the mountain!!!
Love u Larry, great to see u r wife.great job to u both, much love and respect, bri guy the drummer guy!
I mean fully charged laptop battery for a full day of court is kind of beginner stuff 🙄😂

34:49 Mr Baldwin was given a private class. I was given by Hannah, Mr Baldwin spent most of the class on the phone, and I believe he cut it short.
Can you tell me if i can give a 1 time pay Larry or has to be monthly??
Hello from South Dakota
Our law is that if you are born before dec. 31 , 1965 you need to go through Hunter safety .
