  • Can I continue to operate my business if I file personal bankruptcy? Yes, you can, but if the assets of the business exceed the debt, the Trustee may have interest in selling your company to pay your creditors. If you want to file bankruptcy for your company and continue operating, do not file Chapter 7. You should consider filing a small business Chapter 11. Once the company files Chapter 7, it must cease operating.

    Hi Steve,
I have a question and hope you can answer. I’m worried to death about my finances and am afraid bankruptcy is inevitable. I live in a small town, where the busy bodies live to read the newspaper ONLY TO READ who is getting arrested, divorced, foreclosed, and my guess is WHO IS FILING BANKRUPTCY. Is there anything that can be done to keep my case private, or can I file in another county so it doesn’t appear in the local newspaper?

I’ve been talking to several lawyers, and as long as you file with a lawyer licensed in your state, you don’t have to go completely local. 🙌🏼
