Is my worker's comp award included in the calculation of my income for purposes of determining whether I qualify to file bankruptcy? Yes, the Means Test requires you to include all forms of income received over the last 6 months with the exception of social security or federal disability payments. If you receive a significant lump sum award, you may need to wait several months to file bankruptcy to ensure that you qualify under the Means Test.
